HomeMy WebLinkAboutOrd 0509ORDINANCE NO. 509 AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY OF BURLINGAME BY ADDING THERETO A 'NEW ARTICLE 26-A ESTABLISHING A BUREAU OF FIRE PREVENTION AND PUBLIC SAFETY: PRESCRIBING ITS DUTIES: PROVIDING REGULATIONS FOR THE PREVENTION OF FIRES; SAFEGUARDING LIFE AND PROPERTY; REPEALING ALL ORDINANCES IN CONFLICT THBREffITH The City Council of the City of Burlingame does ordain as follows: Section 1, The Ordinance Code of the City of Burlingame Is hereby amended by adding thereto a new Article 26-A, which shall read as follows: ARTICLE 26-A Fire Prevention - Safe Guarding Life and Property as used in this code: (a) APPROVED. wherever approved methods or apparatus are called for in this bode, it shall mean approved by the Bureau. All apparatus must meet the approved standards of the ters Laboratories, Inc. (b) AUTOMOBILE WRECKING YARD: Any lot or premises in v&ich or other motor vehicles are dismantled for the of obtaining parts thereof to be sold or otherwise dis- ed of, and on which such dismantled parts are stored or kept. e) COMBUSTIBLE. Capable of being burned. (d) FIRE CHIEF. Chief of the Fire Department or his duly authorized deputy. Section 1429.9 (a) BUREAU. There is hereby established in and for the City of IlBurlingame, a Bureau of Fire Prevention and Public Safety, here- inafter called Bureau. The objects and purposes of the Bureau to provide an organization for investigation of the cause, In and circumstances of fires, to devise ways and means for prevention, and to enforce regulations for reducing the fire and safeguarding life and property. (b) COMPOSITION OF BUREAU. The Bureau shall be composed of the Fire Chief and two members of the Fire Department, who shall be detailed by the Fire Chief and charged with the duty and responsi- bility of enforcing the provisions of this Code and all other laws and regulations for the prevention of fires. The Fire Chief shall be Chief of said Bureau. (e) DUTY OF INSPECTORS. It shall be the duty of the Inspectors to examine into the condition of buildings and premises especially (susceptible to fire, and all hazardous occupancies; to see that .this Code and all laws and ordinances pertaining to the prevention of fires are strictly enforced, including such matters as the manufacture, storage, handling and use of inflammable or explosivell liquids or substances; to compel the proper location and mainten- ance of fire escapes, the sufficiency and adequacy of exits from faetories, schools, hotels, lodging houses, asylums, hospitals, rest homes, convalescent homes, nurseries, churches, halls, theatres, stadiums and all other places in oft ich numbers of people;l', work, live or congregate. (d) SCOPE OF INSPECTION. The intent of this ordinance is to safeguard and restrict the storage, handling and use of dangerous and hazardous materials to a reasonable degree with respect to injury to persons and destruction of property. Installation, construction and safeguards shall be provided in a standard, modern and approved manner. Compliance with Standards of the National Board of Fire Underwriters shall be prima facie evidence of such approved manner, The Inspectors of the Bureau of Fire Prevention shall maintain a public file of the Standards of the National Board of Fire Underwriters, which shall be deemed as advisory requirements to this ordinance insofar as they can be applied to each particular installation for which a permit is required. The Inspectors, upon complaint of any person, or whenever he deems it necessary, shall make an inspection of buildings and premises within the city for the purpose of investigating and -2- (correcting special hazards pertaining to buildings and/or their occupancies which may be due to such causes as the following: 1. Lack of repairs; 2. Age and/or dilapidated conditions; 3. Faulty or improper construction; 4. Lack of sufficient fire escapes or other means of exit; 5. Lack of automatic or other fire alarm apparatus; 6. Lack of fire extinguishing equipment; 7. Method of construction or materials used which make buildings especially susceptible to fire; 8. Surrounding conditions which endanger property or occupants; 9. Any and all other conditions creating a fire hazard. l(e) INVESTIGATION OF FIRES. The Fire Chief or Inspectors shall (,investigate the cause and origin of every fire occuring in the city by which life was jeopardized or lost, or property was damaged or destroyed and the circumstances surrounding same, and make and file a report thereon with the Fire Chief, immediately after the oecurence of all such fires. Every fire shall be reported to the fire department headquarters within one day after its occurrence. Such report shall contain a statement of all the facts relating to the cause, origin and circumstances of such fir, the extent of property damage therefrom, and the amount of insurance upon such property and any other pertinent information. (f) REPORT OF INSPECTIONS. The Inspectors shall make and file with the Fire Chief written reports of investigations# findings and dangerous conditions which he or his subordinates have been able to have remedied; and also such conditions as require action by the Bureau. Any dangerous condition due to lack of repairs age, general dilapidation, or to faulty or improper construction shall be referred to the Building Department in writing, and a copy thereof filed with the City Council. Section 1429.10 (a) UNOBSTRUCTED FIRE CURTAINS. Fire proof curtains required -3. =in theatres and other places of public assemblage shall never be obstructed from raising or lowering the same by wires, ropes# planks, platforms, etc., placed for the purpose of giving any act or acts. (b) NO SMOKING. It shall be unlawful for any person to smoke din any theatre or place of public assemblage when doing so will be hazardous to life or property. Section 1429.11 iFIRE EXTINGUISHERS REQUIRED. Are extinguishers as hereinafter described shall be the minimum requirement in the following occupancies: (a) APARTMENT HOUSES, HOTELS, AND HOSPITALS, one (1) two -and - one -half (2j) gallon extinguisher or equivalent on each main hall and on each floor. (b) FACTORIES AND MERCANTILE