HomeMy WebLinkAboutReso - CC - 029-2014RESOLUTION NO. 29-2014 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME, GRANTING THE APPEAL OF FLIGHTCAR, INC. AND APPROVING A CONDITIONAL USE PERMIT FOR THE STORAGE OF AUTOMOBILES WITHIN A DRAINAGE EASEMENT ON PROPERTY LOCATED AT 960 DAVID ROAD, SITUATED WITHIN ROLLINS ROAD (RR) ZONE RESOLVED, BY THE CITY COUNCIL OF THE CITY OF BURLINGAME THAT: WHEREAS, on February 24, 2014 the Planning Commission denied an application for a Conditional Use Permit for the storage of automobiles on a drainage easement on property located at 960 David Road; WHEREAS, the Planning Commission's February 24, 2014 denial was appealed by the applicant (FlightCar, Inc.), on March 6, 2014; and WHEREAS, the City Council conducted a public hearing to consider the appeal of the Planning Commission's denial of the Conditional Use Permit at its regular meeting of April 7, 2014. NOW, THEREFORE, IT IS RESOLVED AND DETERMINED BY THE CITY COUNCIL THAT: Section 1. The City Council hereby grants the appeal and approves the request for a Conditional Use Permit for storage of automobiles on a drainage easement on property located at 960 David Road, based upon the following findings: a) Storage of automobiles at proposed location will not be detrimental or injurious to property or improvements in the vicinity and will not be detrimental to the public health, safety, general welfare or convenience. The property is currently utilized for vehicle parking and equipment storage; the proposed use is consistent with usage of other similar properties within the drainage easement. b) The storage of automobiles within the drainage easement at 960 David Road is consistent all applicable policies of the Burlingame General Plan and its implementation regulations, the Burlingame Zoning Ordinance. C) Storage of automobiles within the drainage easement at 960 David Road will not necessitate the removal of any trees from the property as the site is currently used for vehicle parking/storage and equipment storage. C) Conditions are imposed upon the use to ensure that its operations are compatible with the purposes of the Zoning Ordinance and with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties and in the general vicinity, as follows: 1 RESOLUTION NO. 29-2014 1. that the project shall be built as shown on the plans submitted to the Planning Division date stamped December 11, 2013, site plan; that 41 parking spaces shall be used for auto storage only for FlightCar rental vehicles at the south end of the site without amendment to this use permit; 2. that the site shall be used for long term overflow parking for rental vehicles for up to 41 vehicles to be brought to and from the site by FlightCar employees only; that no customers shall ever visit the 960 David Road drainage right-of-way site; 3. that clear access to the parking area to the rear (north) of the site shall be maintained at all times through the FlightCar parking area; 4. that signs shall be posted along the perimeter of the site denoting area subject to flooding; 5. that if any structures or improvements are proposed for the site (including temporary or portable structures), the applicant must contact the Building Division, prior to the installation of those structures or improvements, to discuss City requirements; 6. that fire lanes and fire apparatus access be maintained to 150 feet of all parts of the property, per §503 International Fire Code; 7. that there shall be no loose trash or litter on the property; 8. that all runoff and future discharge from the site will be required to meet National Pollution Discharge Elimination System (NPDES) standards; 9. that each storm water inlet on the site shall be equipped with a sand/oil separator; all sand/oil separators shall be inspected and serviced on a regular basis, and immediately following periods of heavy rainfall, to ascertain the conditions of the chambers; maintenance records shall be kept on-site; 10. that drainage from paved surfaces, including parking lots, driveways and roofs shall be routed to storm water inlets equipped with sand/oil-separators and/or fossil filters, then the water shall be discharged into the storm drain system; the property owners shall be responsible for inspecting and cleaning sand/oil separators and changing fossil filters on a regular basis as well as immediately prior to, and once during, the rainy season (October 15 — April 1); 11. that vehicles associated with the business shall not be moved during the peak traffic hours (weekdays 7:00 a.m. to 9:00 a.m., and 4:00 p.m. to 6:00 p.m.), with 2 RESOLUTION NO. 29-2014 no time restrictions on moving vehicles on Saturday and Sunday. 12. that no fencing shall obstruct existing flow of water into and through the easement from the adjacent parcels; 13. that all the vehicles shall be relocated during any flood situations and shall be the responsibility and liability of the applicant; 14. that the applicant executes a separate hold -harmless and indemnification agreement in regard to the proposed use at this particular site, and that the agreement shall be in a form approved by the City Attorney and executed prior to issuance of the permit; and 15. that any improvements for the use shall meet all California Building and Fire Codes, 2010 Edition, as amended by the City of Burlingame; 16. that all vehicles associated with FlightCar shall be parked upon the property at 960 David Road. Vehicles shall not be parked on the public streets in the vicinity; 17. that a report on the applicant's compliance with the terms of this conditional use permit shall be prepared by the Community Development Department every six - months, with a report back to the City Council. Section 2.
