The City Council of the City of Burlingame DO ORDAIN as .follows: WHEREAS, a petition,, duly executed by Thomas J. Culligan, Jr. and _Cathleen F. Culligan, his wife, as owners, has been presented to and filed with the City Clerk of the City of Burlingame, setting forth the boundaries of the unincorporated, uninhabited area contiguous to the northwesterly boundary of said city, requesting that said property be annexed to said city, and agree- ing that upon the completion thereof said property shall be sub- ject to taxation equally with the property within the city to pay the existing bonded indebtedness of said city, outstanding at the date of said annexation on ind.ebtednesses theretofore authorized and represented by bonds then outstanding; WHEREAS, on November 18, 1940, the City Council adopted. its resolution fixing December 9, 1940 at eight o'clock P.M.in the Council Chambers in the City Hall of said City, as the time and place when and where any persons owning real property within such territory so proposed to be annexed and having any objections to the proposed annexation may appear and show cause why such territory, describing same, should. not be annexed, which resolu- tion was published in the issues of the Burlingame Advance pub- lished and circulated on November 20 and 27, 1940; and WHEREAS, at said hearing no persons interested or at all objected to the said annexation, and this council now has jurisdiction to order same. NOW, THEREFORE, IT IS ORDAINED AND ORDERED, as follows: 1. That the hereinafter described real property is unincorporated, uninhabited territory contiguous to the north- westerly boundary of the City of Burlingame. 2. That said property, when annexed, shall be subject to taxation equally with the property within said city, to pay the existing bonded indebtedness of said city, outstanding at the date of said annexation, on the indebtednesses heretofore auth- orized and represented by bonds now issued. 3. 'Rat the said area shall be known as "BURLINGANLE VILLAGE". 4. That the exterior boundaries of said area are hereby determined, established and defined as follows: BEGINNING at a. point in the northwesterly line of Lot 9 as said lot is shown on that certain map entitled "Map of Burlingame Ggte Burlingame San Mateo County California", filed for record May 14, 1924 in Book 11 of Maps at pages 64 and 65, Records of San Mateo Count, said point of beginning being located North 460 34' 30 East 6.977 feet from the most westerly corner of said Lot 9; running thence from said point of beginning. along the northwesterly lines of said subdivision North 460 34' 30" East 242.31 feet; North 400 26' 30" East 455.00 feet and North 280 18' West 373.609 feet to a point in the southwesterly line of lands described in Deed from Mills Estate Incorporated, a corporation, to United Railroads of San Francisco, a corporation, dated February 2, 1917 and recorded July 16, 1917 in Book 264 of Deeds at page 409, itcords of San Mateo County; thence along said southwesterly line North 62° 20' West 911.17 feet and North 590 52' 30x' West 787.00 feet; thence South 33° 47' West 694.47 feet; thence southeasterly on the arc of a circular curve to the left with a radius of 2120 feet, the center of which curve bears North 42° 02' 44" East from the point last above described, an are distance of 306.53 feet; thence south 560 14' 20" East 1609.63 feet to the point n t 37.'+ Containin �7•+ acres of land, more or less. 5• IT IS FURTHER ORDAINED that the annexation of said territory be, and the same is hereby, approved, and it is further ordered that this ordinance shall take effect and be in force immediately upon the expiration of thirty days from the date of passage hereof and that immediately upon its becoming effective, the Clerk of said city, she being the Clerk of this Council, shall make, under the seal thereof, and transmit to the Secretary of State of the State of California. a certified copy of this ordinance giving the date of its passage, and that from and after -2- the date of the filing of said document in the office of the Secretary of State, the annexation of such territory so proposed to be annexed and described herein, shall be deemed to be and shall be complete, and thenceforth such annexed territory shall be to all intents and purposes a part of such municipal corporation. 6. This ordinance shall be published once in the Burlingame Advance, a daily newspaper of general circulation published and circulated in said city and hereby designated by said Council for said purpose. Introduced the 9th day of December, 1940, and adopted by the City Council on December 16, 19400 by the following vote: Ayes, and in favor thereof, Councilmen: BURROWS, COLEMAN, HUNT, T4cDONALD Noes, Councilmen: NONE Absent, Councilmen: BUCK_ ATTEST: ty Clerk.
