RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BURLINGAME REJECTING ALL BIDS FOR
FOR CONTRACT JANITORIAL SERVICES FOR CITY BUILDINGS
WHEREAS, the City of Burlingame Public Works Department On January 28,2013; staff
began advertising for the Janitorial Services Contract in the local newspapers and contractor clearing
houses for soliciting bids; and
WHEREAS, at the bid opening on February 21, 2013, two bid proposals, one from Impec
Group and one form Jam -King Commercial Cleaning, were received; Jam- King Commercial Cleaning
Services, Inc. was the apparent low bidder with a bid of $559,460; and
WHEREAS; unlrnown to Public Works at the time of the bid opening, a third bid; from
Universal Building Services, had been timely received by the City but had been misdirected into the
interoffice mail and, consequently, was not included in the bid opening; and
WHEREAS, the failure to properly include the third bid in the formal bid opening process
unduly prejudiced the third bidder, tainted the bid -opening process and gave the other two bidders an
unfair competitive advantage; and
WHEREAS, staff has determined that rejection of all bids and the re -bid ofthe contract for
janitorial services is the most appropriate manner to address this error; and
WHEREAS, under the Public Contracts Code, the City may in its discretion reject all bids;
NOW, THEREFORE, the City Council of the City of Burlingame does hereby resolve,
determine, and find as follows:
1. All bids received for the Janitorial Services Contract are hereby rejected.
2. All bonds received in connection with the bids received shall be returned to the bidders.
3. The Director of Public Works is hereby authorized to rebid the proje .

foregoing Resolution was introduced at a regular meeting of the City Council on the -4th day of March,
2013, and was adopted thereafter by the following vote:
