AN ORDINANCE REGULATING AND DEFINING
LEAVES OF ABSENCE FOR EMPLOYEES OF THE
CITY OF BURLINGAME WHILE ENGAGED IN THE
PERFORMANCE OF MILITARY OR NAVAL DUTY
UNDER COMPETENT ORDERS.
The City Council of the City of Burlingame does ordain as
follows:
Section 1: Any officer or employee of the City who is a
member of the National Guard or Naval Militia of the State of
California, or a member of the reserve corps or force in the
Federal military, naval or marine service of the United States,
shall be entitled to leave of absence from his position for one
year and forty days while engaged in, and while going to and
returning from, military or naval duty under competent orders.
Section 2: As defined herein, military or naval duty
under competent orders shall be such to which an employee
must submit or service necessary to maintain military status,
or of a voluntary nature requested of the employee or for
which application was made by him.
Section 3: If the employee or officer has been in the
employ of the City for one year or more, continuously, prior to
the date upon which such leave begins, he shall be allowed his
regular salary for a period of fifteen (15) days.
Section 4: The Civil Service Commission of the City may
require proof of performance of military or naval duty as
defined in this Ordinance, either by presentation by the
officer or employee of properly certified copies of competent
orders or such other proof as shall be deemed necessary, and
the Civil Service Commission of the City may adopt such rules
as it shall deem necessary to carry out the provisions of this
Ordinance.
Section 5: No such officer or employee granted a leave of
absence under the provisions of this Ordinance shall be sub-
jeoted directly or indirectly by reason of such absence to any
loss or diminution of vacation or holiday privilege or be pre-
judiced by reason of such absence with reference to promotion
or continuance in office, employment, reappointment to office
or re-employment.
Section 6: This Ordinance shall be published once in the
Burlingame Advance - Star, a newspaper published in the City
for the time provided by law.
Introduced the 21st day of April, 1941 and adopted the 5th
day of May, 1941 by the following vote:
