AN ORDINANCE ADDING SECTION 1335.1 TO THE
ORDINANCE CODE OF THE CITY OF BURLINGAME TO
PROHIBIT THE DISPLAY, SALE, OFFER FOR SALE,
BARTER, OR GIFT OF ANY FOWL, FISH, REPTILE
OR ANIMAL AS A NOVELTY
The City Council of the City of Burlingame does ordain
as follows:
SECTION 1: The Ordinance Code of the City of
is hereby amended by adding a new Section 1335.1 which shall read
as follows:
"Section 1335.1 - ANIMALS AS NOVELTIES (a)
It shall be unlawful for any person to display,
sell, offer for sale or barter any live rabbit,
baby chick, duckling or other fowl, fish, turtle,
snake, lizard, chameleon or other reptile, bird,
cat, dog, guinea pig, rodent or other animal, as
novelties, whether or not dyed, colored, or
otherwise artificially treated.
''This sub -section shall not be construed to
prohibit the display in proper facilities or
the sale of any animal, fish, reptile or bird
by any person carrying on any business in which
animals, fish, reptiles or birds are the stock
in trade when such person is possessed of a
valid business license under the ,orovisions of
Part IV of the Burlingame Ordinance Code, as
such provisions now exist or as they may be
hereafter amended.
"(b) It shall be unlawful for any
person required to procure a business license
under the provisions of Part IV of the
Burlingame Ordinance Code, as such provisions
now exist or as they may be hereafter amended,
to give away any animal, fish, reptile or bird
unless such person is possessed of a valid
business license to carry on the business of
a pet shop, kennel, aviary or fish hatchery.P°
SECTION 2. All ordinances and parts of ordinances in
conflict herewith are hereby repealed.
SECTION 3. SEVERABILITY. If any section, subsection,

clause, phrase, or portion of this Ordinance is for any reason
held to be invalid or unconstitutional by the decision of any
court of competent jurisdiction, such decision shall not affect
the validity of the remaining portions of this Ordinance. The
City Council of this City hereby declares that it would have
adopted this Ordinance and each section, subsection, sentence,
clause, phrase, or portion thereof, irrespective of the fact that
any one or more sections, subsections, clauses, phrases, or por-
tions may be declared invalid or unconstitutional.
