THEY ARE EMPLOYED IN PART X, ARTICLE 50 Or SAID CODE PROVID-
ING FOR THE ESTABLISHMENT OF DISTRICTS WITHIN SAID CITY AND
REGULATING USES WITHIN SAID DISTRICTS
The City Council of the City of Burlingame does ordain as follows:
"SECT ON l� Section 1903 of the Ordinance Code of the City of
Burlingame is hereby amended to read and provide as follows:
Section 1903 m Definitions
.For the purpose of this article, the plural includes the singu-
lar, the masculine includes the feminine and neuter, and vice -versa,
except as otherwise provided. Other terms used in this article shall
be defined as follows;
ACCESSORY USE A use customarily incidental to the principal use of
land and/or building located on the same lot with the main building
or use.
ACCESSORY LIVING QUARTERS Living quarters within an accessory build-
ing loc•ited on the same premises with the main building, for the sole
use of persons, employed on the premises or of members of the same
family; such quarters having no kitchen facilities and not rented or
otherwise used as a separate dwelling.
AGRICULTURE The tilling of the soil, the raising of crops, horti-
culture, livestock, farming, dairying, or animal husbandry, including
all uses customary and Incidental thereto, but not including slaugr,ktor

AIRPORT Any area of land or Water desigred and set aside for the
sanding and launching; of aircraft.
ALLEY A public or private way providing; a secondary means of access
to public or private property.

APARTMENT A room or suite of rooms in a multiple family structure which
is arranp•ad, designed, or used as a single housekeeping unit and has
kitchen facilities permanently installed„
APARTMENT HOUSE A building, or porbion thereof, containing; three Or
more dwelling units used as a residence for three or more families
living; independently of each other, and in which each unit contains a
kitchen,
AUTOMOBILE OR 2RAILER SALES LOT An open area upon which automobiles
or trailers are, or may be, parked or displayed for the purpose of
sales or demonstration, toFpther with accessory buildings necessary
for the use, and where no repair work except minor incidental repairs
are done.
BALCONY A platform, enclosed by a parapet or railing, projecting
from an exterior wall of a building and open to the sky.
BASIsTLENT The portion of a building; between floor and ceiling which
Is wholly or partly undergrounds Where more than one-half of its
height is above the average ground level of the adjoining, area, a
basement shall be counted as a story for the purposes of height measure®
dent,
BLOCK. That property so designated on an official map of the city
or part of the cityp or 'bounded by streets or street end railroad
right-of-way or by streets or street and unsubdivided acreage.

;tUILDING Any structure with substantial walls and roof securely
affixed to the land and entirely separated on all sides from any
structure by space or by walls in which 'there are no communicating
doors, windows or openings; and which is designed or intended for the
shelter, housing; or protection of persons, animals or chattels.

BUILDING, HEIGHT OF The vertical distance measured from the estab-
lished finished lot grade at the middle of the front of the building
to the highest point of the coping of a flat roof or to the mean
height level between eaves and ridge of a gable, hip or shed rood
BUILDING ACCESSORY A subordinate buildinn•, the use of which is in-
cidental to that of the mair, building; on the same Iota
CARPORT A roofed automobile shelter open on one or more sides
CLUB An association of persons for the promotion of some common ob-
ject, members of which are admitted only upon invitation, and the
chief activity of which is not conducted for profit.
COM/1IS3ION The Planning Commission of the City of Burlingame.
CURB LEVEL The level of the established curb in front of a building
measured at the center of such front. There no curb level has been
established, the City Engineer shall establish such curb level or its
equivalent for the purpose of this ordinance.
DISTRICT A portion of the city within which certain uses of land
and buildings are permitted or prohibited and in which other buildings
or land restrictions may be specified as set forth herein.
DUPLEX A detached building designed for, or altered to provide dwell -
Ing, units for, occupancy by two families living independently of each
other with separate kitchens in each unit.
DbaELLING, MULTI -FAMILY A building, or portion thereof, used and des•
si*,ned as a residence for three or more families living independently
cif -,.-h other with each unit having its own kitchen; including agpart-
ment houses and flats, but not including automobile courts or motels.
DVIELLING, SINGLE-FAMILY A residence building containing but one
kitchen, designed and/or used to house not more than one family, and
not more at any time than three paying guests of such family.
FAMILY A person, or a group of persons related by blood, marriage
or adoption, or a croup of not more than five persons who need not be

related by blood, marriage or adoption, living together and maintain -
Ing a common household, but excluding sororities, fraternities, clubs
or similar organizations. A family shall be deemed to Include servants
FRONTAGE All property abutting on one stale of a street, between two
intersecting streets, measured along the street line.
GARAGE, PRIVATE A detached accessory building or portion of a main
building for the parking or storage of automobiles of the occupants of
the premises.
GARAGE, PUBLIC A building, or portion thereof, except a private
garage, used or designed to be used for the storage or care of self-
propelled vehicles, or where any such vehicles are equipped for
operation, repaired, or kept for remuneration, hire or sale.
GASOLINE SERVICE STATION Premises and the use thereof, for the re-
tail distribution of gasoline directly to motor vehicles, oils, greasesp
tires and batteries, greasing and washing, the sale of minor accesso-
ries, and services incidental thereto,
GRADE The average of the finished ground level at the center of
all walls of a building. In case walls are parallel to, and within
five feet of, a sidewalk, the ground level shall be measured at the
Sidewalk.
GRADE, ESTABLISHED The curb line grade at the lot lines established
by the city engineer.
GUEST, PAYING Any person renting one or more rooms or portions there-
of.
'SUEST HOUSE Living; quarters within a detached accessory building
located on the same premises with the main building, for use by tempo-
rary guests of the occupants of the premises; such quarters having no
kitchen facilities and not rented or otherwise used as a separate
dwelling.

HOPSE'. OCCUPATION Any gainful. occupation or profession engaged in by
an occupant of a dwelling unit including handicrafts, dressmaking,
millinery, laundering, teacb.ing or tutoring to one pupil at a time,
office for mail or telephone solicitation, or other similar uses,
which meets all of the following conditions:
1. The use Is clearly incidental and secondary to the prin-
cipal use of the dwelling for dwelling purposes;
2. The appearance of the dwelling is not changed, nor are
the residential character or esthetics of the district
affected;
3. No persons are employed other than those necessary for
domestic purposes;
4No article is sold or offered for sale on the premisess
and no mechanical or electrical equipment shall be in-
stalled other than that such as is customarily Inci-
dental to domestic use;
5. That the use creates no additional traffic nor requires
additional parking space.
6. No signs shall be displayed other than those permitted
In the particular residential district.
HOME FOR THE AMBULATORY AGED Where the proprietor furnishes lodgm
Ing and varying degrees of custodial care to persons who are elderly,
but otherwise in good health and not bedfast.
HOTEL,, APARTMENT A building containing dwelling units or individual
guest rooms, the majority of which are for permanent guests. Maid
and janitor service may be provided and kitchen facilities may or
may not be included.
H')TEL, MOTEL, TNN, AUTO COURT An establishment consisting of a
building or a group of attached or detached buildings containing lodg-
ing accommodations designed for use by transients, or travelers, or
t mpanary s ;. sts. Facilities provided may include naid <xevtr!.ce,, rixae$'k
scrviceg meal and beverage service, meeting rooms, incidental merchan-
dise sales, barber and beauty shops, kitchens, and other incidental
services and facilities.
FENNEL Any lot or premises or portion thereof on which dogs, cats,
and other household domestic animals are maintained, boarded, bred
or cared for in return for compensation or kept for sale.

