SR -9013 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME APPROVING CLOSURE OF HOWARD AVENUE FROM HIGHLAND AVENUE TO THE EASTERN END OF THE SAFEWAY PARKING LOT AND PORTIONS OF LORTON AVENUE AND PRIMROSE ROAD FOR THE 2013 BURLINGAME ARTZFEST EVENT ON AUGUST 10 AND 11, 2013 WHEREAS, in past years, the Burlingame Chamber of Commerce has sponsored, in the Burlingame Avenue area of downtown Burlingame, the Burlingame ArtzFest, a street fair offering gourmet foods and home & garden displays; and WHEREAS, this year, because of the Burlingame Avenue Streetscape Project, the Chamber of Commerce is relocating the ArtzFest to Howard Avenue; and WHEREAS, the Chamber of Commerce has requested permission from the City to close certain streets in the City's downtown on Saturday August 10 and Sunday August 11, 2013 to accommodate the 2013 Burlingame ArtzFest; and WHEREAS, the ArtzFest is a wonderful celebratory community event benefitting the City and the citizens of Burlingame; and WHEREAS, the Chamber of Commerce has contracted with an event organizer, TeamProEvents, to produce, coordinate and mange the two-day ArtzFest; and WHEREAS, the Chamber of Commerce will pay all costs associated with the event, will provide insurance and indemnification to the City and will provide a traffic control plan in connection with ArtzFest. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BURLINGAME DOES HEREBY RESOLVE AND ORDER AS FOLLOWS: 1. The City Council approves the closure of the following streets from 2:00 a.m. Saturday, August 10, 2013 until 10:59 p.m. Sunday, August 11, 2013: a. Howard Avenue from Highland Avenue to the eastern end of the Safeway parking lot; b. Lorton Avenue between Howard Avenue and the southern end of parking lot C between Howard and Burlingame Avenue for the full duration of the Festival; c. Primrose Road between Howard Avenue and the southern end of the parking lot between Howard and Burlingame Avenues for the full duration of the Festival. d. All public parking lots will remain accessible at all times during all hours of closure. 2. Further, the City Council directs that the Chamber of Commerce, or its designee, prepare and submit to the City a traffic control plan in connection with the Artzfest event; the traffic control plan shall be reviewed by the City Traffic Engineer. Permission to proceed with the event is contingent on approval of the Traffic Engineer's traffic control plan as submitted or modified by the Chamber of Commerce. 3. Further, the City Council's approval of the street closure for the ArtzFest event is specifically conditioned upon the following: a. The Chamber of Commerce shall obtain all required permits from appropriate City departments and all other governmental agencies; b. The Chamber of Commerce shall provide and maintain necessary certificates of insurance and endorsements naming the City as an additional insured and shall hold the City harmless against any liability and/or cost arising from any aspect of the ArtzFest event, including $1M claim and $2M aggregate coverage. c. The Chamber of Commerce, or its designee, shall notify all affected residents and businesses in the greater downtown area of the schedule, dates and times of the ArtzFest event; d. The Chamber of Commerce, or its designee, must ensure that the traffic control plan is implemented and complied with; any changes to the traffic control plan must be reviewed and approved by the City traffic engineer in advance. e. The Chamber of Commerce undertakes to indemnify, defend, and hold harmless the City and its employees and agents for any claim or liability arising out of the ArtzFest and any work connected thereto'.
