I. Call to Order
The meeting of March 20, 2001 was called to order by President
Cecile Coar at 4:30 pm.
II. Roll Call
Trustees Present: Cecile Coar, Andrew Gurthet, Mary

Staff Present: Alfred Escoffier, City Librarian

III Warrants & Special Fund
The Trustees unanimously agreed to approve the warrants as

IV. Minutes
The Trustees unanimously agreed to approve the minutes of the
February 20, 2001 meeting. M/S/C (Gurthet/Herman)
V. Correspondence
Correspondence mailed in the packets was reviewed.
A. Internet Access - The Trustees discussed Alameda
County Superior Court Case No. V-015266-4 Kathleen R. et al,
Plaintiffs and Appellants, v. City of Livermore, Defendant and
Respondent in which the Court held that a city is not subject to
suit for damages or an injunction for offering unrestricted access
to the Internet through computers at a public library.

A. City Librarian's Report - Al Escoffier
The City Librarian reviewed his report highlighting the following
issues.
1. Budget Preparation - Preparation of the City Budget for
the fiscal year July 2001 - June 30, 2002 is in progress.
Areas targeted for increases are personnel, building
maintenance and energy costs.
2. Energy Update - Rob Mallick, has contacted Peter
Colenbrander, the electrical engineering consultant who
designed the library's lighting system. Mr. Colenbrander will
review the lighting system onsite with the intent of
determining if it is possible to conserve more energy and cut
costs. Trustee Herman requested further information on
obtaining a generator for emergency back up. Mr. Escoffier
will look into the matter.
B. Foundation Report - Mary Herman
The Foundation is looking forward to taking an active part in
the renovation of the Easton Branch in much the same role it
played in the reconstruction of the main library. Colman Connelly,
a new Foundation member has agreed to assist Mary Herman with
the annual Employment Achievement Award Dinner in December.
VIII. Unfinished Business
A. Easton Upgrade Project - Kathy Page and the project
committee have determined that the Easton Branch renovation will
require more construction work than originally anticipated. Library
patrons will be given the opportunity to express their views on
what services are a priority at a branch facility later in the Spring.
Kathy Page will help set up the format to gather this information.
IX. New Business -
A. Change of Two Board Meeting Dates - Trustee Herman
made a motion to accept the City Librarian's proposal that the
Board meetings in July and November be changed to the second
Tuesday of the month instead of the third Tuesday. The new dates
would be July 10th and November 13th. M/S/C

B. Reappointments to Board - The City Librarian noted that
Trustee Berger's and Coar's terms on the Library Board will expire
June 30, 2001. The City will send each of them notification of
�- reappointment procedures before the June 301h date.
C. May 15, 2001 Trustee Meeting - President Coar advised
the Board that she would not be able to attend the May 15th
meeting but would be available May 22nd. The Board agreed to
make this an agenda item for the April 17th meeting.
X. Adjournment The meeting was adjourned at 5:30pm. M/S/C
(Herman,Guerthet) The next meeting of the Library Board of
Trustees will be held April 17, 2001 in the Library Conference
Room.

Here is the exchange I had with the Mayor about the closing of the
library on Easter Sundays. He asked for a suggestion as an
alternate. I
have two: 1) the Sunday before Memorial Day, 2) Mother's day Sunday.
I happened to be at the Library on Primrose Rd. today. I noticed that
it is
open every Sunday except next Sunday, Easter. As it is open normally
every
Sunday, including today which is a major Jewish religious holiday and
closed
only apparently on Easter, a major Christian religious holiday, how is
it
that doesn't violate constitutional church/state provisions as a policy
endorsing/supporting Christianity exclusively? David Jonson

The Library Board decides when to open or close the Library. The
Library is
closed on various days during the year.
The Library is closed the day before Labor Day. It seems that all
Public
Libraries are closed on Easter Sunday, not just Burlingame's. This
gives
employees a chance to take a Sunday off.

communicate directly with the Board of Trustees of the Library.

L "ERAF ORPHAN"BILL BY ASSEMBLYMEMBER DUTRA SET FOR HEARING
AB 315 by Assemblymember John Dutra (D-Fremont) has been set for hearing in the Assembly Local
Government Committee on Wednesday, April 18, 2001 at 1:30 p.m. The bill, which is co-authored by
Assemblywoman Helen Thomson (D-Davis) will provide property tax relief to so-called"ERAF Orphan
libraries." Specifically, the bill provides relief to county dependent library districts and independent
library districts, similar to SB 94-Torlakson and SB 74-Speier.
Please take a moment today to write the members of the Assembly Local Government Committee and
urge their support for this important bill, which will provide needed assistance to libraries. The

II. SB 94-TORLAKSON: AMENDED TO BENEFIT ADDITIONAL LIBRARIES
You will recall that Senator Tom Torlakson(D-Antioch) and Assemblywoman Liz Figueroa(D-
Fremont)have introduced SB 94, an ERAF "Orphan libraries"bill, which is scheduled for hearing in the
Senate policy committee next Wednesday. The bill targets relief to county dependent library districts
and independent library districts.
Amendments added to the measure late this week will also make provisions for assisting county general
fund libraries. The amendments state that a"county auditor shall transmit up to 3 percent of the
Educational Revenue Augmentation Fund obligation of the county or city and county to a county
general fund library, if a majority of the entire membership of the board or supervisors of the county or
city and county has approved a resolution that expressly provides for that annual transfer." When
defining a"county general fund library,"the bill assumes two definitions as follows: "(A) a county free
library, established pursuant to Article 1 (commencing with Section 19 100) of Chapter 6 of Part 1 I of
Division 1 of Title 1 of the Education Code, for which a separate property tax rate was not levied in the
1977-78 fiscal year, (B) a library located in a city and county." (San Francisco).
Yesterday we spoke with Senator Torlakson,who explained that the amendments to SB 94 address his
desire to try to assist more libraries in need. He stated that the county general fund library budgets were
also significantly impacted by the property tax shifts, and hoped to provide them some additional relief
through this measure.

RE: Filtering and Federal Funds
You are no doubt reading a good deal about filtering of the Internet and the
potential withholding of Federal Funds to local public libraries. While this is
a serious issue for many libraries in the state and the nation, it is not a
financial issue for us.
The Burlingame Public Library does not receive any Federal Funds or grants
for any purpose. We are supported entirely by local funds.
We do receive state funding for Interlibrary Loan and Direct Loan
reimbursements for serving non-residents, but this funding is state funding
and not affected by the new legislation.
