HomeMy WebLinkAboutOrd 0240�vta,•tcL #�Z f o AN ORDINANCE RELATING TO CONTRACTS FOR WORK TO BE PAID FOR BY THE CITY, OR BY MONEYS DEPOSITED IN THE TREASURY, AND DEFINING THE COEDITIONS UNIAER WHICH SUCH CONTRACTS FOR ", TORK MAY BE AVTARDED- The City Council of the City of Burlingame do ordain as follows: Section f. Every contract for work to be performed by direction and at the expense of the city or paid for out of moneys deposited in the treasury, whether such work is to be done within or outside the limits of the city, and whether such work be done directly by or under such contract duly awarded, or indirectly by or under sub- contract, sub -partnership, day la:oor, piece work or any other arrange- ment whatsoever must provide. (a) That in every contract for the performance of laror, that eight hours shall constitute a day's work; that the contractor and all sub -contractors under him shall pay their employees on said work a salary or wage at least equal to the prevailing salary or wage for the same quality of service rendered to private persons, firms or cor- porations under similar employment in the City of Burlingame. (b) That any person perforr,,ing labor under, or in the execution of, such contract shall be a citizen of the United States, or have declared his or her intention of becoming such. (c) That each and every contractor desiring to submit estimates on construction work shall be required to submit to the City Council on form provided all data and information desired in regard to his experience, training, financial and moral responsibility, all properly sworn to before a notary pui:lic. On the data so submitted, the City Council shall determine the suitability or non -suitability of any contractor to submit estimates and perform the work designated. Section Z. The foregoing provisions designated (a), (b), and (c), must Also apply to persons perforc-ing lar;or in any auxiliary department of,laYor donducted in tYis course of the execution of such contract or any part thereof; and the said provisions shall also apply to any work done by or for the City, or any officer, board or commission thereof, when such work is to be done at the expense of the City, or paid for out of moneys deposited in the treasury. -1- Section OT, If any section, sub -section, paragraph, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portion of this ordinance. The City Council hereby declares that it would have passed this ordinance, and each section, sub -section, paragraph, sentence, clause or phrase thereof irrespective of the fact that any one or more sections, sub -sections, paragraphs, sentences, clauses or phrases be held unconstitutional.
