HomeMy WebLinkAboutOrd 0454ORDINANCE NO. 454 AN ORDINANCE APPROVING THE ANNEXATION TO THE CITY OF BURLINGAME OF CERTAIN UNINHABITED AND UNINCORPORATED AREA KNOWN AS MILLS MANOR The City Council of the City of Burlingame does ordain as follows: WHEREAS, tkOte owner of the property hereinafter described, duly filed with the ity Clerk of the City of Burlingame a petition setting forth the boundaries of the unincorporated and uninhabited area contiguous to the northwesterly boundary of said City, and re- quest that the property be annexed to said City, and agree therefor, that upon the annexation thereof, said property shall be proportion- ately subject to all of the burdens and obligations of the City of Burlingame, andto enjoy all of the privileges and benefits of the City of Burlingame; and, WHEREAS, on the 5th of August, 1946, the said City Council of the City of Burlingame adopted Resolution No. 33-46, fixing Sep- tember 3, 19460 at 8 o'clock P.M. in the Oouncil Chamber in the City Hall of said City, as the time and place then and where any person owning real property within such territory so proposed to be annexed, and having any objections to the proposed annexation, may appear and show cause why such territory described in same should not be annexed; and said Resolution was published as required by law in the Burlingame Advance Star, a newspaper of general circulation, on August 20, 19469 andAugust 27, 1946; and, WHEREAS, at said hearing no person interested or at all ob- jected to said annexation, and the City Oouncil having jurisdication to order the same, IT IS ORDAINED AND ORDERED: 10 That the hereinafter described real property is unin- corporated and uninhabited territory contiguous to the northwesterly boundary of the City of Burlingame. 2, That the said property, known as "Mills Manor", is here- by annexed to, and shall hereafter be a part of the City of Burlingame, and vhen so annexed shall be taxed to pay its portion of the following indebtedness of the City existing at the time of annexation, to wit: 1912 Water Bonds 50000.00 1922 Park Bonds 100000.00 1927 Water Bonds 1050000.00 1930 Library Bonds 12,000.00 1934 Sewer Plan# Bonds 340000.00 and any other existing indebtedness incurred for municipal improvements. 3. That the exterior boundaries of said area hereby annexed are all within the County of San Mateo, State of California, and des- cribed as follows: The territory hereinabove referred to is that certain real property situate in the County of San Mateo, State of California., and more particularly described as follows: FIRST PARCEL A parcel or strip of land in the County of San Mateo, State of California, 100 feet in width measured at right angle to the right, adjacent to and parallel to the following described line: COMMENCING at the point of intersection, marked by a concrete monument "ME 24.13111, of the southeasterly boundary line of that tract of land, known as Tract No. 1, conveyed by deed dated December 160 1916, frau. Ogden Mills and Elizabeth Mills Reid to the Mills Estate Incorporated and recorded in the office of the Recorder of the County of San Mateo, State of California, in Volume of Deeds 263, page 171, on March 20, 1917, said southeasterly boundary line being also the northwesterly boundary line of the corporate city of Burlingame, State of California, with the northeasterly boundary line of that right-of-way of the California State Highway, known as the Skyline Boulevard, conveyed as Parcel IV by deed dated April 24, 1922, from the Mills Estate Incorporated to the State of California and recorded in the Office of the Recorder of the County of San Mateo, State of California, in Volume of Official Records 51, page 276, on October 4, 1922; thence along the heretofore mentioned northeasterly boundary line of the California State Highway north 270414 20" west 660.54 feet, thence on the are of a curve to the left. tangent to the preceding course with a radius of 1040 feet a central angle of 120 311 00" a distance of 227.20 feet, thence tangent to the preceding curve north 400 124 20t1 west 4004.45 feet to the point of intersection marked by a concrete monument "ME 24.134," of said northeasterly boundary line of theCali- fornia State Highway with the northwesterly boundary line of the heretofore mentioned Tract No. 1 conveyed by Ogden Mills and Elisabeth Mills Reid to the Mills Estate In- corporated; thence along the said northwesterly boundary line of said Tract No. 1 north 540 041 20" east 4308.27 feet to a point; thence south and southeasterly on the are of a curve to the left whose tangent bears south 790 161 07" east and whose radial point bears north 100 431 53" east from the last said point with a radius of 600 feet, a central angle of 520 541 05" a distance of 553.98 feet; thence tangent to the preceding curve aorthc 470 491 48" east 588.65 feet; thence on the are of a curve to the right tangent to the preceding course with a rAus of 950 feet a central angle of 60 141 32" a distance of 103.50 feet; thenen tangent to the preceding curve north 540 041 2011 east 1873.37 feet; thence on the arc of a curve to the right tangent to the preceding course with a radius of 100 feet a central angle of 940 231 00" a distance of 164.73 feet to a point in the southwesterly boundary line of the California State Highway, known as the El Camino Real, conveyed by deed dated September 15, 1941, from the Mills Estate Incorporated to ,the State of Califom is and recorded in the Office of the Recorder of the County of San Mateo State of California, in Volume 992 of Official Records, page 11, on October 16, 1941, thence along the last said south- westerly boundary line of the CalifoPnia State Highway tangent to the preceding curve south 310 321 40" east 16.74 feet, thence continuing along the boundary lines of the last said highway conveyed to the State of California and across said E1 Camino Real, north 540 041 201 east 66.47 feet to a point in the northeasterly boundary line of said California State Highway known as the E1 Camino Real, thence north 280 341 10" west 182.24 feet, thence on an are of a curve to the right tangent to the preceding course with a radius of 50 feet a central angle of 820 381 30" a distance of 72.12 feet thence tangent to the preceding curve north 540 o41 20r1i east 20.98 feet to the most southerly corner of that parcel of land known as Parcel 2, conveyed by deed dated September 29, 1941, from the Mills Estate Incorporated to theCounty of San Mateo, State of Cali- fornia, and recorded in the office of the Recorder of the County of San Mateo, State of California, in Volume 987 of Official Records at page 166 on October 15, 1941; thence along the southeasterly boundary line of said Parcel 2; ,which boundary line is also the southeasterly boundary line of Millbrae Avenue, north 540 GO 2011 east 248.27 feet to the southwesterly corner of Millbrae Avenue and the right-of-way formerly owned by the United Railroads of San Francisco; thence along the southwesterly boundary line of the said right-of-way conveyed by deeds dated February 2, 1917, from the Mills Estate Incorporated to the United Railroads of San Francisco and recorded in the office of the Recorder of the County of San Mateo, State of California, in Volume 264 of Deeds, page 409, . on July 16, 1917, south 390 001 00" east 384.43 feet, more or less, thence south 540 091 30t1 east 217.80 feet, more or less, thence south 440 401 3011 east 205 feet, more or less, thence south 380 59t 30" east 94.40 feet, more or less, thence on the are of a curve to the left tangent to the preceding course with a radius of 2919.93 feet, more or less, a central angle of 230 12t 3011, more or less, a distance of 1182.75 feet, more or less, thence tangent to the preceding curve south 620 121 0011 east 358.35 feet, more or less, thence south 590 401 3011 east 216.31 feet, more or lessy: to the point of intersection with the north- westerly boundary line of the corporate City of Burlingame.. State of California, said northwesterly boundary line being also the northwesterly boundary line of that subdivision known as Burlingame Village, conveyed by deed dated November 12, 1940 from the Mills Estate Incorporated to Thomas J. Culligan, Jr. and Kathleen F. Culligan and re- corded in the office of the Recorder of the County of San Mateo in Volume 924 of Official Records at page 296 on November 13, 1940. Being part of Tracts 1 and 10 conveyed by deed dated December 16, 1916, from Ogden Mills and Elisabeth Mills Reid to the Mills Estate Incorporated and recorded in the Office of the Recorder of the County of San Mateo, State of California, in Volume of Deeds 263, page 171, on March 20, 1917. SECOND PARCEL That lot or parcel of land, being a portion of Tracts "1" and 1110" conveyed by deed dated December 16, 1916, from Ogden Mills and Elisabeth Mills Reid to the Mills Estate Incorporated and recorded in the office of the Re- tarder of the County of San ateo, State of California, in Volume of Deeds 263, page 171, on March 30, 1917, and more particularly described as follows: COMMENCING at the point of intersection of southeasterly boundary line of t1 -B heretofore mentioned parcel of land and th the westerly boundary line of the corporate City of Burlin- game, State of California, which said westerly boundary line is also the westerly line of Section 12, Township 4 south Range 5 west, Mt. Diablo Base and Meridian; thence along the last said southeasterly boundary line of the lands of the Mills Estate Incorporated southwesterly 650 feet to the point of intersection with the northeasterly boundary line of the right-of-way conveyed by deed dated June 2, 1922, from the Mills Estate Incorporated to the Southern Pacific Rail- road Company and recorded in the office of the Recorder of the County of San Mateo, State of California, in Volume 49 of Official Records at page 1 on July 19, 1922; thence along the said northeasterly boundary line of the right-of-way of the Southern Pacific Railroad Company north 620 121 00" west 1264.17 feet, thence north 590 511 00" west 610.51 feet, thence north 620 121 00" west 1397.90 feet, thence on the are of a curve to the right tangent to the preceding course with a radius of 2759.93 a central angle of 230 121 3011 a dis- tance of 1117.94 feet, thence tangent to.the preced- ing curve north 380 591 30" west 880 feet more or less to the point of intersection with the south- easterly line of Millbrae Avenue, which said southeast- erly line is also the southeasterly boundary line of that parcel of land conveyed by deed dated September 29, 1941 from the Mills Estate Incorporated to the County of San Mateo, State of California, and re- corded in the office of the Recorder of the County of San Mateo, State of California, in Volume 987 of Official Records at page 160 on October 155, 1941, thence along the said southeasterly line of Millbrae Avenue north 540 041 2011 east 2805 feet more or less, thence on the arc of a curve to the left tangent to the preceding course with a radius of 640 feet a central angle of 240 34. 