HomeMy WebLinkAboutOrd 0472ORDINANCE NO. 472 AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY CONTIGUOUS TO Tl -:E CITY OF BURLINGAME, 01WNED BY THE STATE OF CALIFORNIA, AND A PORTION TTS tE- OF USED BY IT FOR HIGHVaAY PURPOSES The City Council of the City of Burlingame does ordain as follows: WHEREAS the City Council of the City of Burlingame, on its own motion_, passed a resolution declaring its intention to annex the property in said resolution and hereinafter described, and therein stated as its reason for so doing that it did consolidate the State Highway known as the E1 Camino Real within the City of Burlingame from Peninsula Avenue to Dufferin Avenue and secondly to subject the said territory to local police control and regulation; and WHEREAS on Monday, the 4th day of October, 1948, the City Council of the City of Burlingame adopted a resolution fixing November 1, 1948, at the hour of eight o'clock p.m., (C.D.S.T.) at the Council Chambers in the City Hall of said City, as the time and place when and where any person or the owner of any property within the territory so proposed to be annexed may file written protest against the proposed annexation; and WHEREAS a copy of said resolution was published at least once a week for two successive weeks prior to the hearing in the Burlingame Advance, a newspaper of general circulation published in the said City and was so published on October 7 and October 14, 1948; and WHEREAS at the hearing on November 1, 1948, and where no person interested or at all objected to said annexation, the City Council now having jurisdiction to order the same; It is ordained and ordered as follows: 1. That the hereinafter described real property is unin- corporated, unhabited territory, contiguous to the City of Burlingame. 2. That said property is hereby annexed to said City of Burlingame. 3, That the boundaries of said area so annexed are hereby determined, established anddefined as follows: Two separate parcels of the State Highway of the State of California known as the El Camino Real in the City of Burlingame, County of San Mateo, State of California, to -wit: PARCEL NO. 1 BEGINNING at the point of inter- section of the northwesterly bound- ary of that subdivision known as Burlingame Village and recorded in Book No. 23 o{_Maps at Pages Nos. 31 and 92 of San Mateo County Records, with the easterly bound- ary of the State Highway common- ly known as II Camino Real, which point of beginning is also on the northwesterly boundary of the City of Burlingame; running thence southeasterly along the said easterly boundary of El Camino Real as shown on the above recorded plat on the arc of a curve to the left of radius 2120.00 feet, a distance of 306.53 feet; thence continuing along said easterly boundary of E1 Ca- mino Real, South 56' 14' 20" East, a distance of 1609.63 feet to the most along the northwesterly boon( that subdivision entitled "I game Gate," as recorded in No. 11 of Maps at Pages Nos. 65, Records of San Mateo C South 46° 34' 30" West, a di nf'6 AR Peet' thence along the 33' 30" East, a distance of 650.28 feet to the most southerly corner of Lot 1 of said Burlingame Gate Subdivision; thence South 53- 33' 30" East, a distance of 120 feet, more or less, to the northerly boundary of Mills Avenue; thence southwest- erly along said northerly boundary of Mills Avenue and its extension across II Camino Real to the most easterly corner of Lot 10, Block 50, Easton Addition #4, as recorded in Book No. 4 of Maps, Page No. 57, Records of San Mateo County, which corner of said Lot 10 also lies in the westerly boundary of EI Ca- mino Real; thence along said west- erly boundary of .M Camino Real North 53° 14' West, a distance of 93 feet, more or less, to the most easterly corner of Lot. 8, Block 50 of the said Easton Addition #4; thence along the westerly bound- ary of El Camino Real, North 53' 36' West, a distance of 450.17 feet, more or less, to the most easterly corner of Lot 1, Block 51, of that Subdivision designated as "Easton No. 5;' as recorded in Book No. 7 of Maps at Page No. 46, San Mateo County Records; thence along the westerly boundary of El Camino 1 Real, North 53' 56' West, a distance of 235.10 feet to the most northerly corner of Lot 4, Block 51, of said Easton Subdivision #5, as marked by a stone monument; thence leav- ing the westerly boundary of El Camino Real, North 34' 56' 55" East, a distance of 30.59 feet, more or less, to the center line of the old County Road now known as E1 Camino Real; thence northwest- erly along said center line of the old County Road on the arc of a curve to the left of radius 10,556 feet, a distance of 191.30 feet; thence continuing along the center line of the old County Road, North 56° 05' 23" West, a distance of 1392.50 feet to the beginning of a curve; hence continuing along the center line of the old County Road on the arc of a curve to the right ofiu rads 2220.02 feet, a distance of 299.17 feet; thence leaving the cen- ter line of the old County Road and running in a northerly direction a distance of 91 feet, more or less, to the point of beginning. PARCEL NO. 2 ` BEGINNING at the most easterly' corner of Lot 31, Block 1, of that Subdivision designated as Burlin- game Park #4, as recorded in Book" #D of Maps at Page #43, Records: of San Mateo County, which point' is also in the westerly boundary of that State Highway known as El' Camino Real; running thence on the extension of the southeasterly line.of said Lot 31, Block 1, across El Camino Real, to an intersection with the southwesterly line of Lot 8, Block 7, of that Subdivision des- ignated.as Burlingame Land Com- pany, as recorded in Book.�+3 of Maps at Page #55, Records o San Mateo County, which point is also in the easterly boundary of El Ca- mino Real, and is the true point of beginning for this description; running thence in a southeasterly direction along the easterly bound- ary of El Camino Real, which boundary is also the southwest- erly line of Blocks 7 and 8 of the said Burlingame Land ComDanv corner of Lot 3, Block 8, of said Burlingame Land Company Subdi- vision; thence along the easterly boundary of El Camino Real across Bellevue Avenue to the southwest- erly corner of Lot 11, Block 10 of the said Burlingame Land Company Subdivision; thence southwesterly at approximately right angles to the Preceding course on a line toward the northwesterly corner of Lot 1, Block 1 of that subdivision en- titled Burlingame Park #2, as re- corded in Book B of Maps, at Page 17, Records of San Mateo County, a distance of 40 feet to the center line of El Camino Real; thence along said center line of M Camino Real in a northwesterly direction, a dis- tance of 1128 feet more or less, to an intersection with the Southeast- erly line extended of Lot 31, Block 1 of the aforementioned Burlin- game. Park Subdivision #4; thence northeasterly along said lot line extended, a distance of 40 feet, more or less, to the true point of begin- ning. 4. That the annexation of said territory be, and the same is hereby approved and confirmed and shall take effect immediately upon the expiration of thirty days from and after the date of passage of this ordinance, and immediately upon its becoming effective, the City Clerk, being the Clerk of this Council, shall make, under the seal of the City, and transmit to the Secretary of State of the State of California, a certified copy of this ordinance giving the date of its passage, and that from and after the date of the filing of said document in the Office of the Secretary of State, the annexation of such territory so proposed to be annexed and described, shall be deemed t o be conplete and thenceforth such annexed territory shall be to all intents and purposes a part of the City of Burlingame, a municipal corporation. 5. This Ordinance shall be published once in the Burlingame Advance -Star, a daily newspaper of general circulation, published and circulated in the City of Burlingame and thereby designated by said Council for said purpose. introduced the lst day of November, 1948, and adopted by the City Council on the 15th day of November, 1948, by the following vote: AYES: COUNCIIIIEN: Dahl -Harper -Hunt -Love -Simonds NOES: COUNCILICN: None ABSENT COUNCILMEN: None ATTEST: e,
