AN ORDINANCE ADDING CHAPTER 9.06 TO TITLE 9 OF THE MUNICIPAL CODE PROVIDING FOR AN ANIMAL SHELTER, AUTHORIZING CONTRACTS FOR ANIMAL SHELTER SERVICE, CREATING THE OFFICE OF POUND - MASTER, AND PROVIDING FOR THE ENFORCEMENT OF LAWS AND ORDINANCES RELATING TO ANIMALS. The City Council of the City of Burlingame does ordain as follows: SECTION 1: Chapter 9.06 is hereby added to the Munici- pal Code of the City of Burlingame which shall read and provide as follows: "CHAPTER 9.06 ANIMAL SHELTER 11§9.06.010 - Animal Shelter "An animal shelter is hereby authorized and established for the city. The building or buildings constituting the shelter shall be located at such place, or places, with- in or without the city, as shall be designated from time to time by the Council, or by any contract authorized hereby. (The animal shelter shall supersede and supplant the public pound heretofore existing and shall perform all services and functions heretofore performed thereby. All references in this code to "public pound" or "pound" shall mean the animal shelter.) "§9.06.011 - Contracts Authorized 'The Council may provide, by contract or otherwise, for animal shelter service upon such terms and conditions, and with such person, or public corporation, agency or instrumentality as it shall determine in the public interest. "§9.06.012 - Poundmaster "A poundmaster, and such deputy poundmasters as shall be -1- authorized by the Council from time to time, shall be appointed by the City Manager and shall have powers of peace officers and shall have the duty and authority to enforce the provisions of Title 9 of this Municipal Code and the provisions of law relating to the care, treat- ment, or impounding of, or the prevention of cruelty to, animals, 'The Superintendent of the animal shelter and the Animal Control Officers of any person with whom the City of Burlingame has entered into a contract for animal shelter service are hereby declared to be the Pound - master and Deputy Poundmasters authorized by this sec- tion. The Poundmaster and all Deputy Poundmasters, while engaged in the regular performance of their duties, shall have the powers of peace officers, and shall wear I I a badge plainly designating their office. It shall be j unlawful for any person to resist or interfere with any j i Poundmaster or Deputy Poundmaster in the discharge of I his official duties." SECTION 2: This ordinance shall be published as re- quired by law. Mayor I, HERBERT K.
