AN ORDINANCE REPEALING SECTIONS 620, 621, 622,
623 AND 624 OF THE ORDINANCE CODE OF THE CITY OF
BURLINGAME AND ADOPTING NEW SECTIONS 6209 6211
622, 623 AND 624 CREATING A PUBLIC UTILITIES
COMMISSION, PROVIDING FOR ITS ORGANIZATION, TERMS
OF ITS TIMBERS, OFFICERS, POWERS AND DUTIES AND
REPEALING ALL PARTS OF THE SAID CODE IN CONFLICT
THEREWITH.
The City Council of the City of Burlingame does ordain as
follows:
SECTION 1: Sections 620, 621, 622, 623 and 624 of the
Ordinance Code of the City of Burlingame are hereby repealed.
SECTION 2: The Ordinance Code of the City of Burlingame is
hereby amended by adding thereto new Sections 620, 621, 622, 623,
and 624 which shall read as follows:
"SECTION 620 -- There shall be a Public Utilities Commission
of seven members who shall be appointed by the Mayor, subject to
confirmation by the Council. The members of the City Council
shall be ex -officio members of the Commission. Wherever refer-
ence is made in this Code to the Water Commission such reference
shall be deemed to be to the Public Utilities Commission herein
provided for.
"SECTION 621 -- The members shall hold office for three
years and until their successors are appointed and qualified.
The present members of the Water Comaiaaion shall be members of
the Public Utilities Commission for the balance of their present
unexpired terms upon the Water Commission. The members shall
serve without compensation, but all necessary expenses incurred
by them while acting in their official capacity shall be paid by
appropriate action of the City Council.
"SECTION 622 -- The City Council may remove any members of
¢the Commission from office prior to the expiration of his term
of office, with or without cause by the affirmative vote of not
less than four-fifths (4/5ths) of all members of the City Coun-
cil. Vacancies shall be filled by appointment by the Mayor
subject to confirmation by the City Council.
"SECTION 623 -- The Commission shall hold regular meetings
at least once a month and such other meetings as may be necessary
or expedient. A majority of the Commission shall constitute a
quorum for the purpose of transacting the business of the
Commission. The Commission shall elect a Chairman and a Secre-
tary who shall serve at the pleasure of the Commission. The
Secretary may appoint an assistant who shall not be a member of
the Commission. The Secretary shall keep a record of all pro-
ceedings, resolutions, findings and transactions of the Commiss-
ion for public inspection and shall furnish a copy thereof to
the City Clerk for the City Council.
"SECTION 624 -- All monies or credits due the City from the
MUNICIPAL WATER SYSTEM shall be deposited with the City Treasurer.
The Treasurer shall credit to the Water Fund the monies so re-
ceived.
"The Public Utilities Commission shall serve as an advisory
committee to the City Council on all matters pertaining to the
Municipal Water System, Drainage, Storm Drains, Street Repairs,
Street Lighting, Sewers and the City Dump. The Commission shall,
with the City Engineer, from time to time, make recommendations
to the City Council for any changes in policy, or for extensions,
plans of operation for developing, maintaining and protecting
the City's water supply, drainage, storm drains, street lighting,
sewers and the City Dump and for repairing the public streets."
SECTION 3: All parts of the Ordinance Code in conflict
herewith are hereby repealed.
SECTION 4: This Ordinance shall be published once as
required by law.

foregoing ordinance was introduced at a regular meeting held by
the City Council, on the 16th day of May, 1955, and adopted
thereafter at a regular meeting held on the 6th day of June, 1955,
by the following vote:
