HomeMy WebLinkAboutOrd 0673ORDINANCE NO. 673 AN ORDINANCE ANNEXING TO THE CITY OF BURLINGAME CERTAIN UNINHABITED TERRITORY DESIGNATED AS "THE NORBERG PROPERTY" The City Council of the City of Burlingame does ordain as follows: KHEREAS, there has heretofore been filed with the City Council of the City of Burlingame a written petition signed by owners of not less than one-fourth of the land in the territory proposed to be annexed by area, and by assessed value as shown on the last equalized assessment roll of the County of San Mateo, the County in which the said territory is situated, requesting that said territory be annexed to, incorporated in, and made a part of said City of Burlingame, a municipal corporation, and which territory is situated in the Town of Hillsborough, County of San Mateo, State of California, and is more specifically described herein; and WHEREAS, the City Council of the Town of Hillsborough, did pass and adopt, on April 14, 1952, its resolution consenting to the detachment of said territory from the Town of Hillsborough; and 'AHEEREAS, the City Council of the City of Burlingame, on February 17, 1958, adopted a resolution giving notice of such pro- posed annexation, and said resolution specifically described the boundaries of said territory proposed to be annexed to said City, and contained a notice of the day, hour and place when and where any person owning real property within said territory so proposed to be annexed and having any objections to the proposed annexation ht appear and protest against said proposed annexation; and 6,:rHEREAS, notice of said hearing was duly published and mailed required by the provisions of Section 35311 of the Government e of the State of California; and WHEREAS, at the time of said hearing no person owning any real property within said territory appeared and objected to such proposed annexation or showed cause why such territory should not be so annexed; and WHEREAS, the persons signing said petition are hueby found to be all of the owners of the real property proposed to be annexed and all said owners have consented in writing prior to the adoption of this ordinance that the property within the annexed area may be taxed to pay its proportionate share of indebtedness and liability of the City of Burlingame contracted prior to, or existing at the time of its annexation to the City of Burlingame. NOW, THEREFORE, it is hereby ordered that: 1. That certain uninhabited contiguous territory formerly in the Town of Hillsborough, County of San Mateo, State of California, and detached therefrom by its said resolution passed and adopted on April 14, 1952, and more particularly described herein, be, and it is hereby, annexed to the City of Burlingame, and this Council does hereby approve of said annexation pursuant to the provisions of Title 4, Division 2, Part 2, Chapter 1, Article 5 of the Government Code of the State of California, entitled "Annexation of Uninhabited Territory Act of 1939," being sections 35300 to 35326 (both inclusive) of said Government Code. Said uninhabited contiguous territory is situated in the County of San Mateo, State of California, and is more par- ticularly described as follows: BEGINNING at a point on the southwesterly boundary line of Occidental Avenue, said point being the most northerly boun- ary corner of Lot 3, Block 14, as said Avenue, lot and block are shown on the above described map; thence from said point of beginning North 58043t31" East 30.16 feet to the center line of Occidental Avenue, as shown on said Map of "SUBDIVISION NO. 2 OF BURLINGAME PARK"; thence along said center line of Occidental Avenue, North 31107* West 125.76 feet; thence leaving said center line of Occidental Avenue South 520531 West 30.00 feet to said southwesterly boundary of Occidental Avenue; thence leaving said southwesterly boundary line southwesterly along the center line of a creek the following courses and distances: South 460081 West 25.92 feet, South 50111 West 40.30 feet, South 9031115" East 59.08 feet, South 60451 West 59.26 feet, - 2 - South 18004130t1 West 62.80 feet; thence leaving said center line North 58047105" East 29.7 feet, more or less, to the most northwesterly boundary corner of Parcel Two of the lands conveyed to John E. Freed, Jr., and Betty Fisher Freed, his wife, from Doris E. Koenig (formerly Doris E. Reid) and Mark A. Koenig by deed dated August 15, 1949, and recorded August 15, 1949, in Book 1701 of Official Records of San Mateo County, California at Page 233 (4493 I); thence along the northwesterly boundary line of said Parcel Two North 58047105" East 29.00 feet to the boundary corner common to Parcel One and Two of said lands, now or formerly, of Freed and to that certain parcel of land conveyed to Corporation of America, a corporation, trustee and Bank of America National Trust and Savings, a national banking association, from Ernest L. Norberg and Hollis Norberg, his wife, by the deed of trust dated September 16, 1941, and recorded October 18, 1941, in Book 991 of Official Records of San Mateo County, California, at Page 49 (35530 E); thence along the southwesterly boundary line of the last mentioned parcel of land, said southwesterly boundary line being coincident with the Corporate Limits of the above mentioned Town of Hillsborough North 15038105" West 60.13 feet to the most westerly boundary corner of the last mentioned parcel of land; thence north- easterly and continuing along said Corporate Limits line and along the northwesterly boundary line of the last mentioned parcel of land North 58043131" East 80.00 feet returning to the point of beginning. 2. In accordance with the consent in writing as aforesaid of all of the owners of the hereinbefore described territory, and pursuant to the provisions of Section 35319 of said Government Code said territory shall be taxed for its proportionate share of all indebtedness of said City of Burlingame contracted prior to, or existing at the time of such annexation. 3. This ordinance shall be published once in The Burlingame Advance -Star and shall be effective upon the expiration of thirty days after the date of its adoption. CHARLES W. ROOTH - Mayor I, Herbert K.
