AN ORDINANCE AUTHORIZING EMERGENCY
SUSPENSION OF ALL BUILDING, ELEC-
TRICAL, AND PLUMBING ORDINANCES,
AUTHORIZING THE USE OF SUBSTITUTE
MATERIALS AND METHODS DURING THE
PERIOD OF NATIONAL EMERGENCY NOW
EXISTING.
The City Council of the City of Burlingame does ordain
as follows;
Section One; SUSPENSION OF CODE AND ORDINANCE PROVI-
SIONS DURING NATIONAL EMERGENCY.
For the period of the emergency created by war between
the United States of America and Germany, Japan and Italy, the
Building Inspector may grant permits allowing the substitution of
specified building, electrical, and plumbing materials and method
of construction for the materials and methods now required by any
ordinance of the City of Burlingame, whenever he shall find the
following facts to exist;
(1) The materials required by said ordinance are not
available, or cannot be obtained within a reasonable time, or
cannot be obtained except at a prohibitive cost because of the
national emergency, and
(2) The use of such substituted materials or methods
will not materially increase the fire, health or safety hazard,
nor materially lessen the structural stability of the building
or structure for which such substitute is to be used.
Section Two; RULES AND REGULATIONS.
The Building Inspector may prescribe rules and regula-
tions governing applications for permits to use substitute
materials and methods under this ordinance, and he may require
the furnishing of any information reasonably necessary to enable
him to determine whether such applications come within the terms
of this ordinance.
Section Three; FINDINGS TO BE FILED.
In each case where the Building Inspector allows the
use of substitute materials, he shall file, as a part of the
record on the permit, a written statement of facts upon which he
based his determination that the requirements of Section One of
this ordinance would be complied with by the granting of the
permit.
Section Four -
This ordinance is passed as an emergency measure, and
the City Council does hereby declare that an emergency exists
which makes it imperative that this ordinance become effective
forthwith, the nature of the emergency being the war program has
created and will continue to create shortages of materials re-
quired by the ordinances of the City of Burlingame for the con-
struction, re -construction, alteration, or repair of buildings
and structures, making it impossible to protect the public health,
safety and general welfare by continuing the terms of the existing
building requirements so that unless this ordinance is immediately
effective, all construction must cease, and it is therefore
necessary, in the furtherance of the public health, safety, and
welfare of the residents of this City, that this ordinance be
effective immediately.
