HomeMy WebLinkAboutOrd 0789ORDINANCE NO. 789 - AUTHORIZING THE ISSUANCE OF PERMITS FOR THE BURNING OF GARBAGE IN AN APPROVED INCINERATOR The City Council of the City of Burlingame does ordain as follows: Section 1. Section 1608 of the Burlingame Ordinance Code of 1941 is amended to read and provide as follows: "Section 1608. Incinerators,, It shall be unlawful to burn garbage except that a permit may be issued by the Chief of the Fire Department to burn garbage un- restricted as to burning hours or days in an incinerator which meets all of the requirements of the building code and which also meets the following conditions: (1) The incinerator shall be located not closer to any building or structure than specified in the permit. (2) The incinerator shall incinerate any and all combustible material deposited within a degree of neatness free from odor or infestation, resul in a residue which is suitable for a cover material (3) The incinerator shall not discharge into the atmosphere, from any source of emission, any air contaminates, for a period aggregating more 3 minutes in any one hour, which are: (a) as dark as, or darker in shade than that designated as No. 2 on the Ringelman Chart as published by the U. S. Bureau of Mines, or (b) of such opacity as to obscure an - 1 - observer's view to a degree equal to or greater than the smoke described in the prior subsection (a). (4) The incinerator shall not emit any obnoxious odor. (5) The incinerator shall comply with all state laws applicable thereto and shall be of a type which can be altered to comply with all futur state laws and amendments to this code, which may become applicable thereto. (6) The incinerator shall further comply with all rules and regulations relative to the performance of garbage and refuse disposal facili- ties adopted by the governing body of the Air Pollution Control District of the County of Los Angeles, and with all rules and regulations of the Bay Area Air Pollution Control District as each is now in effect, or which may hereafter be adopted, whichever may be the more strict. "No refuse may be burned except in accordance with the provisions of Article 26A of this Code, "This section shall control over all ordinances, portions of this code, and regulations inconsistent or in conflict herewith." Section 2. This ordinance shall be published once as required by law, 1, Herbert K. white, City Clerk, do hereby certify that the foregoing ordinance was introduced at a regular meeting - 2 - of the City Council held on the 7th day of October 1963, and adopted thereafter at a regular meeting of the City Cou ci. held on the 23rd day of October 1963, by the following vote: Ayes: Councilmen: Crosby-Diederichsen-George- Johnson-Martin Noes: Councilmen: None Absent Councilmen: None - 3 -
