HomeMy WebLinkAboutReso - CC - 060-2013RESOLUTION NO. en -2013 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME AUTHORIZING THE MAYOR TO EXECUTE THE SECOND AMENDED AND RESTATED JOINT EXERCISE OF POWERS AGREEMENT, SOUTH BAYSIDE WASTE MANAGEMENT AUTHORITY RESOLVED, by the City Council of the City of Burlingame: WHEREAS, on December 9, 1999, the 12 member agencies of the South Bayside Waste Management Authority (SBWMA) entered into a Joint Exercise of Powers Agreement, which defined the Board of Directors to include one staff person from each member agency from a list of possible position titles; and WHEREAS, in February 2013, a Blue Ribbon Task Force comprised of elected officials (including Vice Mayor Brownrigg) from many of the SBWMA member agencies formed to discuss the Authority's governance structure and related topics; and WHEREAS, during the April 24 Task Force meeting, Redwood City staff, who provided support to the Task Force, presented information regarding the governance models of six solid waste JPAs in Northern California and four other types of local JPAs in which various SBWMA members participate; and WHEREAS, Task Force members observed that the SBWMA is the only JPA among those reviewed that has a Board comprised of staff rather than elected officials; and WHEREAS, Task Force members noted that the expertise of member agency staff was essential on the Board when the Authority was not yet staffed with an Executive Director and when highly technical matters dominated the Board's agenda; and WHEREAS, Task Force members discussed that the important business of the Board is now more policy -oriented, addressing matters like budgets, service levels and rates, which belong in the purview of elected officials who are more accountable to SBWMA rate payers; and WHEREAS, at the April 24, 2013, Task Force meeting, the Task Force voted to recommend that the SBWMA JPA Agreement be modified to define the JPA Board as being comprised of an elected official from each of the member agencies' governing bodies.
