'' ,,rrrd Commissioner ffiffi'-"r"rsed himself from this discussion due to potential conflict of interest. Traffic Engineer Chou provided an overhead transparency displaying the location in question. He explained that this item was an appeal of the installation of two parking spaces behind Cosby Commons, on City Hall Lane. He further explained that the proposed installation of two new designated spaces was one method for the City to be more consistent regarding parking regulations on City Hall Lane. Mr. Chou went on to say that one of the concerns the Mr. Salma has is over the use of an easement area which was agreed upon long ago 2 The City of Butlingane Page TRAFFIG, SAFEW AND PARKING COMMISSION Meeting Minutes - Unapproved Thursday, August 11, 2005 between the Ci$ and property owners. He pointed out that the current overhead display showed City Hall Lane at approximately 20' wide. This was from the face of the curb on the south side almost to the building face. He said that the easement was a 3-foot section extending south directly behind the building at the west end, and increased to 5.39 feet at the eastern end of the property as City Hall Lane curved. So, the 17-foot middle section of Cig Hall Lane (which was actually the City's right-of-way) plus the 3-foot easement made up the entire 2O-foot roadway of Cig Hall Lane. Mr. Chou explained that an old agreement between the City and property owners along City Hall Lane allowed the City to use of that 3- to 5- foot section as part of City Hall Lane. Mr. Chou then displayed a second exhibit showing the placement of the proposed two new parking spaces. He said that these new spaces would be fairly consistent with what was now along the rest of the lane. Mr. Riyad Salma spoke to the Commission and indicated that he appreciated the suggestion of the loading zone for his tenants, but was concerned that it did not address his problem in large part because (1) there was still a question of enforcement of the loading zone since not all his tenants used commercial vehicles, (2) a commercial loading zone would be available to all businesses in the area, making the accessibility of the space to his tenants less guaranteed. Mr. Salma said that he would like to find a compromise with the City. For clarification purposes, Mr. Chou informed the Commission that a parking lane was typically from 6-8 feet and a travel lane was 10-14 feet. Commissioner Conway stated that he concurred with the City Attorney's interpretation of the agreements. He said that there were many businesses in Burlingame that used loading zones farther away, and that Crosby Commons would have a loading zone right behind the building. He added that this seemed to be a fair and equitable solution not just to Crosby Commons, but also to some of the businesses down City Hall Lane and Primrose Road. Mr. Salma reiterated that the distinction about this situation was that the area was a combination of both private and public property. He also felt that a public loading zone of 6-8 feet was not a functional space for loading. Commissioner Cohen was concerned that the current parking situation was unique in terms of enforcement, and presented an unfair situation to the 3 The City of Budingame Page TRAFFIC, SAFETY AND PARKING COMMISSION Meeting Minutes - Unapproved Thursday, August 1 1, 2005 tt'&,^#/ other businesses in Burlingame. He said that there might be other areas in the City where businesses would expect the same treatment. Commissioner Cohen stated that he was comfortable with the proposed compromise of two new parking spaces, and believed the loading zone would be efficient and convenient in accommodating the tenants' loading needs. He added that regarding the agreement and legal issue, he concurred with the City Attorney's determination. Commissioner James stated that he supported the staff recommendation if the parking, health and safety issues regarding this matter were addressed. Mr. Salma stated that he believed the City's action to install one loading zone and one '|O-hour parking space would create an unenforceable loading zone problem, and that the public parking space would quickly become unavailable. He offered the idea of making one public space and one private space. He said that the proposed loading zone could be marked as a private parking space instead. Mr. Chou stated that the City would have to enter into an whole new agreement regarding land-swaps in order to make this happen. He did not recommend such action. Traffic Engineer Chou informed the Commission that at this time, staff was not making a recommendation regarding this matter. He explained that due to the