HomeMy WebLinkAboutOrd 0429ORDINANCE NO. 429 AN ORDINANCE LMENDING THE ORDINANCE CODE OF THE CITY OF BURLINGLIdE BY CHANGING LOTS E, F, G, E, I, J, K, L, M, N, 09 7, 8 AND 9 IN BLOCK NO. 10; LOTS A, B, C, D, E, F, G, H, I, J, K, L, M and THE NORTHERLY 52-1/2 FEET OF LOTS N IN BLOCK NO. 11 AS PER MLP NO. 2 BURLINGAME LAND COIIPANY FROM APARTMENT TO LIMITED COKVIER- CIAL SONE; DEFINING THE LIMITED COTsMERCIAL ZONE AND THE USE THEREOF; ESTABLISHING SET BACK LINES AND PROVIDING FOR THE CONTROL BY THE PLANNING COMMISSION OF THE LAND- SCAPING, PARKING FACILITIES, HEIGHT AND ARCHITECTURAL CHARACTER OF THE BUILDINGS; * * * * * * * * * * * * * * * * * * * * * * * * * The City Council of the City of Burlingame does ordain as follows: Section 1. Area limited for Commercial Purposes. Within the area hereinafter described, there is hereby established a use of property for certain commercial purposes; all of said area shall hereafter be within the first fire zone as prescribed by this Code and all new buildings therein shall conform to the requirements of said first fire zone, provided, however, that all existing and non -conforming structures may be altered/for commercial purposes as the height of the buildings and or the ground area covered by the buildings is not increased more than ten percent (10;/0). Section 2. Delineation. The land referred to in Section 1 of this Ordinance at the time hereof is in the apartment zone and the same is hereby transferred therefrom to the limited Commercial area as herein- after described and comprises of Lots E, F, G, H, I, J, K, L, M, N, 0, 7, 8 and 9 in Block No. 10; Lots A, B, C, D, E, F, G, H, I, J, K, L, Ivi and the northerly 52-1/2 feet of Lots N in Block No. 11, as said lots and blocks are laid down and delineated on that certain map entitled !lap No. 2 of the Burlingame Land Company, Town of Burlingame, California, on file in the Office of the County Recorder, County of San Mateo, State of California. Section 3. Use. All of the land referred to in Section 2 of this Ordinance the use of which is hereby transferred from apartment to limited commercial zone may be used to house and carry on: all business or professions under State regulation; semi-professional businesses, including designing, typing, public stenograph, I, private schools, retail businesses, hotels, mortuaries, hospitals,'' antique shops, child nurseries, convalescent homes and such other businesses having only office requirements. Within the area hereby established as the limited Commercial Zone there shall be no laundry, cleaning and dyeing business, storage or repair services, except those connected with the sale of major appliances, employment or labor agencies, second-hand stores, (antique shops excepted), theatres or other places of public amusement, and no place for the sale, trade or dispensing of liquors of any kind. Section 4. Building Set -Back Lines. Upon any land fronting on Chapin Avenue there shall be maintained a building set -back line of 20 feet, and no building or structure shall be erected, constructed or maintained at a distance of less than 20 feet from the front property line of Chapin Avenue, the purpose hereof to be established a uniform street width of 100 feet. Section 5. Control. All buildings to be used for commercial purposes in the imited Commercial Zone shall comply with and conform to existing rovisions of the building code of the City and any amendments hereto, all existing ordinances governing set back lines, land overage, landscaping, parking facilities, height and architectur- 1 character thereof, and all permits for the construction or rection of any structure within the said limited Commercial Zone ust first be received and approved by the City Planning Commission ided, further, that all lots having a frontage on the El no Heal shall be subject to all of the existing provisimns of this Code for property so facing said E1 Camino Real.
