HomeMy WebLinkAboutReso - CC - 064-2015RESOLUTION NO. 64-2015 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME OPPOSING AB 57 AND AUTHORIZING THE MAYOR TO SIGN A LETTER IN OPPOSITION WHEREAS, the City of Burlingame supports the development of a robust and technologically advanced wireless infrastructure; and WHEREAS, local conditions vary widely and should be taken into account in how a wireless infrastructure gets built out; and WHEREAS, allowing for adequate review and, where appropriate, public input, is a vital part of ensuring that wireless infrastructure works for both industry and local neighborhoods; and WHEREAS, recent proposed legislation, in the form of AB 57, would have the effect of curtailing local review in a manner that could damage the public process and give inadequate weight to local considerations in the neighborhoods where wireless facilities will be located; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BURLINGAME DOES HEREBY RESOLVE, DETERMINE, AND FIND AS FOLLOWS: 1. The City Council opposes adoption of AB 57, as it is currently proposed, for the reasons stated above. The Council supports amendment of the bill to provide to remove a "deemed granted" provision and to restore appropriate local review of wireless facility applications. 2. The City Council hereby authorizes staff to work with appropriate agencies to craft an opposition letter for the Mayor's signature that is consistent with the City's prior approach to wireless regulation as evidenced in existing code and litigation materials.
