Home My WebLink AboutReso - CC - 114-2016RESOLUTION NO. 114-2016 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME DECLARING THE RESULTS OF THE MUNICIPAL ELETION CONSOLIDATED WITH THE NOVEMBER 8, 2016 PRESIDENTIAL ELECTION WHEREAS, a Municipal Election was held in the City of Burlingame on Tuesday, the 8th day of November, 2016; and WHEREAS, the Board of Supervisors of San Mateo County was duly requested and did consent to a consolidated election pursuant to the Elections Code; and WHEREAS, the County Clerk was duly requested to hold the election; notice of the election was duly and regularly given as required by law; voting precincts were duly established, election officers were appointed and voting supplies furnished; in every respect and manner the election was held and conducted, and the votes cast were received within the time and manner prescribed by the law of the State of California controlling elections in general law cities; and WHEREAS, pursuant to Elections Code §§ 10262, 10263, and 10264, the City Council of the City of Burlingame duly convened in the Council Chambers at City Hall on the 19th day of December, 2016, following receipt of the County Clerk's Certificate of Election, to accept the Certificate of the canvass of the returns of the election, and to declare the results of the election; and WHEREAS, as provided by the canvass, the City Council finds that the number of votes cast, the ballot measure for which such votes were cast, and all other matters required by law are hereinafter stated. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BURLINGAME DOES RESOLVE AS FOLLOWS: 1. The election held in the City of Burlingame on the 8th day of November, 2016, was conducted in the time, manner and form required by the laws of the State of California governing elections in general law cities. 2. The number of ballots cast in the election, and the number of votes cast at each precinct and in the City for and against the ballot measure are as set forth in San Mateo County Elections' Certificate, attached hereto and incorporated herein. 3. At this Municipal Election, the measure submitted to the voters to amend the Burlingame Municipal Code to enact rent stabilization and just cause for eviction and repeal prior restrictions on the regulation of sale or rental price of real estate received the following vote count: YES: 4,668 NO: 9,350 4. A simple majority (50%+1) was necessary for Measure R to pass; as it did not meet this minimum. Measure R failed. 5. The City Clerk is requested to deliver the certificate of election as provided in the Elections Code. I HEREBY FURTHER CERTIFY that the record of votes cast at said election is set forth in Exhibit "A" attached hereto and incorporated herein by reference as though fully set forth at length.
