AN ORDINANCE AMENDING TRE ORDINANCE CODE:
CREATING A RECREATION CO--ciMISSION; PROVID-
ING FOR ITS ORGANIZATION, TERMS OF ITS
TEMBERS, OFFICERS, POWERS AND DUTIES.
The City Council of the City of Burlingame does ordain
as follows:
Sec. One. The Ordinance Code of the City of Burlingame
is hereby amended by adding thereto a new division to be desig-
nated Division No. 6 of Article 6 of Part II of said Code to be
entitled "Recreation Commission" and which shall read and provide
as follows:
DIVISION 6 - RECREATION C0MMISSION
Sec. 635. ORGANIZATION - TERMS OF MEMBERS.
There shall be in the City a Recreation Commission which
shall consist of five members, not more than three of whom shall
be of the same sex, who shall be appointed by the Mayor, subject
to confirmation of the City Council. The Mayor, Superintendent
of Recreation and Chief of Police shall be ex -officio members of
said Commission, but shall have no voting power. The appointed
members of the Commission shall hold office for three years, and
until their successors are appointed and qualify. The term of
office of the first members to be appointed shall be determined by
lot, so that the term of office of one member shall be for one
year, of two members for two years, and of two members for three
years;jall of the terms commencing on the date of the appointment
of the first members of said Commission. The members of the
Commission shall serve without compensation. The City Council may
by appropriate action approve payment to the members of said
Commission of such necessary expenses as may be incurred by them
while acting in their official capacities.
Sec. 636. VACANCIES - REMOVALS.
The City Council may remove any appointed member of said
Commission from office prior to the expiration of his term of
office, with or without cause by an affirmative vote of not less
than four-fifths (4/5) of all the members of the City Council.
Vacancies on the Commission, except as to ex -officio members,
shall be filled by appointment by the Mayor, subject to the con-
firmation of the City Council.
Sec. 637. MEETINGS - OFFICERS.
Said Commission shall hold regular meetings at least
once each month, in the City Council Chambers of the City Hall,
and may hold such additional meetings as it may deem necessary or
expedient. A majority of said Commission shall constitute a
quorum for the purpose of transacting the business of said Com-
mission. The Commission shall, as soon as practicable, after the
time of the annual appointment of a member to the Commission,
elect a President, Vice President and a Secretary thereof, who
shall serve at the pleasure of the Commission.
Sec. 638. SECRETARY - DUTIES.
The Secretary of the Commission shall keep a record of
all proceedings, resolutions, findings, determinations and tran-
sactions of the Commission, which records shall be a public
record, and a copy of which record shall be filed with the City
Clerk as Clerk of the City Council.
Sec. 639. POWERS.
The Recreation Commission shall have the power, and it
shall be the duty of said Commission, in a purely advisory
capacity, to make recommendations to the City Council and to ad-
vise the Council in matters pertaining to the creation, operation,
maintenance, management, and control of community recreation
programs, of playgrounds and indoor and outdoor recreational
activities. The Commission shall prescribe the functions and
duties of the Superintendent of Recreation.
Sec. Two. This Ordinance shall be published once in
the Burlingame Advance - Star, a newspaper of general circulation,
and shall become effective thirty (30) days after its adoption.
Introduced the 21st day of April, 1941, and adopted the
5th day of May, 1941, by the following vote:
