HomeMy WebLinkAboutOrd 0273aFOLLOWS: ORDINANCE No. 273A AN ORDINANCE REGULATING SET BACK REQUIREME,NTS AS APPLIED TO LOTS EXTENDING FROM STREET TO STREET IN THE CITY OF BURLINGAME. THE CITY COUNCIL OF THE CITY OF BURLINGAME DO ORDAIN AS Section 1. Whenever any real property within the City of Burlingame has a frontage on two (2) separate and distinct officially designated streets within said city, the frontage of either of which may be used as a front entrance, the owner of said property shall, upon the erection of any structure thereon, elect at the time of the granting of said permit for the erection of said structure, the particular front of his structure to be erected, and upon the election and designation of said front, it shall be construed that the other end of his property shall be considered the rear of said premises. Section 2. That on the rear of said real property, as determined in Section 1 thereof, no building or structure, including garages or other out -buildings, shall be placed less than fifteen (15) feet from said rear property line, nor less than three (3) feet from the side lot lines, except when a side lot line is also a street line, then the set back line shall not be less than five (5) feet. Section 3. Whenever any real property in the City of Burlingame has already been classified by the City of Burlingame and said property extends from one street to another and has a frontage on both streets, one frontage of a businews nature and the other frontage of a residential nature, then the structure to be erected on said real property must conform to a building plan approved by the Planning Commission of the City of Burlingame and the City Council of the City of Burlingame. Section 4. The word "Street " shall include avenues, boulevards, highways, lanes and roads. Section 5. Any person violating any of the provisions of -1- this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Fifty and 00/100 Dollars ($50.00) or by imprisonment in the City Jail not to exceed ten (10) days, or by both said fine and imprisonment. Section 6. This ordinance shall be published in the "Burlingame Advance -Star", for the time and in the manner required by law and be in force and effect from and after the date of its passage.