0011 distance of 274.41 feet, thence tangent to the preceding course north 290 301 2011 east 82.32 feet more or less to the point of intersection with the south- westerly boundary line of the right-of-way ofthe California State Highway, known as the Bayshore Highway conveyed by deed dated October 259 19242 from the Mills Estate Incorporated to the State of California and recorded in the office of the Recorder of the County of San Mateo, State of California, in Volume 177, of Official Records at page 307 on August 8, 1925, thence along the said southwesterly boundary line of the California State Highway, known as Bayshore Highway, south 600 571 20" east 1816 feet more or less, thence on the are of a curve to the right tangent to the pre- ceding course with a radius of 2437.5 feet a cen- tral angle of 160 001 1011 a distance of 680.80 feet, thence tanent to the preceding course south 440 571 101 east 75 feet more or less to the point of intersection Ai th the heretofore mentioned westerly boundary line of the corporate city of Burlingame, State of California; thence along the last said westerly boundary line of the City of Burlingame, State of California, south 2980 feet more or less to the point of commence- ment, 4. That the annexation of said territory be, and the same is hereby approved, and that this Ordinance shall take effect and be in force immediately upon the date of passage hereof, and immediately upon its being effective the City Clerk of the said City shall make, under the seal there- of, and transmit to the Secretary of State of the State of California, a certified copy of this Ordinance, giving the date of its passage, and that from thereafter filing of said document in the office of the Secretary of State, the annexation of such territory so proposed to be an- nexed and described herein, shall be complete and thence- forth such annexed territory shall be to all intents and purposes a part of the City of Burlingame, a municipal corporation, 5. This Ordinance shall be published once according to law. Mayor I. Herbert K. White, City Clerk of the City of Burlingame, do hereby certify the foregoing Ordinance was introduced at a special meeting of the City Council held on October 27, 1947, and adopted at a regular meeting of said Council held on November 3, 1947, by the following vote: AYES: COUNCILMEN: Harris-Simonds-Whitsell NOES: COUNCILMEN: ABSENT: COUNCILMEN: Dahl Hunt IN CONSIDERATION of the annexation by the City of Burlingame of the two tracts or parcels oP land more particularly described in the Petition dated July 31, 1946, executed by MILLS ESTATE INCORPORATED, for the annexation thereof to the City of Burlingame, said Mills Estate Incorporated hereby consents, covenants and agrees that said tracts or parcels of land shall be assessed and taxed to pay the proper proportion of the following specified indebtednesses of said City of Burlingame existing at the time of the annexation of said tracts or parcels of land, to wit: 1912 Water Bonds $ 5,000.00 1922 Park Bonds 10,000.00 1927 Water Bonds 1059000.00 1930 Library Bonds 12,000.00 1934 Sewer Plant Bonds 34,000.00 and any other existing indebtednesses incurred by the City of Burlingame for Municipal betterments or improvements. IN WITNESS WHEREOF, said Mills Estate Incorporated, a cor- poration, has caused this written consent and agreement to be executed by its Vice -President and its Secretary, thereunto duly authorized, and has caused its corporate name to be hereunto subscribed, and its corporate seal to be hereunto affixed, pursuant to a Resolution of the Board of Diredtors of said Corporation, a copy of which is hereunto annexed and made a part hereof. Tor g i o, Secretary WHEREAS benefits and advantages will accrue to this Cor- poration upon the annexation to the City of Burlingame, State of California, of the two tracts or parcels of land described in the Petition of this Corporation, dated July 31, 1946, for the an- nexation to the City of Burlingame of said two tracts or parcels of land; NOW, THEREFORE, in consideration of the annexation of said tracts or parcels of land to the City of Burlingame, this Cor- poration consents, covenants and agrees that said two tracts or parcels of land so annexed shall be assessed and taxed to pay their proper proportion of the following specified indebtednesses of the City of Burlingame existing at the time of the annexation of said tracts or parcels of land, to wit: 1912 Water Bonds 5,000.00 -922 Park Bond -s 102000.00 1927 Dater Bonds 105,000.00 1930 Library Bonds 12,000.00 1934 Sewer Plant Bonds 34.000.00 and any other existing indebtednesses of the City of Burlingame incurred for Municipal betterments or improvements. AND BE IT FURTHER RESOLVED, that Leslie H. Moore, Vice - President, and A. Toriggino, Secretary, of this Corporation, be, and they are hereby authorized, empowered and directed to make, execute, seal and deliver for and on behalf of this Corporation, to the City Clerk of the City of Burlingame, the consent, covenant and agreement of this Corporation that said tracts or parcels of land shall be assessed and taxed to pay their proper proportion of said specified indebtednesses existing at the time of said annexation, and any other existing indebtednesses incurred for Municipal better- ments or improvements. TORIGGINO, the duly elected, qualified and acting Secretary of Mills Estate Incorporated, a Corporation, hereby certify that the foregoing is a full, true and correct copy of a Resolution of the Board of Directors of said Corporation, duly and regularly passed and adopted at a special meeting of the Board of Directors of said Corporation, held onX4-ruraA1 , the /sr day of A/i✓EryCrEq , 1947, and that said Resolution as not been amended, vacated, modified, annulled or set aside, and is still in full force and effect.
