HomeMy WebLinkAboutOrd 0867WJMLoSSD:r�mb 7/25/67 20c ORDINANCE N0, 867 AN ORDINANCE CALLING A SPECIAL ELECTION IN THE CITY OF BURLINGAME FOR THE PURPOSE OF SUBMITTING TO THE ELECTORS OF SAID CITY A PROPOSITION FOR THE INCURRING OF A BONDED INDEBTEDNESS OF SAID CITY FOR THE ACQUISI- TION, CONSTRUCTION AND COMPLETION OF A CERTAIN MUNICI- PAL IMPROVEMENT; DECLARING THE ESTIMATED COST OF SAID IMPROVEMENT,, THE AMOUNT OF THE PRINCIPAL OF SAID INDEBTEDNESS TO BE INCURRED THEREFORq AND THE MAXIMUM RATE OF INTEREST TO BE PAID THEREON; FIXING THE DATE OF SAID ELECTION, THE MANNER OF HOLDING THE SAME AND PROVIDING FOR NOTICE THEREOF SEWERAGE TREATMENT AND DISPOSAL WORKS AND SYSTEM THE CITY COUNCIL OF THE CITY OF BURLINGAME DOES ORDAIN AS FOLLOWS: WHEREAS, the City Council of the City of Burlingame, by Resolution No, 46-67passed and adopted at a regular meeting of said Council on August 7, 1967, by the affirmative vote of more than two thirds of all of its members, did determine that the public interest and necessity demanded the acquisition, construc- tion and completion of the municipal improvement hereinafter men- tioned, and did further determine that the cost of said proposed municipal improvement will be too great to be paid out of the ordinary annual income and revenues of said City and that said indebtedness will require an expenditure of funds greater than the amount allowed for it by the annual tax levy of said City; NOW, THEREFORE, IT IS ORDERED, as follows: 1. A special municipal election be, and it is hereby, called and ordered and will be held in the City of Burlingame on Tuesday, the 10th day of October, 1967, at which election shall be sub- mitted to the qualified electors of said City the question of incurring a bonded indebtedness by said City for the objects and purposes set forth in the following proposition, to wit: PROPOSITION. "Shall the City of Burlingame incur a bonded indebtedness in the principal amount of One Million Two Hundred Fifty Thousand Dollars ($1,250,000) in accordance with the provisions of the Ordinance calling the election at which this proposition is submitted for the acquisition, construction and completion of additions, extensions and improve- ments to the City's sanitary sewerage treatment and disposal plant system and works?" 2. The estimated cost of the municipal improvement set forth in the proposition and the amount of the indebtedness to be incurred therefor, including legal and other fees, costs of printing the bonds and other costs and expenses incidental or connected with the authorization, issuance and sale of the bonds therefor is the sum of $1,250,000. 3. Said Council does hereby submit to the qualified electors of said City of Burlingame at said special municipal election, this Ordinance and said proposition set forth in Section 1 hereof. The said Council proposes to issue and sell bonds of said City in the amount and for the objects and purposes specified in said proposition if two thirds of the qualified electors voting on the proposition at said special municipal election shall vote in favor thereof. 4. If two thirds of the qualified electors voting on the proposition shall vote in favor thereof, said proposition shall be deemed adopted. Said bonds shall be negotiable in form and of the character known as serial, and shall bear interest at a rate not exceeding six percent (6%) per annum, payable semiannually except that interest gor the first year after the date of the bonds may be made payable at the end of said year. 5. The said special municipal election shall be held and conducted, the votes thereof canvassed, the returns thereof made, and result thereof ascertained and determined as herein provided; 2. and in all particulars not prescribed by this ordinance said election shall be held as provided by law for the holding of municipal elections in said City. 6, All persons qualified to vote at municipal elections in said City upon the date of the election herein provided for shall be qualified to vote upon the proposition submitted at said special municipal election. 7. For the purpose of holding and conducting said special municipal election there shall be fourteen (14) voting precincts, consisting of consolidations of County Election Precincts as last established by the Board of Supervisors of the County of San Mateo for the conduct of State and County elections, their descriptions, the polling places designated therefor and the election officers to conduct said election are as follows: Consolidated Voting Precinct "A" shall comprise State and County Election Precinct numbers 8, 9 and 10. The polling place for said Consolidated Voting Precinct and the election officers therefor are as follows. Polling Place; Inspector. Judge: Clerk. Ballots for the election shall be provided of the form and to the number provided by law. On said ballots, in addition to any other printed matter which may be required by law, two voting squares shall be set off to the right of the proposition submitted at the election as set forth in Section 1 of this ordin- ance in the manner provided by law, one having the word "YES" printed before it and the other having the word "NO" printed' before it. 9. Each voter to vote for the proposition and for incur- ring the bonded indebtedness shall stamp a cross (X) in the blank space opposite the word "YES" on the ballot to the right of the proposition, and to vote against the proposition and against the incurring of the indebtedness shall stamp a cross (X) in the blank space opposite the word "NO" on the ballot to the right of the proposition. 10. The polls shall be opened at 7:00 o°clock A.M. of the day of the election and shall be kept open until 7:00 o'clock P.M. of the same day, when the polls shall be closed, except as to voters in line as provided in Section 14436 of the Elections Code. 11. The City Clerk is hereby authorized and directed to con- tact the County Clerk of San Mateo County for the purpose of procuring necessary rosters and ballot boxes and to procure all supplies necessary for the proper conduct of said election. 12. This ordinance is adopted pursuant to Article 1, 91 comprising Sections 43600 to 43638, inclusive of Chapter 4, Division 4, Title 4 of the Government Code of the State of California. 13. This ordinance shall be published once a week for two (2) successive weeks in the Burlingame Advance -Star, a newspaper of general circulation, printed and published less than six (6) days a week in the City, and such publication shall constitute notice of said election. No other notice of the election hereby called need be given. 14. This ordinance, being an ordinance calling and ordering an election, shall take effect immediately upon its adoption.