impending consolidation of the Adrian Road Sky Chefs office to the offices at Cowan Road, there would be an additional demand for parking around the Cowan area. He added that the Adrian Road facility 4 The City ol Bulingade Page TRAFFIC, SAFETY AND PARKING COMMISSION Meeting Minutes - Unapproved Thursday, August 11, 2005 He suggested that the sub-committee, established at the last Commission meeting, work to look at the parking impacts of the entire area as opposed to dealing with the individual streets such as Mahler Road, Gilbreth, and Cowan on a separate basis. Mr Chou also explained that Gilbreth Road currently had a 4-hour parking limit and overnight parking restrictions. He said that the issue before the Commission now was what to do with the other side streets in conjunction with Mr. Al Lovatti's past problems on Mahler, and consolidation of the Sky Chefs facility at Cowan. Vice-chair Condon and Commissioner James suggested considering the extension of the 4-hour parking limit on Gilbreth to Mahler and Cowan to prevent overnight parking. Mr. Chou expressed a concern that the City not penalize those businesses with large trucks for legally parking since the area was a commercial/industrial zone. But, he also cautioned that the City should not create a situation to encourage abuse by removing or changing certain existing restrictions. The sub-committee (Condon and James) felt that keeping customers in mind was a first priority. Also, there is a concern that people are dropping off their cars and leaving it there for days on end. lf a four hour time limit is installed, the reality is that there will be 5€ hour soft time. The height restriction, the sub-committee felt was OK in a commercial area on the EasUWest streets, keeping everything at four hours unless this raises a problem at which time they could raise the height limit on the EastM/est streets so the trucks can go there. Mary Donnelly, of Sky Chefs spoke and informed the Commission that with a bad economy, the company had decided to combine both of their operations to the larger Cowan Road facility. She commented that the existing parking restrictions on Gilbreth could push vehicles to Mitten and Cowan to park for more than four hours. She added that large trucks took up 34 spaces on Cowan, and that there were no marked-off parking spac€s so that people were not parking properly and the excess space was wasted. Ms. Donnelly also said that Gilbreth Road had very few cars parking there now; and, that their employees (who punch a time clock for lunch) need their 30 minutes of rest, sit and eat their lunch before they go back to work. She said that it was not feasible for them to take their short lunches, then move their cars another 100 feet down the road. Ms. 5 The City of Burlingame Page was anticipated to close by the beginning of September; and, that all those employees would be moving over to the Cowan Road facility. Mr. Chou also stated that this would mean an additional 150 employees over a three- work shift period. TRAFFIC, SAFETY AND PARKING COMMISSION Meeting Minutes - Unapproved Thursday, August 11, 2005 Donnelly stated that Sky Chefs has looked into renting parking spaces from a neighboring business, but that they were asking for $200 a space, per month. She said that this was not feasible for the company, so she was asking the Commission consider make Gilbreth Road at least 8-hour parking. Commissioner Cohen asked for clarification of the problem. Mr. Chou explained that there were two issues to this matter. One was to try to create a uniform, comprehensive parking plan in the area, and the other was to figure out how to deal with increased parking needs for customers or employees of future businesses on the side streets. Vice-chair Condon suggested notifying the entire neighborhood about a public meeting to discuss a plan and scope out a thought process. He said that the Commission should deal with this issue over the next two meetings and not call a special meeting. Commissioner Cohen suggested taking notes of the different kinds of business in the area. Commissioner James indicated that he did take an inventory of the business, but suggested that the City give all parties involved notice of upcoming meetings. Vice-chair Condon stated that over the last year, the Commission had dealt with several issues pertaining to this area, and that the Commission should notifo the area of what it wanted to implement at this point. Commissioner Cohen was concerned of the varying needs of the businesses. Chair Warden suggested contacting a few businesses on Cowan to schedule a meeting during the day with the hope of getting a befter response than if a meeting was scheduled in the evening. Ms. Donnelly offered the use of Sky Chefs's conference room for this meeting. Commissioner Conway asked for clarification of Sky Chefs's relocation schedule. Ms. Donnelly stated that September 1 would be the completion date of Sky Chefs's move. She also stated that their employees had already experienced parking problems, especially between 2 PM and 5 PM on Mitten and Cowan. She added that some of their employees worked two jobs in order to maintain their livelihood; and, that they barely had enough time to leave one job to get to another. ln essence, if they had to The City ol Budingame Page Chair Warden asked Ms. Donnelly if Dollar Rent-a-Car was willing to provide space to Sky Chefs. She said they were not. Ms. Donnelly stated that she was passionate about her employee's parking situation and would come to any meetings regarding this subject. 4.2.3 California Drive and Howard Avenue - 24-Minute parking and No Parking Traffic Engineer Chou explained that the City received a request from Mr. Rino Betti, at 297 California for a 24-minute green zone on Howard, in front of his business. Mr. Chou said that there was a concern about turning vehicles at the corner of Howard and California Drive. He also stated that there already were three 24-minute metered parking spaces around the corner on Highland Avenue. He concluded by saying that staff did not recommend considering a new 24-minute zone around the corner from three existing spaces until the business had more time to establish itself. Commissioner Conway stated that he agreed with staffs recommendation and also stated that this business was not far from Lot M, or the on-street parking on Highland and Howard Avenues. Commissioner Cohen said that based on his observations of the area, he believed that there was usually parking available on California Drive. However, he also stated that he was concemed about the Califomia side of Sam's Sandwiches and that there was no red, green, yellow, or white zones along that curb. He said that he has seen people park there next to the curb, which appeared to be a dangerous situation. Chair Warden informed the Commission that he and Traffic Engineer Chou visited the site around 1:15 PM, and there was indeed three green zones on Highland. He added that two were available, with adequate parking across the street on California Drive and several spaces on Highland that were also available. He stated that he did not support any changes, but would like to agendize for next month the curb situation on the Califomia Drive side. Mr. Chou explained that staff was already proceeding with the installation of red curbing there since the street width, if parking were officially allowed, would be substandard. 7 The City of Budingame Page Chair Warden requested Ms. Donnelly's business contact information so the sub-committee members and staff could contact her and coordinate a mailing in reference to setting up a meeting in September, prior to bringing this item back to the Commission next month. zone. M/S/C: James, Conway; 5/0/0 4.2.4 Cadillac Way realignment One-way street designation and/or parking space Traffic Engineer Chou presented a overhead of the area in question. He also informed the Commission that staff recommended referring this item back to Public Works - Engineering. He added that based on calculations and drawings, there would actually be a loss of between five and thirteen spaces if diagonal parking was implemented on Cadillac Way. This was because in order to accommodate diagonal parking and maintain two-way traffic, parking could only be installed on one side of the street. Chair Warden stated that he talked to Mr. Jim Hanney, of Rector Motors, and that Mr. Hanney agreed that losing those spaces would not be in his best interest. Mr. Chou explained that this is a courtesy item on the Commission agenda because Mr. Hanney's original request to Public Works was also copied to the Commission and the Council. No action was required by the Commission since it was being handled by staff on a staff level. 4.2.5 Edgehill Road and Chula Vista Avenue - Stop sign request. Traffic Engineer Chou explained that a full warrant study was not yet completed, but that no accidents were recorded for the past 12 months. He explained that the actual problem could be due to speeding vehicles. He said that this would be continued for next month when a full warant study would be ready. 4.2.6 Broadway - Double-yellow centerline installation Chair Warden said that he felt this method worked well on Burlingame Avenue, and thought it might also work well on Broadway. Traffic Sergeant Shepley stated that the double-yellow line actually did not prohibit U-turns, but just prohibited driving on the left side of the roadway. He cautioned that for Broadway, this might add to the existing backup situation there. Sgt. Shepley also explained that there were currently two City ordinances prohibiting U-turns on Broadway. TRAFFIC, SAFEW AND PARKING COMMISSION Meeting Minutes - Unapproved Thursday, August 11, 2005 7.3 Vice-chair Condon added that the DBID had a program to install parking banners throughout the Burlingame Downtown district from Chapin Avenue to Howard Avenue, and from El Camino Real to Galifomia Drive. M/S/C: James, Condon; 5/0/0 7.2.2 Joint Council/Commission Meeting: October'13, 2005 at 6 PM Traffic Engineer Chou announced that there would be a joint CounciUCommission meeting on October 13, 2005. He encouraged the Commissioners to individually draft up some topics for discussion by the next Commission meeting so that they could have them on the agenda for the Joint meeting. He also encourage all the Commissioners to attend that meeting because it was an opportunity to review with Council what the Commission has done, what the Commission has planned, and what the Commission would like to see for the future. From Staff to Commission 7.3.'l Traffic Engineer's Report Traffic Engineer Chou reported that the annual street resurfacing/paving program was completed. He also reported that staff was going ahead with the three TDA grant projects (bikeways signs, countdown pedestrian signals, and lighted crosswalk). He concluded that late fall might be about the completion date for two of these projects. 7.3.2 Tratfic Sergeant's Report Traffic Sergeant Shepley reported that the parking enforcement staff had been reduced; and, that the projected citation revenue goals might not be met this year. Shepley also reported that two DUI checkpoints would be conducted in August - of which, one was being administered by the Daly City Police Department under an OTS grant. The second checkpoint operation would be run by Sgt. Downs and Sgt. Shepley for Burlingame. He also said that grants for a pedestrian crosswalk sting operation have been submitted for Califomia and Bellevue crosswalk. A sting operation for street racing operation was also planned, but would be delayed pending the adoption of the proposed street racing ordinance. 7.4 From Commission to Staff 7.4.1 Reports of citizen complaints or requests. None. 7.5 Comments and communications None. 7.6 Next meeting: September 8, 2005 There were no anticipated absences from either staff or the Commissioners. 8, INACTIVE ITEMS 8.1 Easton Drive - Eucalyptus tree at Easton and Cabrillo Traffic Engineer Chou reported that he was expecting to conduct trafflc counts in September and have this item ready for discussion in October. Traffic Engineer Chou reported that this item would be placed on the agenda for discussion in September since the 6-month period would be over by then. Commissioner Cohen stated that the first block of Occidental Avenue near the church by Bellevue did not appear to have the 2-hour parking signs, and that this was created a long term parking problem. He added that he was anticipating to have this item ready for discussion in October if the park was ready by then. BAGKGROUND: At the August 11, 2005 TSPC meeting, the Commission heard from Mary Donnelly of LSG Sky Chefs regarding the public parking situation around their Cowan Road facility. On September 1, LSG Sky Chefs consolidated their work force by relocating all their employees at Adrian Road to the larger facility on Cowan Road. moving in preparation of the increase in parking demands due to the consolidation of their offices. Approximately 150 new employees, spread over three work-shifts, have been added to the Cowan Road facility. As a way for the City to address both the Sky Chefs situation and other existing pa*ing concerns throughout the entire commercial/industrial area bounded by Cowan Road/Mahler Road and Gilbreth Road/Bayshore Highway, the Commission established a sub-committee. The main goal of the sub-committee is to set up public meetings to determine the actual needs and demands of the various businesses in the area. DISCUSSION: Staff is currently working to set up two public meetings for the business owners and tenants around the Cowan/Gilbreth/Mahler area. The first meeting was to be at the Sky Chefs Co.wa1 Road facility. A second public meeting is planned to be held at City Hall, and will serve as a final meeting to accommodate any public that could not make the first meeting on Cowan Road. Sinte not all of the public meeting has