HomeMy WebLinkAboutOrd 0372ORDINANCE NO. 372 AN ORDINANCE AMENDING ARTICLE 23 OF THE ORDINANCE CODE, PROVIDING FOR THE REPAIR, RECONSTRUCTION, OR IMPROVE- MENT OF ANY SIDEWALK, WHEN ANY PORTION OF SUCH SIDEWALK SHALL BE SO OUT OF REPAIR OR IN SUCH CONDITION AS TO EN- DANGER PERSONS OR PROPERTY PASSING THEREON, OR SO AS TO INTERFERE WITH PUBLIC CONVENIENCE IN THE USE THEREOF; AMENDING SECTION 1390, AND ADDING SECTION 1391 TO, THE ORDINANCE CODE. The City Council of the City of Burlingame does ordain as follows;, Sec. One. Article 23 of the Ordinance Code of the City shall read as follows: "ARTICLE 23 -- DEFECTIVE SIDEWALKS." Section 1390. Superintendent of Streets to Give Notice. When in the judgment of the Superintendent of Streets, any portion of any sidewalk shall be so out of repair or in such condition as to endanger persons or property passing thereon, or so as to interfere with the public convenience in the use thereof, the said Superintendent of Streets is hereby authorized to notify the owner or owners of any lot fronting on such portion of said sidewalk so out of repair or in such condition as aforesaid, by a notice in writing to be delivered to such owner, or his agent, or to any person in possession of such lot, requiring such owner to repair, or reconstruct, or improve forthwith, in such manner and with such material as the Superintendent of Streets may deter- mine and direct,said portion of said sidewalk in front of the lot of which he is the owner. Within ten days after such notice shall have been de- livered to such owner, he shall cause to be begun such repair, or such reconstruction, or such improvement, as may have been determined by the Superintendent of Streets, and directed in the notice aforesaid to be made, and diligently and without inter- ruption, prosecute the same to completion. Section 1391. If City Does Work, Cost to be a Lien on Property. If any owner refuses or neglects to make such repair, or reconstruction, or improvement, as hereinabove provided, when required and directed in conformity with the provisions of this Article, the Superintendent of Streets shall cause such repair, or reconstruction, or improvement to be made, and the cost and any sum of money necessarily expended by the City in making such repair, or reconstruction, or improvement, shall become a lien upon the property on which the repair, reconstruction, or im- provement, was made, and may be recovered in an action brought therefor in the name of the City; or such cost and expenditure may be placed upon the City Tax Bill and collected in the same manner and at the same time as the City Taxes are collected. Sec. Two. This Ordinance shall be published for the time and in the manner prescribed by law and shall become effective thirty days after its adoption.
