HomeMy WebLinkAboutReso - CC - 066-2013RESOLUTION NO. 66-2013 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME FINDING THAT THE EXTENSION OF A CONDITIONAL USE PERMIT FOR AN AUTO RENTAL, STORAGE AND REPAIR FACILITY LOCATED AT 778 BURLWAY ROAD IS CATEGORICALLY EXEMPT FROM REVIEW UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO SECTION 15301 OF THE CEQA GUIDELINES THE CITY COUNCIL OF THE CITY OF BURLINGAME hereby finds as follows: Section 1. An auto rental, storage and repair facility has existed on property located at 778 Burlway Road since 1985. In 2003 a conditional use permit was granted for continuation of the use with a limited term. The term of the conditional use permit has been extended on multiple occasions by the City of Burlingame Planning Commission and/or City Council (on appeal). A five year extension of the conditional use permit was granted by in 2009 with an expiration date of February 14, 2014; and Section 2. On July 1, 2013 the Burlingame City Council granted the appeal of Vanguard Real Estate Holdings, LLC for an additional two year extension of the conditional use permit for the existing auto rental, storage and repair facility, extending the expiration date of the conditional use permit until February 14, 2016; and Section 3. Section 15301 of the CEQA Guidelines, promulgated by the Secretary for Resources, provides that the permitting of an existing private facility involving little or no expansion of the use are categorically exempt from the provisions of CEQA. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BURLINGAME THAT the extension of a conditional use permit for an auto rental, storage and repair facility at 778 Burlway Road for a period of two years, is Categorically Exempt from review pursuant to the CEQA, per section 15301 of the CEQA Guidelines.
