HomeMy WebLinkAboutOrd 0656NO. 656 APPROVING ANNEXATION TO THE CITY OF BURLINGAME OF UNINHABITED CONTIGUOUS TERRITORY DESIGNATED AS THE LOMBARDI AND BARNES PROPERTY follows: The City Council of the City of Burlingame does ordain as WHEREAS, there has heretofore been filed with the City Council of the City of Burlingame a written petition signed by the owners of not less than one-fourth of the land in the territory proposed to be annexed by area, and by assessed value as shown on the last equalized assessment roll of the County of San Mateo, the county in which the said territory is situated, requesting that such territory be annexed to, incorporated in, and made a part of said City of Burlingame, a municipal corpora- tion, and which territory is situated in the County of San Mateo, State of California, and is more specifically described herein; and WHEREAS, the City Council of said City on May 6, 1957, adopted a resolution giving notice of such proposed annexation, and said resolution specifically described the boundaries of said territory proposed to be annexed to said City, and contained a notice of the day, hour and place when and where any person owning real property within said territory so proposed to be annexed and having any objections to the proposed annexation might appear and protest against said proposed annexation; and WHEREAS, notice of said hearing was duly published and mailed as required by the provisions of Section 35311 of the Government Code of the State of California; and WHEREAS, at the time of said hearing no person owning any real property within said territory appeared and objected to such oposed annexation or showed cause why such territory should not so annexed; and WHEREAS, the persons signing said petition are hereby fours to be all of the owners of the real property proposed to be annexed and all said owners have consented in writing prior to the adoption of this ordinance that the property within the annexed area may be taxed to pay its proportionate share of indebtedness and liability of the City of Burlingame contracted prior to, or existing at the time of, its annexation to the City of Burlingame. NOW, THEREFORE, it is hereby ordered that: 1. That certain uninhabited contiguous territory situated in the County of San Mateo, State of California, and more particularly described herein, be, and it hereby is annexed to the City of Burlingame, and this Council does hereby approve of said annexation pursuant to the provisions of Title 4, Division 2, Part 2, Chapter 1, Article 5 of the Government Code of the State of California, entitled "Annexation of Uninhabited Territory Act of 193911, being sections 35300 to 35326 (both inclusive) of said Government Code. Said uninhabited contiguous territory is situated in the County of San Mateo, State of California, and is more particularly described as follows: COMMENCING at the most northerly corner of the lands described in the Deed from Panama Realty Co., a cor- poration, to Jack W. Cameron and wife dated April 23, 1954 and recorded May 25, 1954 in Book 2588 of Official Records of San Mateo County at page 140 (59033-L); thence along the easterly line of the lands above men- tioned (said easterly line also being the westerly line of a 25 foot wide Easement for roadway and public utility purposes, described in the Deed from Panama Reay Co., a corporation, to County of San Mateo, recorded in Book 2163 of Official Records of San Mateo County at gage 285 (73315-J) and known as Summit Drive, South 1 39" East 24.75 feet, thence Southerly on a curve to the right Tangent to the preceding course, said curve having a radius of 175 feet, an are length of 38.04 feet and a central angle of 120 271 17" to the true point of beginning thence continuing Southerly on afore described curve an arc distance of 4,42 feet with a central angle of 10 26t 43" to a point on the West line of Summit Drive. Thence tangent to last described curve South 120 15t West 53.34 feet; thence Southerly along aforesaid West line on a curve to the left having a radius of 325 feet, an are distance of 85.84 feet with a central angle of 150 08t, thence tangent to last described curve South 20 53t E 33.61 feet calculated (deed 36.96 feet) -to the Southeasterly corner, of the lands of Lombardi thence leaving aforesaid Summit Drive South 750 37t 38" West 210.22 feet calculated (deed distance 208.31 feet) to a point on the Soth- westerly line of lands described in the deed to Jack W. Cameron and wife, first above mentioned; thence North 270 30t West 50 feet to the Southerly line of E1 Prado Road as said Road is shown on subdivision map of E1 Quanito Acres as recorded on April 8, 1957, Book of Maps, Volume 47, pages 13 and 14, Office of Recorder, San Mateo County, California; thence on and along said Southerly line of E1 Prado Road on the arc of a curve to the left having a radius of 225 feet, an arc distance of 107.88 feet and a central angle of 270 28t 18t1, thence tangent to last described curve North 380 08t 3011 East 102.93 feet, thence on a curve to the right along the Southeasterly line of E1 Prado Road, having a radius of 225 feet an arc distance of 88.98 feet and a central angle of 220 39t 31", thence Easterly and Southerly on the arc of a curve to the right on a radius of 20 feet, an arc distance of 45.38 feet with a central angle of 1300 001 1611 to the point of beginning and containing an area of 0.6 acres, more or less. 2. In accordance with the consent in writing as aforesaid of all of the owners of the hereinbefore described territory, and pursuant to the provisions of Section 35319 of said Government Code, said territory shall be taxed for its proportionate share of all indebtedness of said City of Burlingame contracted prior to, or existing at the time of such annexation. 3. This ordinance shall be published once in The Burlingame Advance -Star and shall be effective upon the expiration of thirty days after the date of its adoption.