ESTABLISHMENTS, WHOLESALE AND RETAIL, one (1) two -and -one-half (2a) gallon extinguisher or equivalent per twenty-five hundred (2500) square feet of floor area or fraction thereof. (c) PUBLIC GARAGES, one(1) two -and -one-half (2*) gallon extinguisher or equivalent per twenty-five hundred (2500) square feet of floor area or fraction thereof, (d) PRIVATE GARAGE where more than three (3) automobiles are stored# one (1) two -and -one-half (2a) gallon extinguisher or equivalent for every five (5) cars or fraction thereof. (e) PARKING LOT, one (1) two -and -orae -half (2$) gallon extinguished or equivalent per six thousand (6,000) square feet of parking area or fraction thereof. (f) WRECKING YARD, one (1) two -and -one? -half (2j) gallon extinguish or equivalent per twenty-five hundred (2500) square feet of yard l area or fraction thereof, (g) SERVICE STATION, two (2) two -and -one-half (22) gallon extinguishers or equivalent, -4- (h) SPRAY AND PAINT SHOPS, one (1) tw -and-one-half (2a) gallon extinguisher or equivalent per twenty-five hundred (2500) square feet of floor area or fraction thereof. (i) PUBLIC AND PRIVATE HALLS used for assemblages, two (2) two - and -one-half (2j) gallon fire extinguishers or equivalent on each fldoro (j) EDUCATIONAL INSTITUTIONS, public schools, private schools, parochial schools, two (2) two -and -one-half (2a) gallon fire extinguishers or equivalent on each floor. (k) TAR POTS, one (1) two -and -one-half (2j) gallon foam type extinguisher shall be required for eachtar pot. (1) THEATRES, MOTION PICTURE HOUSES, and portions of buildings used for public or private theatrical purposes: (a) one (1) two -and -one-half (2j) gallon extinguisher or equivalent per twenty-five hundred (2500) square feet of floor area or fraction thereof, figuring galleries, auditorium and basement separately; ('b) one (1) two -and -one-half (2-J) gal Ion extinguisher or egziva- lent on each side of stage; (e) two (2) two -and -one-half (2a) gallon extinguishers or equivalent in basement or dressing room area; (d) one (1) two -and -one-half (22g) gallon extinguisher or equivalent at the entrance of furnace room; (e) one (1) eighteen (18) foot plaster hook on each side of stage, unless Chief of Fire Department deems it unnecessary; (f) one (1) two - and -one-half (2j-) gallon extinguisher or equivalent for every hundred (200) square feet of floor area or fraction thereof projection room. OF EXTINGUISHERS. All extinguishers must be of type by the Underwriters Laboratories, Inc., and conform to i of the National Board of Fire Underwriters as to nstal]ation, maintenance and use. Soda and acid or foam type f extinguishers shall be re -charged at least once each year, ad the date of such re -charge placed on an attached tag. -5- All fire fighting equipment shall be located in an accessible and conspicuous place approved by the Bureau. Additional ex- tinguishers shall be required in the occupancies mentioned above if it is deemed necessary to provide adequate fire protection. Additional fire fighting appliances and apparatus such as wrenches, spanners, axes, hooks, pails, etc., shall be provided when in i the opinion of the Bureau such equipment is necessary because of a special hazard on account of the location, surroundings or other peculiar conditions. All such equipment shall conform in design to that used by the Fire Department of the city. Section 1429.13 All iron or steel material used in the construction and erection of standpipes shall be galvanized, and all threads shall be painted with a rust resisting paint, cad shall be kept in good order and repair and free from obstructions. Standpipes shall be of such strength as will withstand a pressure of 300 pounds per square inch. Section 1429.14 DISTRIBUTION OF INFLAMMABLE LIQUIDS. All produces of petroleum, I including gasoline, benzine, naptha, and any other liquids, that will flash or emit inflammable vapor at a temperature below 187 degrees Fahrenheit, and are kept or stored within the limits of the City for distribution in bulk by a tank wagon, track or otherwise, shall be kept or stored according to the provisions of this Code* Section 1429.15 SCOPE OF PERMITS. Whenever a permit is granted as herein provided, to erect, construct or install any system, plant, deviod or apparatus specified in this Code, said permit shall carry with it the right to use, operate and maintain said system, plant, device or apparatus for the purposes specified in the application but for no other purpose. -6� Section 1429.16 OTHER PERMITS. The permits referred to and required by this Code shall be in addition to permits required by other City ordinances. Section 1429.17 DELIVERY. It shall be unlawful for any person, firm or cor- poration to deliver to any tanks drum or other receptacle that shall be above ground any Class 1, 2 or 3-A liquids or other liquid products that will flash or emit inflammable vapors at a temperature of 100 degrees Fahrenheit or below, without first obtaining a permit therefor from the Fire Chief, except it be for the delivery from a tank wagon to storage tanks of distributing plants. Delivery of gasoline by service stations or garages shall be from approved pumps as provided in this Code. Section 1429.18 PARKING. The Parking of tank trucks and trailers shell not be permitted in localities which would constitute a dangerous fire hazard. The stopping of such trucks or trailers except to comply with traffic regulations or making deliveries, shall be prohibited. Section 1429.19 0 No inflammable liquid with a flash point below 100 F. shall be used in any garage for washing parts or removing grease or dirt, unless in a special closed machine approved for the purpose, or in a separate room enclosed by walls having a fire resistance rating of not less than two hours, with openings therein protected by approved fire doors or fire windows, and with no opening from such room to any upper or lower story. The reservoirs of motor vehicles shall be filled directly through hose from pumps attached to approved portable tanks or drawing .7. from underground storage tanks. No transfer of gasoline to any garage shall be made in any open container. No gasoline or other volatile inflammable liquid shall be allowed' to run upon the floor or to fall or pass into the drainage system of the premises. Contents of all separators or traps of floor drainage systems shall be collected at frequent intervals and removed from the premises. Section 1429.20 ABANDONED TANES. Upon the temporary abandonment of any tank which was used for the storage of Class I or 2 liquids the inlet to the tank shall be effectively sealed in a manner satisfactory to the Bureau. When a tank which has been used for the storage of such liquids is permanently abandoned it shall be completely filled with water so as to expell all vapors and air therefrom. STORAGE AND _MIXING ROOMS FOR _PAINTS, OILS AND VARNISHES Section 1429,21 QUANTITY PERMISSIBLE. No paints, oils or varnishes or similar liquids having a flash point similar to that of Class 1, 2 and 3 liquids, shall be stared in quantities greater than ten (10) gallons and only when original containers are used, except that no one container shall contain more than five (5) gallons. Such storage shall be in a place rich would not constitute a dan- gerous fire hazard, Where it is desired to store more than ten (10) gallons of paints, oils or varnishes, or similar materials, storage cabinets shall be required. No storage cabinet shall contain more than fifty (50) gallons. Where it is desired to store more than fifty (50) gallons, stor- �age or mixing rooms shall be required• No paints, oils, varnishes or similar materials shall be stored in any building or portion of building unless such building meets all specified in the building code of the city for Group E occupancies. Construction of cabinets shall conform with or be equivalent in fire resistance to the following requirements: Bottom, top and sides of cabinet shall be made of not less than. No. 18 gauge sheet iron doubled wall with la inch air space. Joints shall be riveted or made equally tight. Doors shall be constructed equivalent to walls, provided with a three (3) point lock and kept closed when not in use. Door sills shall be raised at least two (2) inches above bottom of cabinet. Cabinet shall be conspicuously labeled "IN F;AMMABLE, KEEP FIRE AWAY." When deemed necessary, the Fire Chief shall require that cabinets shall be wanted. Section 1429,22 LOCATION OF STORAGE OR MIXING ROOMS. For storage of large quantities of inflammable liquids in drums or other receptacles, or where there is extensive miming or handling: No storage or mixing room shall be allowed in a basement or cellar, nor in any building having a basement or cellar, except that where the basement or cellar does not take in the total area of the building a storage room may be installed in a portion of the building that is not over the basement or cellar. Section 1429.23 CONSTRUCTION OF STORAGE OR MIXING ROOMS. (a) Walls floors, and ceilings shall be of eight (8) inches of brick or concrete, four (4) inches of reinforced concrete, or eight (8) inches of tile set in Portland cement mortar and plastered on both sides with Portland Cement plaster to a thickness of sl3 inch. (b) Exterior doors and doors opening to other rooms or building shall be provided with non-cobibustible sills raised at least six (6) inches. (c) Floor shall be waterproof and arranged to drain to a safe location. (d) All door openings shall be protected by a standard fire door of approved automatic or self-closing type, suitable for openings in fire walls. (e) Where other portions of the building or other properties are exposed, windows shall be protected in a standard manner. (f) Shelving shall be non-combustible. (g) Artificial lighting shall be by electricity with instal- lation in accordance with the National Electrical Code for extra hazardous locations. (h) Good natural ventilation is preferable in all storage and mixing rooms. Ducts shall be of substantial metal construction extending above roof of building and terminating in an efficient suction creating device and having screened openings at floor level. Natural ventilation by other methods of equivalent efficiency may be provided. :Where a mechanical ventilating system is necessary, installation shall be in compliance with the requirements of Class B for the removal of inflammable vapors, as provided by the Regulations for the Installation of Blower and Exhaust Systems of the National Board of Fire Underwriters. Section 1429.24 TYPE B INSIDE STORAGE OR MIXING ROOM. The following specifica- tions are intended to apply to inside storage and mixing rooms. where the quantities involved do not require Type A construction. C 014 S TRUC TI ON (a) 'Halls shall be one of the following types of construction and shall be continuous from floor to ceiling and be securely anchored: Metal lath encased in solid cement plaster not less than two and one-half (22) inches thick. Gypsum or cement plaster at least three-quarters (3/4) inch thick on metal lath on each side of stud partitions. Tile, gypsum or concrete block (cement plaster on each side to a thickness of one-quarter (1/4) inch. In lieu of the foregoing, any type of partition construction may be used which will afford one hour's protection against fire as determined by the American Society for Testing Materials specifications for standard fire test. (b) Artificial lighting shall be by electricity with installa- tion in accordance with the National Electrical Code for extra 10� hazardous locations. (c) Ventilation shall be as provided in subdivision (k) of Section 1429.23 hereof. Section 1429.25 STORAGE AND MIXING ROOMS. The following three sectional paragraphs shall apply to both types of mixing or storing rooms; (a) Heating shall be restricted to low pressure steam or hot water. (b) An approved waste can with self-closing lid shall be pro- vided for the storage of oily rags or waste, the contents of which shall be removed daily. (c) For first aid fire protection there shall be provided extinguishing equipment of the approved type, and one or more automatic sprinkler heads. Section 1429.26 OUTSIDE STORAGE HOUSES. (a) The type of construction to be employed for outside storage houses shall depend upon the proximity of proposed location to other buildings or structures. (b) When an outside storage