LOT A single parcel of land, usually fronting on a street, into
which an urban block is usually divided far the construction of a
building or for a use, as such lot is shown and delineated on the
latest official map thereof on file with the county recorders; or,
if subsequently resubdivided, as described in the deed of the
owner.
LOT AREA The total horizontal area within the boundary lines of a.
lot.
LOT, CORNER A lot on a corner fronting on two intersecting streets.
LOT, DEPTH OF The horizontal distance between the front and rear
lot lines measured in the mean direction of the side lot lines.
LOT, INTERIOR A lot, other than a corner lot,
LOT LINE The established division line between parcels of land,
public or private.
LOT, THROUGH A lot having frontage on two parallel or approximately
parallel streets.
LOT, WIDTH OF The horizontal distance between the side lot lines
measured at an approximate right angle to the lot depth midway be-
tween the front and rear lot lines.
NON -CONFORMING USE A building or part of a building or a use of
land lawfully established which does not conform with the use regu-
lations of the district in which it is situated after the passage of
this Article or amendments thereto.

PARKING AREA, PUBLIC An open area, other than a street, used for the
temporary parking of automobiles and available for public use whether
free, for compensation, or as an accommodation for clients or custom-
ers.

PARKING LOT An open lot or parcel of land used for the storage of
motor vehicles capable of being moved by their own power and exclu-
sive of lots or parcels of land used for the purpose of dead storage,
auto wrecking or exhibition for sale,
PARKING SPACE, AUTOMOBILE Space within a parking area of a build -
Ing exclusive of driveways, ramps, columns, office and work areas, for
the temporary parking or storage of one automobile.

lodging is provided for compensation or a dwelling where mc. -e than
three paying guests are aecommodatad, without the service of reals.
SANITARIUM A building and premises in and on which two or mor,
sick, infirm, or injured persons are regularly housed or intendei to
be housed for compensation, not including hospitals.
SETBACK LINE A line within a lot paralleling a lot line, betweei
which lines the construction of buildings is prohibited.
SHELTERS, FALLOUT AND PROTECTIVE Structures built to protect: humans
against the effect of deposited radioactive airborne debris rssultiiZ
from the explosion of a nuclear weapon or from. other uncontrolien, rs-
lease o-' radioactive materials into the atmosphere„ A shelter which
extends at any point above the natural grade, except for the Vio¢
vision of essential ventilators, shall be deemed an above-grounii
shelter.
STORY That portion of any building included between the surface of
any floor and the surface of the next floor above it, and if there be
no floor above it, then the space between such floor and the ceiling

next above it. Neither an attached garage nor a roof garden shall
be construed as a story.
STORY, HALF A story with at least two of its opposite walls situ-
ated in a sloping roof, the floor area of which does not exceed two-
thirds of the floor area immediately below it.
STREET The land dedicated to, or condemned for, or established bym
use as a public thoroughfare,or a public or private thoroughfare
which affords principal means of access to abutting property.
STREET LINE The property line or 'boundary between a street and
abutting property.
STRUCTURE Anything constructed or erected, except fences, the use
of which requires permanent location on the ground or attached to
something having a permanent location on the ground.
TRAILER A vehicle designed for carrying property or persons on its
own structure and for being drawn by a motor vehicle.
USE The purpose for which land or a building is arrangeda designed
or intended, or for which either land or building is or may be oc-
cupied or maintained.
YARD An open space other than a court, on the same lot with a build-
ing which space is unoccupied and unobstructed from the ground up-
ward.
YARDS FRONT A yard extending across the front of the lot between
the inner side lines and measured between the front line of the lot
and the front line of the building.
YAPD# BEAR A ,yard extending across the width of the lot,, and
measured between the rear line of the lot and the rear line of the
main building.
YARD, SIDE A yard between the building and the side line of the lot
and extending from the street line of the lot to the rear yard.`

SECTION 2. If any section, sub -section, sentence, clauses
phrase or portion of this Ordinance is for any reason held in-
valid or unconstitutional by any court of competent jurisdiction,
such portion shall be deemed a separate., distinct and independent
provision and such holding shall not affect the validity of the
remaining portions.
SECTION 3. Any section, part of a section, of this Code in
conflict herewith is hereby repealed.
SECTION p. This Ordinance shall be published once as required
by law.

hereby certify that the foregoing Ordinance was introduced at a
regular meeting of the City Council held on the 4th day of
December , 1961, and adopted thereafter at a regular meeting of
the City Council held on the 18th day of December , 1961, by the
following vote:
