HomeMy WebLinkAboutOrd 0279ORDINANCE NO. 21 q AN ORDINANCE GRANTING PERMISSION TO THE TOWN OF HILLSBOROUGH TO USE, JOINTLY ''KITH THE CITY OF BURLINGAME, A CERTAIN SEINER, PUMPING PLANT, TREATMENT PLANT AND ACCESSORIES, AND AUTHORIZING THE EXECUTION OF A CONTRACT IN CONNECTION THEREWITH The City Council of the City of Burlingame do or- dain, as follows; 'NHEREAS, the City Council of the Town of Hillsbor- ough, in pursuance of the statute in such case made and provided, did, on the 7th day of November, 1934, pass and adopt a certain resolution wherein it did find, ascertain and determine that it was for the best interest and advantage of the Town of Hillsbor- ough to enter into a joint agreement with the City of Burlingame providing for the enlargement in capacity of a certain sewer in I said resolution specifically designated, and for the changing of the location thereof to and along a location in said resolution particularly set forth, and for the construction of a pumping plant, a treatment plant, and accessories in connection therewith, and for the proportionate payment by said two municipalities of the cost and expense thereof, and for the joint use thereof by said two municipalities, upon and subject to the terms and agree- ments of a certain proposed contract which was set forth in and made a part of said resolution; and 'JVHEREAS, a copy of said resolution, duly certified, has been received by the City Council of Burlingame, attached to which was a request in writing, signed by the City Clerk of Hillsborough, asking that permission be granted by the City of I Burlingame to the Town of Hillsborough to have and enjoy the mss, jointly with Burlingame, of the said sewer, pumping plant, treat- ment plant and accessories, in compliance with and upon the terms and conditions set forth and contained in the said proposed contract; which said certified copy of said resolution, with said request attached thereto, is on file with,and in the office of, I the City Clerk of Burlingame, and reference thereto is now hereby) made for further particulars; and VMEREAS, it appears to this City Council, and this City Council does now hereby find, ascertain, determine and ad- judge the fact to be, that it is for the interest and advantage of the City of Burlingame that said sewer, pumping plant, treat- ment plant and accessories be built, subject to and upon the terms in said proposed agreement set forth, and that said pro- posed agreement should be entered into between said two munici- palities, and that the request in writing attached to the copy of said resolution, as aforesaid, should be granted. NOVI, THEREFORE, BE IT ORDAINED by the City Council of the City of Burlingame, as follows: Section 1. That the City of Burlingame, by and through its legislative body, to -wit, its City Council, does hereby find, ascertain, determine and declare that it is for the interest and advantage of the City of Burlingame that the City of Burlingame enter into a joint agreement with the Town of Hills- borough for the enlargement in capacity of the outfall or inter- ceptor sewer in said proposed contract particularly described, and that the location thereof be changed to and upon and along the route in said proposed contract set forth, and for the con- struction of a pumping plant and of a treatment plant with ac- cessories, as in said proposed contract enumerated, and for the joint use thereof by the said two municipalities upon the terms and conditions in said proposed contract set forth. Section 2. That the City of Burlingame, by and through its legislative body, to -wit, the City Council of said City of Burlingame, hereby grants to the Town of Hillsborough permission to have and enjoy the use, jointly with Burlingame, in perpetuity, of the sewer, pumping plant, treatment plant and accessories in said resolution referred to, together with all and singular such other rights, privileges, rights of way and easements as are to be granted to Hillsborough under the pro- posed contract hereinbefore referred to, but subject to the terms) and conditions in,said contract set forth and contained. Section 3. That the contract so proposed by the Town of Hillsborough to be entered into with the City of Burl- ingame, a full, true and correct copy whereof is set forth and made a part of said resolution so adopted by the City Council of Hillsborough, as aforesaid, be and the same is hereby approved in all particulars, both as to its terms and as to its substance, and that the Mayor of the City of Burlingame and the City Clerk thereof be, and they hereby are, authorized and instructed, for and on behalf of, and in the name of, and under the corporate -2- seal of, and as the act and deed of, said City of Burlingame, to make and enter into such contract with the Town of Hillsbor- ough. Section 4. That the City Clerk of Burlingame be, and he hereby is, authorized and instructed to furnish to the City Council of the Town of Hillsborough a certified copy of this ordinance. Section 5.
