RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME
APPROVING AN ADDITIONAL SUBSIDY OF $32,000 FOR FISCAL YEAR 2013-2014
FOR THE BURLINGAME AQUATIC CLUB, INC. AND A SUBSIDY OF $136,330 FOR
FISCAL YEAR 2014-2015.
WHEREAS, On June 6, 2011, the City of Burlingame (the "City") and the
Burlingame Aquatic Club ("BAC" hereinafter "the Parties") entered into an agreement
(the "Agreement") for the maintenance and operation of, and for the provision of
aquatic programs at, the Burlingame Aquatic Center; and
WHEREAS, On December 7, 2012, the City and the BAC amended the agreement and
subsidy through June 30, 2013; and
WHEREAS, On June 12, 2013, the City and the BAC amended the agreement and
subsidy through June 30, 2014; and
WHEREAS, the Parties are currently negotiating an extension of the agreement, and the
City is currently negotiating a potential revision of its agreement with the San Mateo Union High
School District (SMUHSD) for operation, management and responsibility for the Burlingame
Aquatic Center; and
WHEREAS, the Parties intend and continue to intend for BAC to work towards
operating the Community Aquatics Activities on a break-even net income basis; and
WHEREAS, the City has funded the deficit during the transitional period from July 1,
2011 through June 30, 2012 in the amount of $136,000; from July 1, 2012 through June 30, 2013
in the amount of $95,000; and from July 1, 2013 through June 30, 2014 in the amount of
$75,000; and
WHERAS, the BAC has asked for an additional $32,000 for the period July 1, 2013
through June 30, 2014 because of the addition of expenses by the SMUHSD and a shortfall in lap
swim income from lost participation because of the pool's heating failure and an overly
optimistic budget; and
WHEREAS, the Parties now agree to further allocate financial responsibility of the BAC
deficit for community aquatic activities to the City in the amount of $136,330 for the period of
July 1, 2014 through June 30, 2015 and continue the agreement until the new agreement is
completed.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
BURLINGAME DOES HEREBY RESOLVE AND ORDER AS FOLLOWS:
1. The City Council finds that all of the facts recited above and stated in the staff report are
true and correct.
2. The City Council hereby approves the subsidy in the amount of $136,330 for fiscal year
2014-2015.
3. The City Council hereby authorizes the payment of an additional $32,000 to the BAC in
fiscal year 2013-2014 as a supplemental subsidy necessitated by the addition of expenses
by the SMMSD and a shortfall in lap swim income.
I, Mary Ellen Kearney, City Clerk of the City of Burlingame, do hereby ckrtify that the
foregoing Resolution was introduced at a regular meeting of the Burlingame City Council
held on the 7th day of July 2014, and was adopted thereafter by the following vote:
AYES: Councilmembers: BROWNRIGG, NAGEL, ORTIZ
NOES: Councilmembers: DEAL, KEIGHRAN