not taken place yet, staff and the sub-committee are not prepared to provide a recommendation at this time. I Meeting Date: Sept. 2.2005 STAFF REPORT SUBMITTED BY TO: Traffic, Safety and Parking Commission DATE: September 8, 2OO5 FROM: Augustine Chou, Traffic Engineer SUBJECT: Agenda ltem 4.2.2 Edgehill Road and Chula Vista Avenue - Stop Signs RECOMMENDATION: Staff does not recommend the installation of stop signs at the intersection of Edgehill Road and Chula Vista Avenue. D|SCUSSION: Staff conducted a full stop sign warrant study at this location. Traffic volume counts and accident history were examined. The data collected did not support consideration for stop signs. The accident history review revealed that there have been no reported accidents at the intersection of Edgehill Road and Chula Vista Avenue over the last 12-month period. This lack of reported accidents demonstrates that drivers in the area are exercising due caution when approaching the intersection from all the approaches. Additionatly, staff conducted a field examination for sight visibility and determined that there are no significant sight-visibility impairments on the corners that would cause drivers to significantly alter their driving behavior in order to traverse this intersection. Similarly, the traffic volume data collected for the warrant study showed that there is no extraordinary amount of vehicular traffic on Edgehill Road or Chula Vista Avenue that would cause serious and persistent problems with drivers over right-of-way assignment. Staffs determination regarding this intersection is that it is not so significantly different from other intersections in the area that it would warrant further consideration for stop signs. Two hour parking at the church is appropriate. lf no cars park on the street, it appears wider which encourages speeders. Mr. Klein requested the signs be removed. Ms. Blunt requested the signs be removed and that special parking permits be issued to residents if the signs remain. She requested notices be sent again for next month's meeting because the last notice arrived late. Ms. Yost requested the signs remain due to the church day care, church events, and shoppers parking on Friday and Saturday nights. Mr. McVeigh requested the signs remain and special parking permits be issued to residents. Mr. Beaudreau requested speed limit signs be installed. Sgt. Cutler advised that staff costs are a major reason for not issuing permits and that such a program would be citywide, not street by street. Chair Cohen stated that noticing the neighborhood is necessary since this would be a major change and volunteered to go door-to-door to obtain resident input before next month's meeting. 2 2.12.04 5.2 DISCUSSION ITEMS 5.2.2 Request removal of 2-hour parking limit on Occidental Avenue Vice Chair Warden stated that this item is continued to the March meeting when Chair Cohen will return with a completed survey. 3.'t 1 .04 4.2 DISCUSSION ITEMS. 4.2.1 Request removal of 2-hour parking limit on Occidental Avenue Chair Cohen stated that he canvassed the neighborhood for opinions and concems about the current parking situation. He stated that he found a 50-50 split between support and objection on this mafter. From the floor, Frank Kelly requested removing the 2-hour signs or not enforcing them. Jeriann Fleres requested removing the signs or providing resident parking permits. Susie Klein requested removing the signs or providing resident parking permits. Joe McVeigh asked about the City wanting to buy the property next to Lot H for more parking. Julie McVeigh stated she has great dfficulty backing out of her driveway on Occidental because of the , especially when cars park near her Minutes 3. driveway. Mr. Chou commented that since there was no clear indication from the residents one way orthe other, a permanent action could cause the City to come back soon after to undo that action. He suggested that the Commission consider a temporary action such as having Public Works crews temporarily remove the signs as an experiment. Comm. Condon then suggested removing the signs for a year to allow enough time for the public to respond to the change. Chair Cohen suggested sending a notice to the local residents of the temporary sign removal so that they are aware that the current parking enforcement action would be suspended for that testing time period. It was moved and seconded (Comms. Condon/Mclver) to make this an Action item; it was then moved and seconded (Comms. Condon/Mclver) to temporarily remove the 2-hour parking signs for one year with two quarterly reviews by a committee made up of three residents of the affected streets to monitor results. Unanimously approved by the Commission. Frank Kelly accepted to chair this committee at Chair Cohen's request. Also, Mr. Kelly is to select two residents with contrary views to balance the committee which will be confirmed by the Commission at the next meeting. 4 4.8.04 4. CURRENTBUSINESS. 4.1 ACTION ITEMS 4.1 .2 Confirm Citizen Committee for Occidental Avenue Chair Cohen stated that he will be contacting other residents who have shown interest in serving on the citizen committee with Mr. Kelly. These residents are to include people who are both for and against the proposal to remove the parking time restriction on Occidental Avenue. He said that this was to ensure a balanced representation for the citizen commiftee. Comm. Condon suggested not removing the parking limit signs before membership on the committee is approved by the Commission. 5.13.04 4.1 ACTION ITEMS 4.1.2 Contirm Citizen Committee for Occidental Avenue Chair Cohen stated that the two-member citizens' committee will consist of Frank Kelly and Elizabeth Yost. He said that they each have opposing views on this issue and would supply the Commission with separate quarterly reports. lt was moved and seconded (Comms. CondonM/arden) to accept the committee members. Unanimously approved by the Commission. After the committee members receive confirmation, the City will start covering the parking limit signs. 2 5. 6.8.12.04 7.2 From Commission to Staff 7.2.1 Reports of citizen complaints or requests Comm. Mclver provided a lefter he received about the corner of El Prado and Canyon Roads which contains foliage so high you can't see cross traffic on Canyon. Mr. Chou willcontact code enforcement. Comm. Warden asked for an update on the Auto Exec cars with For Sale signs still being parked on California Drive. Officer Witt will check on it. Chair Cohen asked for an update on Bellevue. Mr. Chou stated that there is a design problem and cannot get Caltrans' agreement on a good sign location. Chair Cohen asked about complaints received since Caltrans removed signals on El Camino Real at Adeline and at Cambridge. Mr. Chou stated that Caltrans is asking the City to install graphic signs to educate drivers. Comm. Gondon asked if there is an update on Occidental. Mr. Chou advised that the signs wilt be removed by Monday. 7 9.9.04 7.3 FROM COMMISSION TO STAFF 7.3.1 Reports of citizen complaints or requests Mr. Chou stated that the parking signs on OccidentalAvenue have been removed. He also advised that Engineering and Police staffs will be meeting with Our Lady of Angels school next week. Also, he has received calls from the day care school about the plan. The curb painting will be done soon and expects improvement of the situation next week. 8.10.14.04 8. DISCUSSION ITEM 5.2.6 Occidental Avenue - Temporary removal of 2-hr parking restrictions: 6-month final review. Mr. Chou explained that this was the six-month review for the parking situation on Occidental Avenue. Some residents support the removal of the 2-hour limit on a permanent basis, and others support the reinstatement of the limitations. Commissioner Condon commented that perhaps there should be a next phase of this experimental parking test. He suggested the 300 block of Occidental between Chapin and Ralston have no limit parking, and reinstate the 2-hour parking limit for the rest of the street. Frank Kelly stated that he has had no problems since the restriction was temporarily lifted and suppo(ed the permanent removal. Theresa Bain stated that she has had problems and would like the restriction retumed. Clarence Metcalfe stated that the rest of Occidental seemed to still have problems but that the people on the west side of the 300 block seemed not. Commissioner Cohen suggested that maybe the Commission should consider returning the limit back to the rest of the street, but exclude the west side of the 300 block. Motion:To move this to an Action ltem. 4 2.10.05 Mr. Chou stated that this item is in the fifth month of review; and, that next month would make the end of the six-month evaluation period. Chair Warden stated that he has received mostly negative feedback with nothing positive to report. Traffic Engineer Chou reported that Public Works received no new comments other than a question about a 'missing', or as yet uninstalled sign at the corner of Occidental Avenue and Ralston Avenue. He stated that after a field investigation, it was determined that there was an old pole which had no new sign posted. Mr. Chou explained that it was determined that the pole should be removed, because its placement was redundant and unnecessary. 6.9.05 8. ORDINANCE OF THE CITY OF BURLINGAME ADDING CHAPTER IO.72TO THE BURLINGAME MUNICIPAL CODE TO PROHIBIT THE GATHERING OF SPECTATORS AT ILLEGAL SPEED CONTESTS, EXHIBITIONS OF SPEED, AND SIDESHOWS The CITY COLTNCIL ofthe CITY OF BURLINGAME does hereby ordain as follows: Section l. This ordinance is adopted in order to provide law enforcement with additional means by which to discourage and prevent dangerous street racing and sideshows in the community. Section 2. A new Chapter 10.72 is added to read as follows: Chapter 10.72 SPECTATORS PROHIBITED AT ILLEGAL SPEED CONTESTS, EXHIBITIONS OF SPEED, OR SIDESHOWS Sections: 10.72.010 10.72.020 10.72.030 t0.72.040 t0.72.050 Purpose. Definitions. Spectator at illegal speed contest, exhibitions of speed, or sideshows - Violation Relevant circumstances to prove a violation. Admissibility of prior acts. 10.72.010 Purpose. (a) The city council finds and declares that motor vehicle speed contests and exhibitions of speed conducted on public streets and highways are illegal under California Vehicle Code section 23109 . Motor vehicle speed contests and exhibitions of speed are commonly known as street races or drag races. Streets within the city have been the site of illegal street racing over the past several years. Such street racing threatens the health and safety of the public, interferes with pedestrian and vehicular traffic, creates a public nuisance, violates the rights of persons to peacefully use and enjoy the city and its facilities, parks, and walkways, and interferes with the right of business owners to enjoy the use of their property within the city. Illegal street racers accelerate to high speeds without regard to vehicular traffic, pedestrians, or vehicles parked or moving nearby. In addition, the Bay Area has witnessed a variation on speed contests called sideshows, where drivers of vehicles engage in reckless stunts and maneuvers on streets, sidewalks, and other public places in the presence of spectators. These sideshows constitute a public nuisance. (b) Those who participate in this illegal activity can be very sophisticated, using their cell phones, police scanners, and other electronic devices to communicate with each other to avoid detection or arrest. They also use the Internet to provide information on where to race, and give advice on how to avoid detection and prosecution. Traffrc accidents, property crimes, and calls for police service can increase dramatically. The mere presence of spectators at these events fuels the illegal street racing and sideshows and creates an environment in which these illegal activities can flourish. (c) This chapter is adopted to prohibit spectators at illegal street races and sideshows with the aim of significantly curbing and inhibiting this criminal activity. The chapter gives proper notice to citizens as to what activities are lawful and what activities are unlawful. In discouraging spectators, the act of organizing and participating in illegal street races and sideshows will be discouraged. 10.72.020 Definitions. For purposes of this chapter, the following definitions shall apply: (a) "Illegal motor vehicle speed contest" or "illegal exhibition of speed" means any speed contest or exhibition of speed referred to in Califomia Vehicle Code sections 23109(a) and23l09(c). (b) "Preparations for the illegal motor vehicle speed contest, exhibition of speed, or sideshow" include, but are not limited to, situations in which: (1) A group of motor vehicles or individuals has arrived at a location for the purpose of participating in or being spectators at the event; or (2) A group of individuals has lined one or both sides of a public street or highway for the purpose of participating in or being a spectator at the event; or 28/3 1/200s I 2 aJ 4 5 6 7 8 9 l0 1l 12 t3 t4 15 t6 t7 l8 19 20 2l 22 23 24 25 26 27 28 (3) A group of individuals has gathered on private property open to the general public without the consent of the owner, operator, or agent thereof for the purpose of participating in or being a spectator at the event; or (4) One or more individuals has impeded the free public use of a public street or highway by actions, words, or physical barriers for the purpose of conducting the event; or (5) Two or more vehicles have lined up with motors running for an illegal motor vehicle speed contest, exhibition of speed, or sideshow; or (6) One or more drivers is rewing his engine or spinning his tires in preparation for the event; or (7) An individual is stationed at or near one or more motor vehicles serving as a race starter. (c) "Sideshow" means a gathering, procession, or assemblage of vehicles on highways where vehicles in motion are used to exhibit stunts and maneuvers in the presence of spectators. (d) "Spectator" means any individual who is present at an illegal motor vehicle speed contest, exhibition of speed, or sideshow or at a location where preparations are being made for such activities, for the purpose of viewing, observing, watching, or witnessing the event as it progresses. "Spectator" includes any individual at the location of the event without regard to whether the individual arrived at the event by driving a vehicle, riding as a passenger in a vehicle, walking, or arriving by some other means. I0.72.030 Spectator at illegal speed contest, exhibitions of speed, or sideshow - Violation. (a) It is unlaufirl for any individual to be knowingly present as a spectator, either on a public street or highway, or on private property open to the general public without the consent of the owner, operator, or agent thereof, at an illegal motor vehicle speed contest or exhibition of speed. (c) It is unlawfirl for any individual to be knowingly present as a spectator, either on a public street or highway, or on private property open to the general public without the consent of the owner, operator, or agent thereof, at a sideshow. (d) It is unlawful for any individual to be knowingly present as a spectator, either on a public street or highway, or on private property open to the general public without the consent of the owner, operator, or agent thereof, where preparations are being made for a sideshow. (e) An individual is present at the illegal motor vehicle speed contest or exhibition of speed if that individual is within 200 feet of the location of the event, or within 200 feet of the location where preparations are being made for the event. (f) Exemption: Nothing in this section prohibits law enforcement officers, a medical professional, or a firefighter from being present at illegal motor vehicle speed contests, exhibitions of speed, or sideshows in the course of their official duties. 10.72.040 Relevant circumstances to prove a violation. Notwithstanding any other provision of law, to prove a violation of section 10.72.030, admissible evidence may include, but is not limited to, any of the following: (a) The time of day; (b) The nature and description of the scene; (c) The number of people at the scene; (d) The location of the individual charged in relation to any individual or group present at the scene; (e) The number and description of motor vehicles at the scene; (f) The activities in which the motor vehicles are engaged; (g) Whether the individual charged drove, walked, or was transported to the scene; (h) How long the individual charged was present at the scene of the event; (i) Whether the individual charged has previously participated in an illegal motor vehicle speed contest, exhibition of speed, or sideshow; 48/3 t/2005 I 2 J 4 5 6 7 8 9 l0 11 I2 13 t4 l5 t6 t7 18 t9 20 2l 22 23 24 25 26 27 28 O Whether the individual charged has previously aided and abetted an illegal motor vehicle speed contest, exhibition of speed, or sideshow; (k) Whether the individual charged has previously attended an illegal motor vehicle speed contest, exhibition of speed, or sideshow; (f Whether the individual charged previously was present at a location where preparations were being made for an illegal speed contest, exhibition of speed, or sideshow, or where an exhibition of speed, illegal motor vehicle speed contest, or sideshow was in progress. 10.72.050 Admissibility of prior acts. The list of circumstances set forth in section I0.72.040 is not exclusive. Evidence of prior acts may be admissible to show the propensity of the defendant to be present at or attend an illegal motor vehicle speed contest, exhibition of speed, or sideshow, if the prior act or acts occurred within three (3) years of the presently charged offense. These prior acts may always be admissible to show knowledge on the part of the defendant that a speed contest, exhibition of speed, or sideshow was taking place at the time of the presently charged offense. Prior acts are not limited to those that occurred within the city. Section 3. The provisions of this ordinance are severable, and if any word, clause, sentence, paragraph, provision, or part ofthis ordinance, or the application ofthis ordinance to any person, is declared invalid, preempted, or unconstitutional by any court, that holding shall not invalidate any other portion of this ordinance. The City Council finds and determines that it would have adopted this ordinance without the word, clause, sentence, paragraph, provision, or part that was declared invalid. Section 4.
