A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN
ADMINISTRATIVE SERVICES AGREEMENT AND A HRA BUSINESS
ASSOCIATE AGREEMENT WITH EMPLOYER BENEFIT ADMINISTRATORS,
LLC TO PROVIDE A RETIREE HEALTH SAVINGS PLAN TO CITY
EMPLOYEES AND AN AGREEMENT WITH MG TRUST COMPANY, LLC TO
PROVIDE TRUSTEE CUSTODIAL SERVICES FOR THE RETIREEE HEATLH
SAVING PLAN ASSETS
WHEREAS, the City previously offered a retiree medical program for employees with five
or more years of service which consisted of payments of health care premiums after retirement
from the City; and
WHEREAS, given the cost of this ongoing retiree medical benefit, the City negotiated a
series of lesser retiree medical benefits that would come into effect successively based on date
of hire; and
WHEREAS, the City currently has four tiers of retiree medical programs, with the final tier
requiring that the City establish a Retiree Health Savings (RHS) Plan; and
WHEREAS, this fourth tier benefit requires the City to provide a Retiree Health Savings
Account to employees who work at the City for more than five years and to make monthly
contributions into the account for active employees in this tier; and
WHEREAS, in order to make contributions into a Retiree Health Savings Account, the
City needs to contract with a provider to provide trustee custodial services for the Plan and to
manage the plan funds; and
WHEREAS, the City has selected Employer Benefit Administrators to perform these
services; and
WHERAS, City Council authorization is required to authorize the City Manager to
negotiate and execute the necessary agreements to initiate a HRA Plan.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Burlingame does
hereby authorize the City Manager to negotiate and execute an Administrative Services
Agreement and a HRA Business Associate Agreement with Employer Benefit Administrators,
LLC to provide a Retiree Health Saving Plan and an Agreement with MG Trust Company, LLC
to provide trustee custodial services for the Retiree Healy Saving Plan,assetg. i

the foregoing resolution was introduced at a regular meeting of the City Council held on the 7`h
day of November, 2016, and was adopted thereafter by the following vote:
