CITY OF BURLINGAME
CALIFORNIA
ORDINANCE NO. 127
An ordinance regulating the construc-
tion, erection, enlargement, raising,
alteration, repair, removal, mainte-
nance, use and height of buildings.
Establishing fire limits and repealing
all ordinances In conflict with this or-
dinance.
THE BOARD OF TRUSTEES OF THE
CITY OF BURLINGAAIS DO ORDAIN
AS FOLLOWS:
Section 1. This ordinance shall be
known as "The Budding Law" of the
City of Burlingame.
Section 2. ThisOrdinanceshall apply
to all buildings hereafter to be erected,
constructed, al[et'ed, repaired, raised,
added to or built upon within the
boundnrles of the City of Burlingame.
Boundary Lines of the Areas Within
Which Various Classes of Buildings
May Be Erected.
Section 3. That portion of the City
of Durling'ame within the boundary lines
in this section hereinafter It forth
shall be known as the fire limits within
which It shall be unlawful to erect ar
construct frame or woolen buildings, of
to alter, enlarge, repair, add to or build
upon, any building or buildings except
as in this ordinance otherwise pro-
vided.
The fire limits are as follows:
Beginning at a point of cmnmence-
ment on the northeasterly line of Pl a-
rose Road a distance of one hundred and
eighty feet southeasterly from Burlin-
game avenue; thence along the nm'th-
westerly aide of the creek in a north-
easterq- direction and parallel to Sol -
bucolic Avenue to Part: Road; thence
continuing accuse Park load in the same
direction to the southwesterly line of
Middlefield Road, thence at right angles
in a southenstelly dircetion to the
northwesterly it,,, of Howard Avenue;
thence at right angles along Howard
.Avenue in a northeasterly direction
crossing Middlefield Road, Hatch Alley,
highland Avenue, San Abutco Olive.
Southern Pacific Right -of -\\'ay and

RELATING TO ISSUANCE OF PER-

CATIONS AND STATEMENTS AND
DEMOLITION OF BUILDINGS.

Application for Permit
Section 5. The permit may be applied
for and obtained by the owner or lessee
direct on acting through an architect,
engineer contractor at- other agent.

It shall give the name and residence
address of the actual owner or owners
Of the land and of the building or
structure, the name and residence ad-
dress of lessee or lessees if an, and the
mune and address of the architect,
engineer or designer of the building or
structo'e.
The application shall be made upon
blanks furnished by the Hoard of Trus-
tees and shall conform to the require-
ments as indicated an the blanks so
furnished.
The application shall be accompanied
by plans and specifications which shall
clem'ly show all parts of the construc-
tion.
Said application and Copy of the sPe-
cifieations and plans, shall be kept on
file by the Hoard of TI'tmtee6, and the
erection, construction or alteration of
said building, structure. or any Part
thereof, rhea proceeded with shall be
-ousnacted In accordance with such ap-
proved copy or specifications and Plans',
and any modification in drawing' or spe-
,himilions made after approval by said
Board shall be subject to its further
approval.
When the estimated cost of erecting,

Demolition of Building
Section 7. When a building or shruct-
tile is to he denmlishcd it shall be done

satisfactory to the Board of Trustees-.
Said owner or lessee shall in all cases

building is ready for inspection.
Certificate of Occupancy to Be Issued
Section S. It shall be the duty of the

No person, firm m' corporation shall
occupy any building m' structure until
such certificate has been issued.
Temporary Certificates of Occupancy
Section 9, The Board of Trustees may
issue a certificate of temporary occu-
pancy, allowing the Ilse of a portion
ur portions of any budding, provided
said potion or portions of said building
has been erected or constructed in ac-
cordance with all the requirements of
this Ordinance governing the erection
and construction of said building.
Non -Liability of City for Damages
Section 10. Every application for a
building permit shall contain an agree -

which may accrue from use or occu-
pancy of the sidewalk, street or sub-
space.
Fees for Permits
Section 11. Thi_ applicant or appli-
cants for such building permit shall pay

Classification, Description, Limiting Di-
mensions and Restrictions as to
Use of Buildings.
Section 13. For the purpose of this
Ordinance buildings are divided into
"Class C" "Slill Construe tion" and
"Frame or Woudeo Buildings."
Class "C" Buildings
Section 14. Class ^C" buildings are
defined us those having exterior walls

Reinforced Concrete Walls

Construction
The fulluwing conditions shall he ob-

shall be removed until all parts of the

mar come upon them during construc-
tion.
Unit Loads of Masonry
Section 18. The following unit load
per square feet must not be exceeded:
Brick Work, lime mortar........ 7 tons

Granite .......................... 25 tons
Test to determine the crushing strength
of concrete shall be made by a compe-
tent engineer under the direction of
the Board of Trustees. Tests of any
members of reinforced concrete struc-
ture shall be made by the owner, when
required by the Board of Trustees, and
said tests shall show that the members
tested will safely carry twice their des-
ignated load, and without deflecting
more than 1-700 of the span.
Service Pipes and Cutting of Concrete
or Reinforcement
Section 19.
inConduits or pipes foc con-
veying electricity, all or gas may be
embedded in the concrete except in col-
umns, provided they are of such size
and placed so as not to weaken the
structure of its fireproofing in any way.
Pipes conveying liquids in any form
are not to be embedded in any part
of the structural concrete except as may
be necessary to pass through floors and
walls.
No drilling into or cutting of the fire-
proofing or of steel reinforcing spirals,
hoops, stirrups or rude in any columns
or beams for the purpose of attaching
fixtures, hangers or for any purpose
which kill in any way injure the con-
crete or reinforcing in the same, is to
be permitted.
Special Provisions Relating to Class "C"
Bulldings
Section 20. Class "C" buildings shall
ire built with brick, stone or concrete
walls supporting the adjacent floor
loads incl with the interior floor loads
supported by studded partitions, or by
wooden or steel or cast iron columns and
wooden or steel girders. Floor joists
-may be of wood.
The limit of height shall be eighty-

