THE CITY COUNCIL OF THE CITY OF BURLING_43E DO ORDAIN AS FOLLOWS:
Section 1. It shall be unlawful for any person, co-
partnership, corporation, firm or association (except as specified
in Section 2 herein) to display or expose for sale, give away or
wise
othe 3X distribute to t1_e public in stores, on the streets, by
vending machines, by peddling from house to house, or in any
public place or office building, any contraceptive device, any
article or medicinal preparation primarily manufactured for,, or
which may be used as, a contraceptive, any prophylactic rubber
goods, any other articles for the prevention of venereal diseases
and infections or any sex inciting device or contrivance in the
City of Burlingame, County of San Mateo, State of California, or
to display or expose any containers or packages therefore, des-
criptive or suggestive of the contents. It shall be unlawful to
advertise the sal:- of the same on any placards, billboards,
handbills, newspapers, periodicals, signs or other printed or
painted matter in the City of Burlingame, California.
Section 2. The provisions of Section 1 as to the sale
and distribution of such goods shall not apply to wholesale 3uggists,
Sotbers or manufacturers who sell to retail drug stores for
resale, nor to regularly licensed practitioners of medicine, nor
to the sale of such appliances, drugs or medicinal preparations by
licensed drug stores, provided such sales are made only from the
prescription counters of such drug stores by registered pharmacists
there employed, and only to persons more than eighteen years of
age.
Section 3. Any person, co -partnership, corporation, firm
or association violating any of the provisions of this Oruinance
shall upon conviction thereof be punished by a fine of not less than

ten dollars ($10.00) and not to exceed two hundred dollars (4P200.00).
Section 4. All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 5. This Ordinance shall be in full force and
effect from and after its
yassage,
and shall be published in the
"Burlingame Advance -Star",
in the
manner and for the
period
required by law.
