AN ORDINANCE CALLING A SPECIAL, ELECTION IN TIM CITY OF BURLING_AME
FOR THE PURPOSE OF SUBMITTING TO THE ELECTORS OF SAID CITY THE
PROPOSITION OF INCURRING A BONDED INDEBTEDNESS OF SAID CITY IN THE
PRINCIPAL SUM OF $86,000, FOR THE ACQUISITION, CONSTRUCTION AND
COMPLETION OF THE FOLLOWING MUNICIPAL IMPROVEMENT OF SAID CITY, TO -
WIT: SEWERS FOR SAID CITY OF BURLINGAME, INCLUDING INTERCEPTING
SEVERS AND SEWERAGE TREATMENT PLANT: DECLARING THE ESTIMATED COST OF
SAID MUNICIPAL IMPROVEMENT, THE AMOUNT OF PRINCIPAL OF SAID INDEBTED-
NESS TO BE INCURRED THEREFOR AND THE MAXIMUM RATE OF INTEREST TO HE
PAID THEREON: FIXING THE DATE OF SAID ELECTION AND PRESCRIBING TIM
MANI.OR OF HOLDING THE SAME; ESTABLISHING ELECTION PRECINCTS AND
POLLING PLACES FOR SAID ELECTION AND APPOINTING BOARDS OF ELECTION
THEREFOR, AND PROVIDING FOR NOTICE THEREOF.
WHEREAS the City Council of the City of Burlingame,
by resolution adopted at a regular meeting of said City Council
on the 2nd day of July, 1934 by affirmative vote of more than
two-thirds of all of its members, did determine that the
public interest and necessity demand the acquisition, construction
and completion by said City of Burlingame of the municipal
improvement hereinafter mentioned, and did further determine that
the cost of said proposed municipal improvement will be too great
to be paid out of the ordinary annual income and revenue of said
municipality, which resolution was duly entered on the minutes of
said meeting of said City Council, and is now on file and of record
in the Clerk's office of said City,
NOW, T=FORE, THE CITY COUNCIL OF THE CITY OF
BURLINGAME DO ORDAIN AS FOLLOWS:
Section 1. That a special municipal election be and
is hereby ordered, called and will be held in said City of
Burlingame on Thursday, the 30th day of August, 1934, at
which election shall be submitted to the qualified electors of
said City the proposition of incurring indebtedness of said City
in the principal sum of $86,000 for the purpose of acquiring,
constructing and completing a municipal improvement of said City
of Burlingame, to -wit: Sewers for said City of Burlingame, in-
cluding intercepting sewers and sewerage treatment plant. That
the estimated cost of said proposed municipal improvement is the
sum of $86,000, and the amount of the principal of said indebted-
ness proposed to be incurred for said municipal improvement is
said sum of $86,000.
Section 2. That said City Council proposes to issue
and sell bonds of said City of Burlingame in said amount of
486,000 for the purpose specified in said proposition set forth
in Section 1 of this ordinance, if two-thirds of the qualified
electors voting at said special election shall vote in favor
of said proposition. Said bonds shall be negotiable in form,
of the character known as serial, and shall bear interest at a
rate not exceeding six (6) per cent, per annum, payable semi-
annually.
Section 3. That said City Council does hereby submit
to the qualified electors of said City of Burlingame at said
special municipal election said proposition set forth in Section
1 of this ordinance, and designates and refers to said proposi-
tion in the form of ballot hereinafter prescribed for use at
said election.
Section 4. That the polls at the polling places
hereinafter designated shall be opened at six o'clock A.M. of
said day of election and shall be kept open continuously there -

after until seven o'clock P.M. of said day of election, when
the polls shall be closed (except as provided in Section 1164
of the Political Code), and the election officers shall there-
upon proceed to canvass the ballots cast thereat.
Section 5. That said special murk ipal election
shall be held and conducted, and the votes thereat canvassed,
and the returns thereof made, and the result thereof ascertained
and determined as herein provided; and in all particulars not
prescribed by this ordinance said election shall be held as
provided by law for the holding of municipal elections in said
City. The returns of said election shall be made out and
signed by the election officers and shall be by them deposited
with the Clerk of said City, together with the ballots cast
at said election; and this City Council shall meet and canvass
said returns on Tuesday, the 4th day of September, 1934 (the first
Monday after said election being a legal holiday), at the hour of
eight o'clock, P.M.; and if upon such canvass it shall be found
that at least two-thirds of the qualified electors of said
City, voting at said election, voted in favor of said proposi-
tion, then bonds of said City of Burlingame in the amount
specified in said proposition, to wit, $86,000 will be issued
and sold by said City for the purpose therein mentioned.
Section 6. For the conduct of said special election,
the City of Burlingame is hereby divided into seven special
election precincts. The territory embraced within each of
said precincts, the polling places therein, and the election
officers appointed to conduct said election thereat are as follows,
to wit:

Section 9. Each voter to vote for said proposition

hereby submitted and for incurring said bonded indebtedness
shall shall stamp a cross (X ) in the blank space opposite the
word "YES" on the ballot to the right of said proposition, and
to vote against said proposition and against incurring said
indebtedness shall stamp a cross (X) in the blank space
opposite the word "NO" on the ballot to the right of said
proposition.
Section 10. The Clerk of the City of Burlingame is
hereby directed upon the passage and adoption of this ordinance
to publish the same once a day for at least seven (7) days in
the "Burlingame Advance -Star" (which is a newspaper published
at least six (6) days a week in said City of Burlingame) and
such publication shall constitute notice of said election. No
other notice of the election hereby called need be given, and
no sample ballots will be mailed or delivered.
Section 11. This ordinance shall be forthwith entered
upon the
minutes
of
this City
Council
and
in the
Ordinance
Book
of said
City.
This
ordinance
shall
take
effect
from and
after
its passage and approval.
