RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME
REVISING COUNCIL MEETING AGENDA TO REMOVE ITEMS LABELED
"NEW BUSINESS" AND "OLD BUSINESS" AND TO ADD ITEM LABELED
"FUTURE AGENDA ITEMS"
WHEREAS, for many years, the City Council meeting agenda has included
agenda items labeled "New Business" and "Old Business", which were intended to allow
Council members to ask whether the Council as a whole would consider placing a
particular item or issue on a future agenda for Council discussion and possible action; and
WHEREAS, on recent occasions, Council member discussion under
"New Business" has migrated from the narrow focus of considering a matter for a
future agenda toward a general discussion of the matter itself, and
WHEREAS, in order to ensure that the City and its legislative body do not
inadvertently stray from the parameters of Brown Act restrictions, the Council wants to
remove from future agendas the items labeled 'New Business" and "Old Business" and
replace them with the item labeled "Future Agenda Items", which more accurately
describes the nature and permissible range of any discussion;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
BURLINGAME DOES HEREBY RESOLVE AND ORDER AS FOLLOWS:
1. The City Council approves and directs the City Clerk to remove from future
agendas the items labeled 'New Business" and "Old Business" and replace them with a
single item labeled "Future Agenda Items", which more accurately describes the nature
and permissible range of any discussion under that item.
2. The City Council hereby revises the City Council Conduct Policy in the
following manner:
a. Section I, subsection C.11, is revised to read as follows:
"11. Communicate suggested items for future Council meeting
agendas during the "Future Agenda Items" portion of the Council
meeting or directly to the Mayor."
b. Section II, K, is revised to read as follows:
"The Mayor determines Council meeting agendas in concert with
the City Manager and the City Clerk. Council members should
communicate suggested items for fixture Council meeting agendas
during the "Future Agenda Items" portion of the Council meeting
or directly to the Mayor, who will decide if and when such an item
will be placed on an agenda. However, when two or more
Council members request that an item be placed on a future agenda,
the Mayor will do so within a reasonable period of time. A Council
vote can be taken to place an item on a specific meeting date."
3. Except as specifically revised herein, the provisions of the City Council
Conduct Policy shall remain in full force and effect.
I, Mary Ellen Kearney, City Clerk of the City of Burlingame, do hereby certify
that the foregoing Resolution was introduced at a regular meeting of the Burlingame City
Council held on the 4th day of February, 2013, and was adopted thereafter by the
following vote:
AYES: Councilmembers: BAYLOCK, BROWNRIGG, DEAL, KEIGHRAN, NAGEL
NOES: Councilmembers: NONE
