HomeMy WebLinkAboutReso - CC - 117-2016RESOLUTION NO. 117-2016 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME AUTHORIZING THE CITY MANAGER TO EXECUTE SIDE LETTER AGREEMENTS WITH THE POLICE OFFICERS ASSOCIATION, THE TEAMSTERS LOCAL 856, AND THE AFSCME LOCAL 829 ADMINISTRATIVE AND MAINTENANCE UNITS RESOLVED, by the City Council of the City of Burlingame: WHEREAS, the City of Burlingame and representatives from the Police Officers Association, the Teamsters Local 856, and the AFSCME Administrative and Maintenance Units have met to discuss the terms and conditions of the attached side letter agreements; and WHEREAS, the City and the bargaining units wish to amend, via side letter agreements, some of the language in the Memorandums of Understanding (MOUs) to address administrative changes to existing language in the MOUs; and WHEREAS, the three issues that the City and the bargaining units discussed, as applicable, are retiree medical, flat rate premium pay, and uniform allowance; and WHEREAS, the City and the AFSCME Administrative and Maintenance Units agreed to side letter language on retiree medical, flat rate premium pay, uniform allowance and the transfer of three classifications to the Maintenance Unit; and WHEREAS, the City and the Police Officers Association agreed to side letter language on uniform pay; and WHEREAS, the City and the Teamsters agreed to side letter language on uniform NOW, THEREFORE, BE IT RESOLVED, 1. The attached side letter agreements containing the language approved by the various bargaining units, as contained in Exhibits A, B, and C are hereby approved. 2. The City Manager is authorized and directed to execute the side letter agreements with the Police Officers Association, the Teamsters Local 856, and the AFSCME Local 829 Administrative and Maintenance Units. Section 18 will be amended to read as follows: Effective January 1, 2011, the city agrees to pay One Thousand Eighty Five Dollars ($1,085) annually per employee. Effective January 1, 2012 the City agrees to pay One Thousand One Hundred Ten Dollars ($1,110) annually per employee. Uniform allowance will be paid biweekly to conform to PERS guidelines. It is understood that the City shall provide and maintain all employees with required safety equipment. Any failure or refusal by an employee to care for and maintain a proper uniform or equipment shall be deemed cause for discipline. Section 16 Uniform Allowance. Section 15 will be amended to read as follows: 15. UNIFORM ALLOWANCE Effective January 1, 2005 the City agrees to pay a uniform allowance of Eight Hundred and Fifty Dollars ($850) per year per employee. Approved and Accepted: For Teamsters Local 856 Date: Date: SIDE LETTER AGREEMENT BETWEEN THE CITY OF BURLINGAME AND AFSCME 829 Administrative Unit December 9, 2016 Representatives for Local 829 Administrative Unit, Council 57 American Federation of State, County and Municipal Employees, AFL-CIO hereinafter "AFSCME 829" and representatives for the City of Burlingame, hereinafter "City" have met and conferred in accordance with Government Code Section 3500 and have mutually agreed to modify the Memorandum of Understanding between the parties, which expires on June 30, 2018, in the following manner: Retiree Medical for Employees Hired Prior to March 31 2008 and Retire on or after August 1. 2012 Effective Jan. 1, 2012, employees hired priorto March 31, 2008, who retire from the City with 5 years of City service, will receive a retiree medical benefit in accordance with the following: • For eligible retirees who are under the age of 65, the City contribution will be equivalent to the medical premium for the CalPERS Bay Area Region for: • Single Coverage: Blue Shield Access HMO • 2 -Party Coverage: Blue Shield Access HMO • Family Coverage: Kaiser For eligible retirees who are 65 years of age or older and enrolled in Medicare, the City contribution will be equivalent to the medical premium for the CaIPERS Bay Area Region for: • Single Coverage: Blue Shield Access HMO • 2 -Party Coverage: Blue Shield Access HMO • Family Coverage: Kaiser If Blue Shield Access HMO or Kaiser Is no longer offered by CaIPERS medical, the employee will receive the contribution equal to the third highest cost plan offered by CalPERS medical. Occupational, Department, Premium Pay & Reimbursement Provisions Training Required Licenses and Certificates - In the event of changes to any state or federal requirements which require licenses or certificates for an employee to continue work in their current job classification, the City agrees to pay the cost of training necessary to meet the new requirements. This shall include training costs and reasonable paid work time for taking examinations. Ordinary drivers' licenses are not included. This is In addition to the current City contribution forjob-relatedtraining in the City Administrative Procedures. Clothing and Footwear— Effective July 1, 2017, uniform allowance will be paid bi-weekly with the regular payroll check. Parkins Enforcement—Effective 7/1/2015 Parking Enforcement Officers and Parking Meter Workers shall receive an annual uniform allowance of eight hundred and Fifty dollars. ($850). Police Clerks — Effective 7/1/2015 Police Clerks shall receive an annual uniform allowance of seven hundred dollars ($700). Building Inspection Certification and Pay—The City shall provide certification payfor building Inspection certificates as follows: Building Inspector Certification Combination Inspector Certification Plans Examiner Certification Approved and Accepted: For AFSCME 29 Administrative Unit $107 per month $107 per month $107 per month For City of Burlingame Date: Date: Side Letter of Agreement Between The City of Burlingame And AFSCME Local 829 /Maintenance Unit December 9, 2016 Representatives for the City of Burlingame and representatives for AFSCME Local 829 Maintenance Units have agreed to the following: • Effective on January 1, 2017 the following classifications shall be moved from the bargaining unit represented by AFSCME Local 829 Burlingame Association of Mid -Management to the bargaining unit represented by AFSCME Local 829 Malntenance Unit. • Street & Sewer Supervisor • Water Operations Supervisor • Water Quality Supervisor o The above classification shall continue to receive, until they are transferred to the bargaining unit represented by AFSCME Local 829 Maintenance Unit, the following benefits: o All benefits and rights specified in the AFSCME Local 829 BAMM MOU. o They shall continue to receive the following benefits in accordance with the established past practices; ■ Standby Pay • On -Call Pay ■ Call Back Pay FOR THE CITY Date: • Weekend Duty Pay • Over Time Compensation Upon transfer to the bargaining unit represented by AFSCME Local 829 Maintenance Unit, the above classifications shall receive all rights and benefits specified in the AFSCME Local 829 Maintenance Unit. • There shall be no impact on an employee's seniority or benefits based the employee's date of hire or based on the years of service with the City of Burlingame. ■ incumbents in the classifications that will be transferred to AFSCME Local 829, who have administrative leave hours on the books, will be paid out for the accrued hours. The employees in the above classifications will maintain a separate vacation selection process and calendar.