Class "C" buildings may be built to
the maximum height without lathing if

Class "C" buildings may be built any-
where in the City. ,
Tenement Houses and Apartment Houses
Tenement houses and apartment
houses shall be constructed in accord-
ance with the provisions of that certain
act of the legislature of the State of
California entitled: "An act to Regulate
the Building and 0111111111- of Tene-
ment. Houses in Incorporated Towns, In-
corporated Cities. and to Provide Penal-
ties for the Violation Thereof and All
amendments Thereto."
Exits for Frame Lodging, Apartment
and Tenement Houses, Hotels,
Hospitals and Asylums
Finnie buildings used as lodging,
apartment and tenement houses, hotels,
hospitals, or asylums shall have on each
floor open halls at least three feet and
six inches wide, which shall lead to all
fire escapes.
Fire Escapes
For the proper and necessary printer -
tion of life and property all buildings
hereinafter designated in this section
and Ordinance that may be hereafter
erected and built in this city shall be
provided and equipped with fire escapes,
as follows:
Every building that is occupied or
so constructed as to be occupied by two
or more families on the third stmt', not
having proper and sufficient exits or
facilities for escapes in case of fire, and
every building four or more stories fn
height, and every building used or oc-
cupied as a theatre, hospital, tenement
house, -apartment house, lodging house,
or for a factory, mill or manufactory, or
for offices, moth shop, or public enter-
tainments massemblages, above the
second story, and every school building
of more than two (2) stories in height,
shall be provided slid equipped with
metallic fire escapes combined with suit-
able metallic balconies, platforms and
railings, firmly secured to the outer
walls, and erected and arranged in such
a way and in such proximity to one or
.are windows or to as many windows of
each story above the first as may be
necessary to make and render said fire
escapes readily accessible, safe and ade-

Section 21. Inside loads shall be sup-

Timber Columns

In lieu of a brick or stone chimney
as herein before provided, there may be
erected a chimney known as a "Patent
Chimney-." In no case shall a stove-
pipe enter the bottom of a patent chim-
ney. No patent spoke flue shall be less
than seven inches inside measurement.
If a patent chimney be erected on the
outside of a building it shall rest on a
substantial iron bracket. If supported
by brackets. file brackets must be of
metal and fastened to studding with
bolts and nuts: screws or lag screws
shall not be allowed.

Fireplaces
All fireplaces and chimney breasts
where utantels are placed, except as prq-
vided for patent chimney fireplaces,
whether intended for ordinary fire-
places or not, shall have trimmer arches
to support the hearth arches and shall
be of brick, atone, burnt tiny or c[m-
crete, at least twenty inches wide of-as-
med from the face of the chimney breast
and their length shall not be less than
the width of the chimney breast. Wood
centers shall be removed Iron ander
trimmer arches and no timber shall be
placed under any fireplaces or hearths.

Fireplaces shall have arched beads

All fireplace openings where furred

shall not be placed under the iron platen

Removal of Paint from Building.
Section 53. It shall be unlawful for
any person, association Dl- corporation to

undertae the removal of paint from any
wooden building or other structure by
the Process of burning without first
having given Clue Fire Marshal of the
Fire Deportment at least three (3)
days' written notice of intention to per-
form such work, and without having
secured Prmission from said Fire Mar-
shal as a precaution against fires and
conflagrations which alight arise from
the careless performance of said work.
Board of Trustees to Stop Construction
of Certain Buildings
Section 54. The Diard at' Trustees

struction of any building or the making
of any alteration Or repairs to any

Inspectors' Right to Enter Buildings
Section 56. The inspectors of the
Board of Trustees and of the Depart-
ment of Health. so far as may be neces-
sary for the performance of their duties,
shall have the right to enter any new
or unoccupied building, or any build-
ing under construction, repair, altera-
tion or removal, or any building alleged
to be unsafe, or a menace to life and
limb. upon showing their' badge of office.
Section 5T. This Ordinance shall in
no way affect Ordinance No. 119 of
the Citv of Burlingame.
Section 58. Where any part of this
Ordinance shall he declared invalid, it
shall in no ways affect the other Pmts.
Penalty
Section 59. Ally person, firm, com-
pany or corporation that violates, (Its -
obeys, omits, neglects or refuses to cam -
ply with, or that resists or opposes the
execution of any Of the provisions of this
Ordinance, shall be guilty of a rinfil
meanor and upon conviction thereof
shall be punished by it One not exceed-
ing five. hundred ($500) Dollars, or by
ftnprisonment for not mare than six (6)
months, or by both such role and im-
prisonment and every such person. firm.
company or corporation shall be deemed
guilty of a separate offense fat' every
day such violation, disobedience. cnlfs-
stou, neglect, or refusal shall continue,
and shall be subject to the penalty" un-
posed by this section to, each and every
separate offense; and any builder or
contractor who shall cents ti CI any
building in violation of any Of the Pro-
visions of this Ordinance, and any ar-
chitect having charge Of such Indlding
who shall permit it to be se const'ucted,
shall be liable to the penalties provided
and imposed by this section.
