The City Council of the City of Burlingame do ordain as follows: Section I. (a) It is hereby declared to be a nuisance and it shall be unlawful for any person, firm or corporation to suffer or permit any chickens, geese, ducks, turkeys, pigeons, doves, squabs or similar fowls, or any hare or hares, or ranbit or rabbits, owned or controlled by him or it, to run at large or to go upon the premises of any other person in the City of Burlingame, or to keep any chickens, geese, ducks, turkeys, pigeons, doves, squabs or similar fowl within thirty-five (35) feet of any dwelling house or structure used as a dwelling house, unless such house or structure be occupied by him or it, or to keep any chickens, geese, ducks, turkeys, pigeons, doves, squabs, or similar fowl or any hare or hares, or rabbit or rabbits, closer than thirty-five (35) feet to any street line, or to keep any hare or hares,or rabbit or ra'r-bits within fifty (50) feet of any dwelling house or struct.re used as a dwelling house, unless such 1 house or structure shall be occupied by him or it, or to keep f any rooster over four months old within one hundred (100) feet of any dwelling house or structure used as a dwelling, unless such house or structure shall be occupied by him or it. (b) It is hereby declare,: to be a nuisance, and it shall be unlawful for any person, firm or corporation to keep on any premises more than twenty-five (25) in all of chickens, turkeys, pigeons, and doves, or hares or rabbits, within seventy-five (75) feet of any dwelling house or structure used as a dwelling house unless such house or structure shall be occupied by him or it, " -1- Section 2. It is hereby declared to be a nuisance and it shall be unlawful for any person, firm or corporation to keep or maintain or suffer ur permit to be kept or Maintained upon premises owned or controlled by him, or it, in the City of :Burlingame, more than one (1), hive of bees and which hive shall not be within two hundred (200) feet of any dwelling house other than the dwelling house of the owner or person in control of such bee hive. Section 3. It is hereby declared to ;e a nuisance and it still i.e unlawful for any person, firm or corporation to keep, maintain, or permit upon any lot or parcel of land within the City of Burlingame, under his or her or its control, any animal or animals, Q' which oy any soufd or cry shall aisturb the peace and comfort of any neighborhood, or interfere with any person in the reasonable and comfortable enjoyment of life or property. Section 4. In the keeping of any animals, fowl, or insects, on any lot or parcel of land in the City of Burlingame, it is com- pulsory on the part of the owner or person having control of -said place to keep at all times the places where said animals or fowl are kept in a sanitary condition and properly enclosed so that same will not go upon the premises of a neighbor or any other property with said City. Section 5. Each day during which a nuisance as stated in this ordinance is maintained, continued or suffered, or permitted to be maintained, continued or to exist, shall constitute a distinct and separate offense. Section 6. Any person, firm or corporation, as principal, officer, agent, clerk or employee, whether acting for himself or itself, or for another person, firm or corporation, who or which shall violate any of the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not exceeding Five Hundred Dollars (4500.00), or by imprisonment in the city jail not exceeding six (6) months, or by both said fine -2- fine trot excdedino Five•,hunared Dollars (w500.00), or by imprisonment in the`.city jail not exceeding six (6) months, or by,both said fine and imprisonment. "Section 7. All ordinances or parts of ordinances in conflict with this ordinance are hereby expressly repealed. Section 8.
