No 65 AN ORDINANCE REGULATING THE LAYING AND MAINTAINING OF PIPED AND CONDUITS IN THE STREETS OF THE CITY OF BURLINGAME AND PROVIDING CERTAIN PREREQUISITES NECESSARY TO 22 THE EXERCISING THE RIGHT TO DO SAME— BEING AN ORDINANCE SUPPLEMENTARY TO ORDINANCE Nogk%x 30 OF THE CITY OF BURL INGAME* The Board of Trustees of the City of Burlingame do ordain as follows, SECTION No I; No person, firm or corporation shall exercise any franchise or privelege to lay or maintain any pipes or conduits in or under any street of the City of Burlingame for the transmission of gas, water, heat steam or other substance without having obtained a grant theref6r from the City in accordance with the City Charter and all such Ordinances pertaining to the said laying or maintaining of pipe, pipes conduit or conduits unless such firm or corporation is entitled to do so by direct and unlimited authority of the Constitution of the State of California or of the Constitution cand laws of the United States , SECTION No 2: It shall be unlawful for any person, firm or corporation to make any excavation in any street for any purpose without first obtaining perms cion in writing from the Superintendent of Streets of said City in accordance with Ordinance No 30 of the City of Burlingame and its amendments thereto; that before issuing the permit the Superintendent of Stre'dta must require said applicant therefor to state the purpose for which the excavation is to be made and show legal authori*y to occupy and use the street for that purpose., as granted under. Section I of this Ordinance. SECTION +3. Any person', firm or corporation violating any of the J provisions of this Ordinance shall upon conviction thereof be fined in a Sum not less than One hundred dollars and not more than Three hundred dollars, or by imprisonmen7.r in the City Jail not less than one (I) month or more than six (6) months or by both such fine and imprisonment, SECTION 4, Th6s Ordinance shall be published for two (9) succesive publications in the Burlingame Advance, and be in force and effect from and after the date of its passage.
