HomeMy WebLinkAboutReso - CC - 056-2013RESOLUTION NO. 56-2013 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE 2' AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF BURLINGAME AND THE BURLINGAME AQUATIC CLUB, INC. FOR THE MANAGEMENT AND OPERATION OF, AND FOR THE PROVISION OF AQUATIC PROGRAMS AT THE BURLINGAME AQUATIC CENTER WHEREAS, On June 6, 2011, the City of Burlingame (the "City") and the Burlingame Aquatic Club ("BAC" hereinafter "the Parties") entered into an agreement (the "Agreement") for the maintenance and operation of, and for the provision of aquatic programs at, the Burlingame Aquatic Center; and WHEREAS, On December 7, 2012, the City and the BAC amended the agreement through June 30, 2013; and WHEREAS, the Parties are currently negotiating a permanent extension of the Agreement, and the City is currently negotiating a potential revision of its agreement with the San Mateo Union High School District for operation, management and responsibility for the Burlingame Aquatic Center; and WHEREAS, the Parties intend that BAC shall work towards operating the Community Aquatics Activities on a break-even net income basis; and WHEREAS, the City has funded the deficit during the transitional period from July 1, 2011 through June 30, 2012 in the amount of $136,000 and from July 1, 2012 through June 30, 2013 in the amount of $95,000; and WHEREAS, the Parties now agree to further allocate financial responsibility of the BAC deficit for community aquatic activities to the City in the amount of $75,000 for the period of July 1, 2013 through June 30, 2014, and this amount has been included in the City's adopted budget for Fiscal Year 2013/2014. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BURLINGAME DOES HEREBY RESOLVE AND ORDER AS FOLLOWS: 1. The City Council finds that all of the facts recited above and stated in the staff report are true and correct. 2. The City Council hereby approves and authorizes the expenditure of $75,000 in City funds as subsidy for the provision of community aquatic activities by the BAC. 3. The City Council hereby approves, and authorizes the City Manager to execute, the 2nd Amendment to the Agreement for the maintenance and operation of, and for the provision of aquatic programs Burlingame Aquatic Center.
