HomeMy WebLinkAboutOrd 0273follows: .i ORDINANCE No.j V AN ORDINANCE PROHIBITING ELECTRICAL INTER- FERENCE WITH RADIO RECEPTION, REGULATING LOCATION AND AMPLIFICATION, DECLARING SANTE TO BE A NUISANCE, AND PROVIDING PUNISHMENT FOR THE VIOLATION THEREOF. The City Council of the City of Burlingame do ordain as Section 1. It shall be unlawful for any person, co- partnership, association, firm or corporation knowingly or wantingly to operate or cause to be operated any machine, device, apparatus or instrument of any kind whatsoever within the corporate limits of the City of Burlingame, the operation of which shall cause reasonably preventable electrical interference with radio reception within said municipal limits. Section 2. That it shall be unlawful for any person, co- partnership, association, firm or corporation knowingly or wantingly to use or operate, or cause to be used or operated any mechanical device, machine, apparatus or instrument for intensification or amplification of the human voice or any sound or noise in any public or private place in such manner that the peace and good order of the neighborhood is disturbed, or that persons owning, using or occupying the property in the neighborhood are disturbed or annoyed. Section 3. That no broadcasting station used for commer- cial purposes and gain shall be operated in any other district in the City of Burlingame than in the commercial or industrial zones or districts of said City. Section 4. That this ordinance shall not be construed as an interference with any acts of a governmental nature, or acts that may be construed as bearing on governmental action of the United States. Section 5. That any person, co -partnership, association, firm or corporation who operates or maintains any machine, device, appaistus or instrument of any kind whatsoever as hereinbefore mentioned and which is in violation of the provisions as hereinbefore -1- mentioned, shall be deemed to be committing and maintaining a nuisance within the City of Burlingame. Section 6. Any person, co -partnership, association, firm or corporation violating any of the provisions of this ordi- nance shall, upon conviction, be punished by fine of not less than Fifty Dollars ($50.00) nor more than One Hundred Doll�.rs (8100.00), or by imprisonment in the city jail for not less than ten (10) days nor more than thirty (30) days, or by both such fine and imprisonment. Each day during which such violation continues shall be construed a separate offense. Section 7. This ordinance shall be published in the Burlingame Advance -Star for the time required by law, and be in force and effect from and after thig date of its passage.