house is so located as to seriously expose any nearby building or structure, construction should be equivalent in fire resistance to the Type A construction re- quirements for inside storage or mixing rooms. (c) When an outside storage house is so located as to moderately expose any other building or structure, construction should be equivalent in fire resistance to the Type B construction requirements for inside storage or mixing rooms prescribed by the Board of Fire Underwriters. (d) The provisions of Types A and B construction for lighting, heating, ventilating and first aid fire appliances prescribed by said Board shall be complied with. OIL BURNING SYSTEMS Section 1429.27 PORTABLE OR UNIT TYPE OIL HEATERS. This type of oil heater shall be deemed to mean those heaters which have been approved by the National Board of Fire Underwriters and listed as small heating and cooking appliances in pamphlet No. 310 published by said Board. No tank installed on the burner as original equipment shall have a greater capacity than six (6) gallons. If a burner is connect to an outside tank, all piping and tanks shall conform to the regulations for gravity oil burning systems as mentioned in this Code. All burners of this type shall be placed in a metal pan capable of controlling the capacity of the fuel tank of burner. On all burners of this type with outside storage tank, the pan shall be capable of controlling three gallons capacity and must be equipped with a heat actuating valve. Section 1429.28 COMPRESSED GAS SYSTEMS. In the event that natural gas is not available, compressed gas systems may be installed and utilized, until such time that natural gas becomes available lis per following regulationss All metal or other containers containing gas of nay nature used for burning or fuel purposes in any stove, heater, furnace or other heating or cooking devices, excepting acetylene welding or burning outfits, shall be stored outside the walls of any building, and not less than ten (10) feet therefrom. They shall be installed in conformity with the regulations of the National Board of Fire Underwriters$ on the installation of compressed gas systems, and to the satisfaction of the Bureau. LIQUIFIED PETROLEUM GASES. The design, installation and con- struction of containers for the storage and handling of liqui- fied petroleum gases shall be in accordance with the regulations of the National Board of Fire Underw1iters. ACIDS AND CHEMICALS Section 1429.29 ACID STORAGE. (a) Not more than one carboy of nitrie, muriatic or sulphuric acid, or a like acid, shall be kept or stored in any one place in the city unless the same be kept in a fire proof acid room of one (1) hour fire resistanffi construction, as defined 12 in the Building Code of this city. The Floor of said acid room shall be of concrete, and a sump shall be constructed at the lowest point thereon capable of containing at least two carboys of acid. There shall be a sill constructed of brick or concrete rising not less than nine (9) inches from the floor. On the outside of all walls or doors of the acid room there shall be signs reading "'ACID STORAGE'in letters not less than three (3) inches in height. All acid rooms shall be vented to outside air. (b) All acids mentioned in this section may be stored outside of the walls of any building in an open lot or yard, provided that such lot or yard be enclosed with a tight and secure fence, or wire mesh, with signs attached thereto designating that acid is being stored in the enclosure. Letters of such signs shall be not less than three (3) inches in height. (c) This section shall not apply to manufacturers while engaged in the process of manufacturing such acids; provided, however, that the Fire Chief may specify such regulations as he may deem necessary for the safety of life and property in the case of manufacturing. Section 1429.30 CALCIUM CARBIDE. (a) No calcium carbide shall be kept or stored without first obtaining a permit to do so from the Bureau. (b) All calcium carbide in transit through the city must be enclosed in hermetically sealed metal receptacles and plainly marked "CALCIUM CARBIDE --DANGEROUS IF NOT KEPT DRY", and no receptacle shall contain more than one hundred twenty (120) pounds of said carbide. (c) Calcium carbide shall be stored only in buildings of types of construction, or better, as defined in the Building Code for such purpose. They shall not exceed one (1) story in height with a basement, and be devoted exclusively to the storage, of calcium carbide or operation of an acytelene generator. No artificial heat will be permitted in such storage building. Lighting shall be of the fixed marine type. All calcium carbide shall be kept in hermetically sealed metal containers. -13- Section 1429.31 CHLORATE OF POTASH. Chlorate of potash in quantities in excess of one hundred (100) pounds must be stored in separate fire proof buildings or portions thereof, constructed in keeping with one (1) hour fire resistant construction, as defined in the Building Code. Section 1429.32 HAZARDOUS CHEMICALS. A permit from the City Council shall be required for the storage, handling and sale of chemicals and chemical compounds in excess of one standard Interstate Commerce Commission container where such chemicals or compounds are of a corrosive or poisonous nature, or which materially increase the fire hazard. Where kept in containers or packages usual to the retail trade, no general restriction shall apply other than shelving shall be substantial and storage shall be neat and orderly. (a) For storage of hazardous chemicals in warehouses, factories and wholesale stores, material of an oxidizing nature, such as nitrates, nitrites, chlorates, etc., shall be stored in dry places, and the Bureau may require a separate room or building when the quantity stored constitutes a material hazard. (b) Bulk storage or storage of two or more carboys of acid shall be outside in a yard or an enclosure, or properly protected on the roof of the building, or in a special room provided with a suitable container for the character of acid in case of breakage or leak. (c) The Chief of the Bureau of Fire Prevention may require the separation, or isolation of any chemical which is of a nature which in combination with other chemical or with organic matter may bring about a fire or explosion or may liberate a hazardous or poisonous gas. (d) Defective containers, which permit the spillage or leakage of contents, must be replaced or repaired and no materials shall be allowed to accumulate on floors or shelves. Section 1429.33 FUMIGATION -14- It shall be unlawful for any person to conduct or carry on the business of fumigation without first obtaining a permit therefor from the Chief of the Fire Prevention Bureau. Whenever any premises are to be fumigated or whenever any toxic or inflammable fumigant are to be used in any building, a permit therefor must be obtained from the Chief of the Fire Prevention Bureau, and sufficient warning of the process of fumigation must be given to prevent entrance to the premises. Permitees must have available suitable self-contained or forced air breathing appliances. Permits shall be issued only after an inspection of the premises, approval of the apparatus, materials and method of operation and the persons in charge thereof. AUTOMOBILE WRECKING AND JUNK YARDS Section 1428.34 It shall be unlawful for any person to establish and maintain an automobile wrecking or junk yard without first obtaining a permit from the City Council, and such establishment shall not be main- tained in any part of the city except in that portion thereof zoned as Industrial District. No automobile or any part thereof shall be burned for wrecking or salvage purposes in or on any premises occupied as a wrecking or junk yard. On any premises where large quantities of waste, paper, rags or combustible materials are stored in a building, the structure must be of fireproof construction not more than one story in height and proper ventilation for air circulation must be main- tained at all times. Vertical openings shall be properly enclosed and window openings shall be protected by metal frames and sash glazed with wired glass. Picking rooms shall be separated from storage rooms by a fire partition or wall. The entrance to such rooms shall be provided with standard, self-closing fire door. All picking rooms shall be provided with exhaust systems of sufficient capacity to adequately remove dust collections. Every storage building shall be completely protected by an approved system of automatic sprinklers. -15- BOWLING ALLEYS Section 1429.35 (a) Resurfacing operations shall not be carried on while the establishment is open for business. The Chief of the Bureau of Fire Prevention shall be notified when alleys are to be presurfaced. Proper ventilation shall be provided. Heating, ventilating, or cooling systems employing recirculation of air shall not be operated. All motorized or other equipment in the °area which might be a source of ignition shall be disconnected and all smoking and open flames prohibited during resurfacing operations involving the application of Inflammable finishes, and for one hour thereaf ter. (b) Pin refinishing shall not be done on the premises while the establishment is open for business. A special room meeting the requirements of Section 1429.24 of this Code shall be provided for this purpose; it shall not be located below grade. Storage of inflammable liquids in such rooms shall not exceed sixty (60) gallons in original metal containers or approved safety containers not exceeding five (5) gallons individual capacity. A metal waste can with self-closing cover shall be provided for all waste materials and rags; contents shall be removed daily. Smoking shall be prohibited at all times in refinishing rooms. EXPLOSIVES: MANUFACTURE, STORAGE AND USE Section 1429.36 EXPLOSIVES - LIMITATIONS IN MANUFACTURE. No person, firm or corporation shall manufacture or cause to be manufactured within the limits of the city any blasting powder, gun powder, hercules or giant powder, nitro-glycerine, dynamite, daulin or other explosives, except as provided hereafter in this code and except also that any explosives may be manufactured in the laboratories of colleges and similar institutions for the purpose of investigation and instructions. Section 1429.37 -16- TRANSPORTATION, STORAGE AND SALE. Regulations for the trans- portation, storage and sale of explosives shall be in accor- dance with the provisions of Division XI of the Health and Safety Code of the State. Section 1429.38 PERMIT REQUIRED FOR STORAGE. No explosive, as defined herein, shall be stored or kept in any location in the city without first securing a permit for such storage from the City Council and be stored Ina place and manner to its satisfaction. Section 1429.39 USE -PERMIT -BOND. No person, firm or corporation shall use or cause to be used any blasting powder, gun powder, hercules or giant powder, dynamite, daulin or other explosives, without first obtaining a permit from the City Council, and giving a bond in a sufficient amount as a guarantee to save the city harmless in the case of injury to persons or damage to property. LUMBER Section 1429.40 LUMBER STORAGE. All lumber within the limits of the City shall be piled in neat and orderly piles. Said piles, when stored in lumber yards shall not exceed fourteen (14) feet`in height measured from the adjoining ground level to the highest point of the lumber or timber piles. When stored on any premises other than a lumber yard it shall not exceed six (6) feet in height measured from the adjoining ground level to the highest point. of combustible vegetation or rubbish. PAINT SPRAYING, FLOOR DRESSING. PAINT REMOVING Section 1429.41 (a) PAINT SPRAY BOOTHS AND ROOMS. Spray painting shall only be done in rooms separated from the rest of the building by a one (1) hour fire resistive partition or partitions. Floors shall be covered with impervious incombustible materials. 01.7- Interior surfaces shall be smooth. Glass shall be wired glass in metal sash. The total area of glass in any wall cr ceiling, shall not exceed twenty percent (20%) of the area of such wall or ceiling. (b) VENTILATION. Every spray room shall be provided with a ventilating system exhausting to the exterior designed to produce a complete change of air every three minutes. (c) MMAUST DUCTS. Each exhaust duct shall be separate from all other ducts. Metal used in exhaust ducts shall be not thinner than 22 gauge, and, if the duct is larger in dimension thirty inches (30"), the metal shall be not thinner than 16 gauge. Exhaust ducts shall be at least twelve (120) inches from any combustible material unless insulated with one.fourth inch (1/4") asbestos paper or equivalent or unless surrounded by a ventilated metal collar. Exhaust ducts shall have tight fitting cleanout doors with substantial closing devices. Cleanout doors shall be spaced ao that the duct may be cleaned from the outside. Duct pipes vhere they terminate shall be so arranged that the discharge or residue or fire therefrom will not endanger Property, Where the building is so exposed that fire or sparks might enter the exhaust duct, setting fire to the spray equip. ment, the outlets shall be protected. No paint spraying as referred to in this section shall be done in any room in which an open flame, lamp or torch of any kind is used or in v&l ch electrical apparatus emitting a spark is installed. No other mechanical or repair work shall be done in a spray room, vehicles shall not be moved under their own power into spray rooms and electrical batteries in such motor vehicles —18. shall be removed before such vehicle is brought into the spray room. PAINT SPRAYING. It shall be unlawful f or any person, firm or corporation to apply or cause any paint, varnishes, lacquers or like finishes to be applied by spraying with air, air brash or direct pressure on any object or surface thereof, in any ng in the city, without a permit to do so* issued by the , vh ich permit shall not be granted is the conditions the premises for which the permit is desired, eonsti dangerous fire hazard under this code. No person shall manufacture, transport, store or sell matches exceeding in aggregate 60 matchman's gross (14,400 matches each gross) without securing a permit from the Chief of the Bureau of Fixe Prevention. Application for permit shall be made in writing and shall set fourth in detail, location of proposed storage or place of sale, or method of transportation, character of building con- struction, location of storage or place of sale within the building, kind of matches involved and type of containers. If, after an inspection of premises, the provisions of this ordinance are found to have been complied with, permit shall be issued. wholesale Storage..- At wholesale establishments and wherever matches exceeding the quantity specified in the first paragraph of Section 1429.45 are stored, shipping con- tainers containing matches shall be arranged in piles not exceeding ten (10) feet in height with aisles at least four (4) Peet wide. Where other materials or commodities are stored on the s ame floor with matches, a corner, and/or other portion of the room shall be devoted t III o match storage exclusively, and a clear i space of not less than four (4) feet maintained between match storage and such other materials and commodities. No matches shall be stored within tarn (10) feet of any open elevator shaft, elevator shaft opening, open stairway or other vertical opening. Ili Where shipping containers containing matches are opened, the contents of such broken containers shall be removed and stored in metal or metal lined bins equipped with spring self-closing metal or metal lined covers. -20. Storae by Retailers. --Where matches are sold at retail original sealed packages may be sdtbred on shelves. when such packages are broken, individual boxes shall be o t"d in metal or metal lined bins as described in the above paragraph. REFUSE AND COMBUSTIBLE CONTAINERS Section 1429.47 REFUSE -SPRINKLER HEAD. All refuse and garbage receptacles located within the exterior walls of any building which is designed, intended, or used, to receive the refuse, garbage or rubbish of a number of families shall be equipped with an auto- matic sprinkler -head of a type approved by the Fire Chief. Section 1429.48 STORAGE OF COMBUSTIBLE CONTAINERS. No packing cases, boxes, barrels or similar combustible containers shall be piled or stored on or in any premises in the city near any heating pipe, stoves, furnaces or similar appliances, or in any place or manner that is not deemed safe to life or property. Any such containers or materials stored or kept in the open, outside of any building, shall be piled not more than sixteen (16) feet high, and where possible, at least five (5) feet from any building, This shall not apply to canneries and preserving factories in the piling or storage of lug -boxes. CONTAINERS FOR COMBJSTIBLE MATERIALS. All receptacles for excelsior, waste paper, rags or other substances liable to cause fire by spontaneous ignition or combustion or otherwise must be made of metal, concrete or other non-combustible materials, and if possible must have a clear air space of not less than two (2) inches below the bottom. Section 1429.50 REMOVING COMBUSTIBLE MATERIALS. (a) Every person, firm or corpor- ation making, using or having in its charge or under his control any shavings, hay, straw, sacks, bags, litter or other "gombustible -21- waste material or fragments, shall at the close of each day cause the same to be securely disposed of or removed so as to be safe from fire. (b) It shall be unlawful for any person, firm or corporation to allow or permit to remain upon any roof, or in any building, yard, alley or on any vacant lot in the city any accumu7a tion of paper, hay, moss or any other inflammable or combustible rubbish or waste material. Section 1429.51 AUXILIARY FIRE ALARM BOXESs SPECIFICATIONS. Auxiliary fire alarm systems shall be in accordance with the regulations of National Board of Fire Underwriters as set forth in Article 5 of Pamphlet No. 72, MISCELLANEOUS PFS VISIONS Section 1429.52 X-RAY FILMS. All regulations for the storage and handling of photographic and X -Ray nitro-cellulose films shall conform to the regulations of the National Board of Fire Underwriters as recom- mended by the National Fire Protection Association. Section 1429,53 TAR POTS. No tar pot or portable fire box shall be transported through the city while any fire is burning therein or in the fire box thereunder, and no tar pot shall be burnt out without first securing a permit therefor from the Bureau. Section 1429.54 FAT RENDERING. No person shall render or boil down any fat for commercial purposes, unless he shall have first secured a permit therefor from the Fire Chief. Section 1429.55 FIRE ZONE. (a) There is hereby established about the scene of every fire during its course a "FIRE ZONE". which will consist of all public streets within a radius of three hundred (300) feet or more from said fire, and in every case shall include the two (2) closest street intersections. -22. (b) All traffic, vehicular and pedestrian, including street cars, locomotives, railroad cars, within a "Fire Zone" shall stop and it may be unlawful for any person to move, operate or start to move or operate any vehicle except upon orders of the Chief of Police or the Fire Chief. (c) It shall be unlawful to enter a "FIRE ZONE" or to stop, stand or park in such manner as to hinder the apparatus of the fire department in entering or leaving any "FIRE ZONE". (d) Such "FIRE ZONE" shall remain in existence until such time as the Fire Chief or his authorized agent shall declare the emergency past. OBSTRUCTING FIRE ALARM BOXES, It shall be unlawful for any person to place, or caize to be placed, any article or thing so as to interfere with or obstruct free access and approach to any fire alarm box. Section 1429.57 OBSTRUCTING FIRE HYDRANTS. It shall be unlawful f or any person to obstruct any fire hydrant in the city, or to place or deposit any lumber, rock, sand, debris or other substance within fifteen (15) feet of any such fire hydrant on any public or private rty in the city. The use of any wrenches that are not designed for a hydrant are strictly prohibited. No fire hydrant L the city shall be used by any person other than a member of is Fire Department, a city employee, or any employee of the ter Department supplying water to the hydrants of the city, thout first having secured permission therefor in writing om said water Department. HINDRANCE TO FIREMEN. It shall be unlawful for any person to wilfully offer any hindrance to any fireman in the performance of his duty at a fire. Section 1429059 VEHICLES OVER FIRE DEPARTMENT EQTJIPME-NT. It shall be .23- unlawful for any person to operate any vehicle, street car, locomotive or rdIroad car on, over or across any hose, ladders, or other equipment of the Fire Department. Section 1429#60 DEFACING PROPERTY. It shall be unlawful for any person to injure deface or destroy any property of the Fire Department. Section 1429.61 POWER TO COMMANDEER. It shall be lawful for the Fire Chief and his authorized agents to require the aid of the operator of any vehicle, in drawing or conveying aiV apparatus, personnel, equipment, or tools of the Fire Department to a fire. Section 1429.62 REMOVING DEBRIS AFTER FIRE. The owner or person having under his control or in his possession, upon any premises in the city any hay, straw# bales of wool, cotton, paper or other substances which have been rendered useless or unmerchantable by reason of any fire on such premises, or any debris, resulting from said fire, must forthwith remove the same from the premises. Section 1429.63 ;FRIGERATION APPARATUS. It shall be unlawful for aiy person, rm or corporation to install, alter, or cease to be installed altered# any non-portable system of refrigeration, unless such stem is an approved type and is instal]e d in accordance with a provisions of the "Safety Code for Mechanical Refrigeration", published by the Americai Society of Regrigerating Engineers. permit shall also be required of the Bureau for said stal]a tion and/or alterations. RICAL FUSES. All electrical circuits shall be fused with a of fuse allowed by the National Electrical Code. It shall be ful to use makeshift fuses. TIONS NEAR GLOBES. It shall be unlawful for any person to to any electric light globe or other lamp or light in such a -24- manner as to me in direct contact witb iper, cloth or combust- ible materials; such materials shall have at least six (6) inches clearance from the globe. Section 1429.66 DANGEROUS HOUSEHOLD APPLIANCES. The Fire Chief may prohibit the u e of any type, kind or make of cooking or heating appliance which after test by him or some competent authority, is considered a fire hazard. Section 1429.67 1 CLEANING OF CHIMNEYS. The owner or occupant of any building in the city shall ca use the chimney, stack or smoke flues thereof to be cleaned when, in the opinion of the Fire Chief, the amount of soot therein is liable to cause a fire. 1429 CLOSING UNOCCUPIED BUILDINGS. Whenever any unoccupied building or structure is not properly closed, and vagrants or other unauthor- zed persons may enter the same and start a fire therein, the u may notify the owner or person in control thereof to forth- th effectively close the same, which notice shall be complied th within forty-eight (48) hours after its receipt. c TINGS ON SIDEWALKS. There shall be at all times maintained, er every sidewalk grating on the floor of a sidewalk or open. onto a sidewalk, a metal catch pan, said catch pan to extend less than four inches beyond all sides of the grating or . Said catch pans shall be regularly cleaned and kept free all accumulations of dirt and refuse. Gratings on the front side of buildings which open or are exposed to passers-by on dewalks shall be covered with a fine screen adequate to keep out ghted matches, cigar butts or cigarettes, the throwing of vh ich ai nst such grating shall be unlawful. DEADLIGHTS. ALL sidewalk deadlights, that is, all plates f glass in the floor of a sidewalk for giving light underneath, be kept in good repair; en d broken deadlights shall be aced within twenty-four hours after notice has been given by Fire Chief to make necessary repairs. A copy of such notice -25- shall be given by the Fire Chief to the L-ty Council. Section 1429.72 BURNING RUBBISH OUTSIEE. It shall be unlawful for any person, I'firm or corporation to kindle, light, or cause to be kindled or c lighted any fires for the burning of rubbish, rags, papers, grass,, wood, refuse or any othercombustible material without first securing a written permit from the Fire Chief. The hours for burning shall be from 8:00 A. M. to 4 P. M. All fires must be extinguishes by 4:00 P. M., unless special permission is granted by the Fire Chief. There shall be no burning on Mondays. I A permit shall be required for all bonfires. For the purpose of this code, bonfires shall mean the burning of accumulations of combustible material in large open areas. If, in the opinion of the Fire Chief, such fires are safe to life and property he may grant a permit for the disposal of same or for a celebration. P, The location of all incinerators shall be approved by the Fire Chief, Before any incinerator can be used a written permit must be obtd ned from the Fire Chief. No permit shall be isszed in Fire Zone 1 for the burning of papers, rags, rubbish, wood, refuse or any other combustible material unless said burning is confined to a Class A, B, or C incinerator in accordance with the recommended standards of the National Board of Fire Under- writers. A permit shall be required for the use of any Domestic or Portable type incinerator in the residential district. Permits shall be required for the construction, location and use of barbecue pits. No barbecue pit shall be used for the disposal of combustible waste material. Section 1429. 73 DUTIES OF PERSONS IN CONTROL OF PUBLIC BUILDINGS. The owner, manager, or person having control or management of any theatre, hall, concert hall or other place of public assemblage must notify the Fire Chief at least six (6) hours before the same shall be opened or used for the purpose of public assemlolage therein. Licensed theatres and moving picture houses are exempt -26- from this provision insofar as it pertains to their regular afternoon matinees and evening performances. Section 1429.74 DETAIL OF FIREMEN TO PUBLIC BUILDINGS. The Fire Chief may, whenever he deems it advisable, detail one or more firemen to any building or structure used as a place of public assemblage, to be present during the progress of any assemblage therein. Section 1429.75 DUTIES OF FIREMEN DETAILED. The firemen so detailed shall enforce all laws, ordinances, and regulations pertaining to public safety arra the prevention and extinguishing of fires, pursuant to orders of the Fire Chief, and submit a report thereon. Section 1429.76 ENFORCEMENT, The Fire Chief, subject to the approval of the City Council may, from time to time, detail one or more firemen to serve as Fire Inspectors. While serving in that capacity it will be their duty to devote their entire time, except during a fire, to making inspections neeessax7 to secure the effective enforcement of this Code. Section 1429.77 NOTIFYING OTHER DEPARTMENTS. In case the Fire Chief should make any recommendations which involve structural, electrical or sanitary conditions, he shall immediately notify the building, electrical or health department, as the case may be, of such cotaditions, and a copy of such notice shall be sent by the Fire Chief to the City Council. Section 1429.78 Before a license or a permit may be issued, the Bureau of Fire Prevention shall inspect and approve the receptacles, Vehicles, buildings, or storage places to be used. Some of the provisions included in this code, along with other requirements, may also be covered by other laws or regulations enforceable by other departments other than the bureau of fire prevention. In such cases joint approval shall be obtained by the Bureau of Fire Prevention. M27� All applicants for a permit required by this ordinance shall be made to the Bureau of Fire Prevention in such form and detail as it shall prescribe. Permits and licenses must at all times be kept on the premises designated therein, and shall at all times be subject to inspec- tion by any officer of the fire or police departments. One permit only shall be required by retail establishments deal- ing in, or manufacturing plants using, two or more inflammable combustible or explosive materials to be kept in the establishmen' at any one time, but each of the materials shall be listed in the permit. Section 1429.79 USE OF REGULATIONS OF NATIONAL BOARD OF FIRE UNDERWRITERS MD OTHER REGUTA TIONS. The Fire Chief or his duly authorized representatives are hereby empowered and directed to invoke the existing requirements aad regulations of the National Board of Fire Underwriters, Underwriters Laboratories, Ihc., Interstate Commerce Commission, United States Bureau of Standards, Industri el Accident Commission of the State of California and other recognize authorities in any and all cases of fire hazards not specifically covered in any section of this code or other ordinance, all of which have been published in Code form and copies of which are on file vL th the Fire Chief and/or the City Clerk. Section 1429.8U APPEAL AND REVIEW. The Chief of the Fire Department shall be charged with the duty and responsibility of administering this Code. Wherever it is provided herein that certain thinEs shall be done in accordance with the order, opinion or approval of the Fire Chief, such order, opinion or approval shall be complied with; provided, any person aggrieved thereby, or believing that such. order, opinion or approval is erroneous or fault7i may appeal to -28- the City Council at its next regular meeting thereafter, and the decision of the City Council shallbe final and conclusive. In the meantime, the order, opinion or approval shall be deemed suspended until such person has exhausted his right of appeal as herein provided. Section 1429081 PENALTY FOR VIOLATION. Any person, firm or corporation violat- ing any of the provisions of this Code shall be guilty of a mis- demeanor and shall be purnished by a fine of not more than Five Hundred Dollars ($500.00), or by imprisonment for a period not to exceed one hundred and eighty (180) days, or by both said fine and imprisonment. Section 1429.82 CONSTITUTIONALITY. If any section, sub -section, sentence, clause or phrase of this ordinance be for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each section, sub -section, sentence, clause or phrase thereof Irrespective of the fact that ay one or more sections, sub- sections, sentences, clauses or phrases be declared to be unconstitutional.
