ORDINANCE N0. 70.
AN ORDINANCE FOR THE PRESERVATION OF PUBLIC HEALTH IN THE
CITY OF BURLINGAME AND THE CREATION AND APPOINTMENT OF A BOARD OF
HEALTH AND HEALTH INSPECTOR AND DEFINING THE DUTIES OF SAME.
THE BOARD OF TRUSTEES OF THE CITY OF BURLINGAME DO ORDAIN
AS FOLLOINS:—
Section No. 1. The Board of Trustees of the City of
Burlingame do hereby create in and for the City df Burlingame a
Board of Health of five (5) citizens of the City of Burlingame to
be known as the Board of Health, two of which shall be physicians;
Section No. 2. Said Board shall be appointed by the
President of the Board of Trustees of the City of Burlingame and shall
hold office for a period of four (4) years from and after the date
of their appointments; provided, however, that the first Board shall
so classify themselves by lot that three will go out of office at
the end of the second year and two at the end of the fourth year;
Section No. 3. The President of the Board of Trustees of
the City of Burlingame shall at the first regular monthly meeting
in the month of July of each and every year appoint such citizens
to fill such vacancies caused by the expiration of the term of such
offices as he shall determine and in the event a vacancy occurs
for any other reason than the expiration of the term of office, he
shall appoint such citizen or citizens to fill the unexpired term
or terms of such office as he shall so determine.
Section No. 4. The Board of Health shall have the power to
devise ways and means and enforce same as will, in their judgment,
best promote the health of the City and rrevent the spread of disease;
to enter into and examine in the daytime houses, stores, vehicles and
places in the City, to prevent and forbid communication with infected
families or houses; to recommend to the Board of Trustees in meeting

whenever they deem it necessary such sanitary measures as they may
agree upon as advisable and to co-operate with them in carrying the
same into effect;
Section No. 5. The Board of Trustees of the City of Burlin-
game do create as a subordinate office to the City of Burlingame
as a co-operative agency to the Board of Health the office of
Health Inspector.
Section No. 6. It shall be the duty of said Health Inspector
immediately after his appointment, to make a systematic and thorough
examination of all parts of the City where any noxious or offensive
substances are supposed to exist, and for this purpose he shall be
permitted, in the daytime, to enter any house, store, stable or
other building, for the purpose of examining cellarsip vaults, sinks,
drains, or cess pools; and it is hereby made the duty of said Health
Officer to enter on all grounds, premises or lots where offensive
or noxious substances are to be kept; and all pools, sinks, vaults,
drains, or low grounds to be cleansed, fulled up or otherwise im-
proved; require all privies to be chi and kept in good condition;
to require the use of such disinfectants and in such quantities as
the Board of Health may direct, and to cause all dead animals or
other nauseous and unwholesome substances to be buried ore removed
beyong the limits of the City. It shall be his duty to notify the
occupant (if any) or owner, or agent of any lot, building or premises
upon which any offensive substnaees may be found, requiring them to
remove the same forthwith; and should he deem it necessary he may
specify how said premises shall be cleansed or purified; and should
the same not be done forthwith, or if the owner or occupant cannot
be found, he shall cause the same to be done at the expense of the
City, keeping an account of said expense, which he shall collect,
by suit if necessary, against the occupant, owner, or agent, in the
name of the City, as for money paid at his or their request; and he
shall also act as agent of said Board of Health in carrying out their
instructions.

Section No. 7. Whenever any case of contagious disease shall
have been reported to the Board of Health it shall be their duty to

ices so infected a public notice of the existence of said disease
in ouch form as the Board of Health may determined; and it shall be
the duty of the'occupant of said premises to Bee that said notice
remains where the same shall have been posted by said Health Of:f c' r
until removed by him , or his order.
Section No. 9. The word year within the meaning of this ordi—
nance is from July 1st to July 1st.
Section No. 9. Any person, firm or.corporation violating any
provision of this ordinance shall be fined in a sum not less than
Twenty (20.00) Dollars or more than Two Hundred ($P-00.00) Dollars
or by imprisonment in the City Hail not exceeding ten (10) days,
or by both such fine and imprisonment.
Section No. 10. This ordinance shall belazblished for two (2)
successive publications in the Burlingame Advance, a newspaper pub—
lashed in said City.
I HEREBY CERTIFY that the foregoing ordinance was introduced
