. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME
AUTHORIZING AND APPROVING A COMPROMISE AGREEMENT AND
RELEASE BETWEEN THE CITY OF BURLINGAME AND KENNY MOY
REGARDING PROPERTY DAMAGE FROM A BROKEN WATER LINE
WHEREAS, Kenny Moy and Elaine Ko ("Claimants") filed a claim against the city
in the amount of $72,143.45 for property damage resulting from a broken water line; and
WHEREAS, the city disputed the amount of Claimants' damages; and
WHEREAS, Claimants and the city reached a compromise agreement to
fully settle the claim in the amount of $58,632.26; and
WHEREAS, it is in the best interest in the city to effectuate the compromise
agreement for the amount of $58,632.26 to fully settle this claim.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
BURLINGAME DOES HEREBY RESOLVE AND ORDER AS FOLLOWS:
Section 1. The City Council hereby authorizes $58,632.26 to be paid to Claimants
to fully settle their claim against the city.
Section 2. The City Attorney is authorized and directed to execute such documents
and take such other measures as are necessary to carry out the purpose of this Resolution.

I, Mary Ellen Kearney, City Clerk of the City of Burlingame, do hereby certify that the
foregoing Resolution was introduced at a regular meeting of the Burlingame City Council
held on the 7th day of April, 2014, and was adopted thereafter by the following vote:
