AN ORDINANCE AP,2ENDING THE ORDINANCE CODE
OF THE CITY OF BURL%NGAME BY REGULATING
THE HEIGHT OF FENCES AND IiTALLS ON OR AD-
JACENT TO LOT LINES IN THE CITY OF
BURLINGAME, AND REPEALING SECTION 1275
OF SAID ORDINANCE CODE
The City Council of the City of Burlingame does ordain
as follows, to -wit:
Section One. The Ordinance Code of the City of
Burlingame is hereby amended by adding thereto the following:
Sec. 1275. It is hereby declared unlawful for any person, firm
or corporation to build, construct or maintain along or near the
rear lot line of any residence lot in the City of Burlingame, a
fence or wall over six (6) feet in height.
Sec. 1275.1. It is hereby declared unlawful for any person,
firm or corporation to build, construct or maintain along or near
the side lines of any residence lot, between the rear line of
said lot and the set -back line on the front of said lot, in the
City of Burlingame, a fence or vall over six (6) feet in height.
Sec. 1275.2. It is hereby declared unlawful for any person,
firm or corporation to build, construct or maintain along or near
the side lines of aiiy residence lot, between the set -back line
and the street property line, in the City of Burlingame, a fence
or wall over four (4) feet in height.
Sec. 1275.3. It is hereby declared unlawful for any person,
firm or corporation to build, construct, or maintain on or near
the street line of any residence lot in the City of Burlingame, a
fence or wall over four (4) feet in height.
Sec. 1275.4. For the purpose of this Code, the rear line of
any residence lot in the Cit;/ of Burlingame abutting the side
line of an adjacent lot shall be considered as a side line of the
lot instead of the rear line.
Sec. 1275.5. The provisions of this Code shall also apply to
the lot lines upon any lots used for residence purposes in the
business districts of the City, as shown by the zoning maps of
the City; provided, however, that any lot in the business
district, upon which a business building has been constructed or
is to be constructed, shall not be affected by any of the pro-
visions of this Code.
Section Two. Section 1275 of the Ordinance Code of
the City, as the same non- exists, is hereby repealed.
Section Three. This ordinance shall be published once
in the Burlingame Advance -Star, a newspaper of general cirou-
lation published in the City, and shall take effect and be in
full force from and after thirty (30) days after its adoption.
The foregoing ordinance was introduced on the 2nd day
of September, 1041, and was duly passed and adopted on the fifteenth
day of September, 1941, by the following vote:
