HomeMy WebLinkAboutOrd 0545ORDINANCE NO. 545 APPROVING AND ORDERING THE ANNEXATION OF CERTAIN UNINHABITED, UNINCORPORATED TERRITORY TO THE CITY OF BURLINGAME The City Council of the City of Burlingame does ordain as follows: WHEREAS, the Atlantic Life Insurance Company, a Virginia corporation, the owner of the real property hereinafter described, filed with the City Clerk of the City of Burlingame, a verified petition setting forth the boundary of the unincorpor- ated, uninhabited territory contiguous to the corporate limits of the City of Burlingame and requesting that the property be annexed to the City; and WHEREAS, said Atlantic Life Insurance Company, a corporation, by an agreement dated November 30, 1953, agreed that upon the annexation of said territory, the said property shall be proportionately subject to all of the existing bonded indebted- ness of the City outstanding at the date of said annexation, and in any indebtedness authorized and represented by bonds now issued, and to enjoy all of the privileges and benefits of said City; and WHEREAS, the City Council on the 21st day of December, 1953, adopted Resolution No. 93-53, fixing January 25, 1954, at eight o'clock, p.m., in the Council Chamber of the City Hall of said City, as the time and place when and where any person interested in the proposed annexation may appear and be heard thereof; and WHEREAS, the said Resolution directed that a copy thereof be published in the Burlingame Advance -Star, a newspaper of general circulation published in the City of Burlingame, County of San Hateo, State of California, on the 26th day of December, 1953 and on the 2nd day of January, 1954, being once a week for two successive weeks and twenty days prior to the time for the hearing of said petition; and WHEREAS, said Resolution further ordered that a copy thereof be published in the Redwood City Tribune, a newspaper of general circulation printed and published in the County of San Mateo, but not in the City of Burlingame, on the 26th day of December, 1953 and on the 2nd day of January, 1954, being once a week for two successive weeks and twenty days prior to the time for hearing on said petition; and WHEREAS, it appears from the affidavits of publication filed in this proceeding that the notice of hearing was published and all legal notice of said hearing was given as required by law; and WHEREAS, on January 25, 19540 at the, meeting of the City Council of the City of Burlingame and at the time and place fixed in the aforesaid notice, a hearing was had on the petition and thereafter the City Council having full and complete jurisdiction of the matter; it is hereby found, ordered and ordained: Section 1 - That the hereinafter described real property is unincorporated, uninhabited territory contiguous to the corporate limits of the City of Burlingame. Section 2 - That the Boundary Commission of the County of San Mateo, State of California, has approved the boundaries of the territory, above referred to and hereinafter described. Section 3 - That the said territory, hereinafter described, is hereby annexed and shall hereafter be a part of the City of Burlingame, a municipal corporation and shall be taxed to pay any indebtedness or liability of the City contracted prior to or existing at the time of annexation, and shall enjoy all of the privileges and benefits of said City ats aid time. Section 4 - That the said exterior boundaries of said territory hereby annexed are within the County of San Mateo, State of California and described as follows: V Beginning at a point on the northterly corporate d'. P limits line of the City lof Mi1f6'!ae, said. oint of, beginning,� ;.. being located S 61°00'00" E 853:41 feet and N 53011'36" E 521.70 feet from the intersect on of ,+,he''southwesteriy 1ine7,: 1 of the Old Bayshore Highway,nveyed byline Mills Estate Incorporated to the State of California by deed recorded August 8, 1925 in Book 277 of Official Records of San Mateo County, California, at page 307, with the southeasterly line of that certain parcel of land conveyed by the Mills Estate Incorporated to the Co ity of San Mateo by deed recorded October 15, 1941, in Book 987 of Official Records of San Mateo County, California, at page 166; thence from said point of beginning and leaving said northeasterly corporate limits line of the City of Millbrae, N 53011'36" E 7.266.32 feet to the corner common to Sections 1, 21 11 & 12, Town- ship 4 South, Range 5 West, Mt. Diablo Base and Meridian; thence along the line dividing Sections 11 and 12, S 0°02' 40" E 1508.57 feet to the most southerly corner of Tidelands Survey Number 12, which survey was made March 23, 1868, and the same being shown in Book of Tidelands Surveys at page 169, Records of San Mateo County, California; thence con- tinuing along said line dividing Sections 11 and 121said continuation of said line also being the common corporate limits line to the cities of Burlingame and Millbrae, S 00 02'40" E 493.94 feet to a point on the westerly line of the Old Bayshore Highway above described; thence along said westerly line N 44059'50" W 91.59 feet; thence tangent to the preceding course on the are of a curve to the left, having a radius of 2437.50 feet and a central angle of 16°00'10", an are distance of 680.00 feet; thence tangent to the preceding curve N 61°00'00" W 944.94 feet; thence leaving said westerly line of Old Bayshore Highway N 53' 11'36" E 521.70 feet to the point of beginning. . 4, •'U sr y m 4 Section 5 - That the City Clerk is hereby directed to submit to the Secretary of State of the State of California, a certified copy of this ordinance, giving the date of its passage, and that from and after the time of filing said document in the Office of the Secretary of State, the annexation of the territory above described shall be complete, and thenceforth shall be accord- ing to all intents and purposes, a part of the City of Burlingame, a municipal corporation. Section 6 - This Council declares that an emergency exists which constitutes a menace and a possible damage to the public health, welfare and safety of the people of the City of Burlingame and which makes it imperative in the furtherance of the public health, safety and welfare that this ordinance become effective forthwith, on the adoption thereof. The nature of the emergency is such that the land is to be immediately developed for residential, commercial and industrial enterprises, and saidt erritory should be subject to planning and zoning regulations, which now exist in the City of Burlingame and which it is proposed to apply to the newly annexed territory immediately and before any process of development occurs. It is also necessary that immediate police and fire service be rendered to the area as well as plans for storm and sanitary drainage be provided and failure to supply such service may endanger the safety, health and welfare of persons residing in said territory.
