HomeMy WebLinkAboutOrd 0405ORDINANCE NO. 405 AN ORDINANCE AWWDING TRE ORDINANCE CODE OF THE CITY OF BURLINGAME, PROVIDING FOR THE LEVY AND COLLECTION OF TAXES AND ASSESSMENTS FCR THE PURPOSE OF CREATING A FUND FOR CAPITAL OUTLAYS BY THE CITY. The City Council of the City of Burlingame does ordain: Section 1 " The Ordinance Code of the City of Burlingame is hereby amended by adding thereto a new section to be known as Section 950, which shall read as follows: Section 950 - Special Fund for Capital Outlays: There is hereby established a special fund for capital outlays, to be created by the levy and collection of taxes and assessments which the City Council may levy, and which taxes and assessments shall be levied and collected in the same manner and at the same time as other taxes. In making such levy the City Council shall not exceed the limitation to impose taxes prescribed by the general laws of the State of California without the assent of two-thirds of the qualified electors of the city. The City Council may transfer to such capital outlay fund any unencumbered surplus funds remaining on hand at the end of any fiscal year. No money shall be disbursed from said find except for the making of any capital outlays, provided, however, the City Council may submit a proposition to the electors of the City, to obtain the consent of such electors to the use of the moneys in such fund, or any portion thereof, for some other specific purpose. Such proposition may be submitted at any election, and shall require a two-thirds vote of all voters voting at such election to authorize the expenditure of the moneys in said fund, or any portion thereof, for such other purpose. The term "Capital Outlays" shall not be construed to include the construction, acquisition, extension of, or additions to utilities, other than utilities for the furnishing of a water supply. S c 2. This Ordinance shall be published once in the "Burlingame Advance -Star, and become effective thirty days after its adoption. The foregoing ordinance was introdir ed at a regular meeting of the City Council of the City of Burlingame, held July 3, 1944, and was adopted at a regular meeting of said Council held on July 17, 1944, by the following vote: AYES: COU2SOIT:Dahl -Harris - Hunt - Roth - Whitsell NOBS: COUNCILMCN : None ABSENT: COUNCII1EN : NONE ATTEST:
