BACKGROUND
Mercy High School is an alFfemale Catholic cpllege-preparatory sghool-gwhed and operated by
the Sisters of Mercy - West Mid-West Oommunity, a community of Catholic women.
Fdhf & Peers previously prepared a memorandum for the Sisters of Mercy: Slsters of Mefty,
Burllng.anp Comnunity Campus fuisting Cctnditions. This memorandum quantified exlsting
(2006) parkihg and vehicle trip generatlon charac'teristicd of the Campus. The flndings were used
to obtaln a condiflonal use permit ln March 2007 from tire City of Burlingame.
Mercy High School has requested Fehr & Peers quantity the incrgaSe ln parking and vehicle trip
generation associated wlth scenarios lnvolvlng the addition of students and staff/faculty.
VEHICLE TRIP AND PAHKING GENEHATION
Vehicle trip geperAtlon rates for Mercy Hlgh School are taken from Sisfers of Mercy, Builingame
Communlty Campus.Existing Condltions. They were deriVed hom empirlcal data - taffic counts
taken at driveway access points. Parking occupancy rates were reported by Mercy Hlgh School
Administrdtion.
Vehlcle Trip Generation
Vehlcle trip rates include student plck-u/drop off, staff/faculty anivaUdeparture, shude bus pick-
up/drop-off, maintenance sEff, deliveries, and other various trips associated with the tp'aal
weekday operation of Mercy Hlgh School. They are derlved from counts taken at the Main gate of
Mercy Hlgh school, located at Adeline Drive and Alvarado Avenue, divlded by the studant
enrollment at the time at which they wele cotlected. Vehicle trips to a school over the course o[
the week are stable due to the cohsistent schedule kept by schools; students separately anlve
and depart at the same time almost every day.
Vehicle trlp rates are based on student enrollment, as this number is easlly available and stable
throughout the school yaar, Vehicle trip generation ratBs were derlved for the following tlme
periods and are preEented in Table 1,

AN OVERVIEW OF THE RELATIONSHIP OF MERCY HIGH SCHOOL BURLINGAME
AND SISTERS OF MERCY WEST MIDWEST COMMUNITY'S BURLINGAME CAMPUS
This memorandum will summarize the relationship between the Sisters of Mercy West Midwest
Community and Mercy High School and between the separately-owned parcels that are used by the two
corporations.
1. Relationship of Mercy High School Burlingame and the Sisters of Mercy West Midwest
Community, Burlingame Campus: Corporate
a. Sisters of Mercy, Burlingame Regional Community, was a California non-profit
corporation, originally formed in 1868. ln July 2008 it merged into Sisters of Mercy
West Midwest Community, a non-profit corporation that owns and operates six
campuses in the Midwest and Western United States.
b. Sisters of Mercy purchased approximately 38 acres of property in Burlingame in 1924,
consisting of the properties now separately owned by the corporation of the Sisters of
Mercy and by the corporation of Mercy High School Burlingame.
c. The Sisters of Mercy opened Mercy High School in 1932. Mercy High School Burlingame
later became a separate California non-profit corporation.
d. Mercy High School Burlingame remains a sponsored ministry of the Sisters of Mercy.
2. Relationship of Mercy High School Burlingame Campus and Sisters of Mercy West Midwest
Burlingame Campus: Property
a. The campus of the Sisters of Mercy belongs to the Sisters of Merry West Midwest
corporation and consists of 34.24 acres.
b. The campus of Mercy High School belongs to the corporation of Mercy High School
Burlingame and consists of a 3.74 acre "island" within the Sisters of Mercy campus. This
island is land-locked without ownership of its own access to a public street. Sisters of
Mercy granted this parcel of land to the corporation of Mercy High School Burlingame
on January 31, 1953. The high school property includes the Kohl Mansion.
3. Relationship of Mercy High School Burlingame Campus and Sisters of Mercy West Midwest
Burlingame Campus: Shared Property Uses
a. The corporation of the Sisters of Mercy owns Russell Hall but the majority of space is
leased to the High School and is used for classrooms . a library, and some staff offices.
b. A swimming pool located on Mercy High School property is owned by the Sisters of
Mercy corporation but is primarily used by the High School.
c. The High School utilizes parking spaces located on property owned by the Sisters of
Mercy.
d. The High School leases a small portion of its building to a Montessori pre-school. Sisters
of Mercy lease a small portion of its land (for no fee) to the HiBh School which, in turn,
allows the Montessori pre-school to use this property as a playground.

4. Relationship of Mercy High School Burlingame Campus and Sisters of Mercy West Midwest
Burlingame Campus: Shared Conditional Use Permit
a. Because many of the parking spaces dedicated to Mercy High School are located on
Sisters of Mercy land, a problem was created under the Burlingame Zoning Code, which
provides that all required parking for a property be located on that property, or adjacent
property under common ownership. ln order to satisfy the Code, the City required that
the Sisters of Mercy and the High School obtain a joint Conditional Use Permit. This
permit was approved by the City Council in 2007 . lt sets forth the collective uses and
parking allocations for the two properties. The Conditional Use Permit did not merge
the two properties or create a single parcel.
b. The primary use of the Sisters of Mercy property is to serve as home for members of the
order and as a retreat center for members of the public seeking spiritual education and
growth. Any future development on either property should be consistent with these
purposes.

I would like to recap some of the history and actions pertaining to traffic in and around Mercy High
School.
The traflic over the last few years has increased, especially on Alvarado Ave. For the last 4-5 years it
has become dangerous with multiple cars side swiped on Alvarado and significant property damage.
In addition during the morning and afternoon school drop off and pick up hours it is dangerous to
enter and exit the driveways on Alvarado due to both the volume and speed of the traflic.
The problem on Alvarado has grown significantly worse, especially in the last 5 to 6 years due to 2
reasons. First, the residents ofAdeline organized and were able to get a significant number ofstop
signs on Adeline. This shifted some of the traffic to Alvarado. In addition the prior increase in
enrollment at Mercy to 500 students from approximately 440 has significantly increased the traffic.
That has been coupled with what is probably an increased number ofout ofarea students that has
created this dangerous situation. It is only a matter of time before a resident on Alvarado is broad
sided and seriously injured.
The remediation of this dangerous situation requires both action by Burlingame in addressing the
traffic patterns and speed, but also action by Mercy in putting in place permanent rules regarding
the drop offand pick up ofstudents.
Several neighbors met with Mr. Augustine Chou and offered a number of alternatives to the current
traffic flows and drop offcongestion. Amongst the alternatives for traffic patterns were:
1. Opening up the lower Mercy gate and routing some traffic through the lower parking lot for
drop offand student parking. This action could split the traffic pattern, and spread it over a
larger number of streets.
2. Placing a restriction on how vehicles can exit Mercy's main gate by forcing cars to turn right
or left. This would in essence make Alvarado one way for both high school and Mercy events
and spread out the impact of the tralllc.
3. Changing the traffic pattern for entry into Mercy so cars can only enter from the east on
Adeline and exit through Alvarado cr Adeline to the west. This would eliminate crossing
traffic and also mitigate the impact on a single street. It would require enforcement from
Mercy and would have to be a condition of the use permit.
4. Allowing a flow through traffic through Mercy so that traffic entered from one gate and
exited from another.
5. Creating drop off points outside the Mercy Campus and only allowing drop off in campus to
those who are car pooling with 2 or more Mercy students, or those with Mercy parking
permits. Again this restriction would need to be codified in the use permit with appropriate
annual reporting and penalties for non-compliance.
There were also several suggestions for dealing with the speed and rampant stop sign running at
Alvarado and Hillside.
1. One suggestion is to reconfigure the traffic island at Alvarado and Hillside. The current
configuration allows cars to excessively speed entering Alvarado from Hillside. In addition
cars coming down Hillside do not yield to those at the stop sign at Alvarado. This could be
mitigated by curving Alvarado so that it intercepts Hillside at a 90 degree angle. If
configured properly this would remove the strait entry into Alvarado from Hillside, which
would force cars to slow, and also create a 3 or 4 way stop at Alvarado so that the game of
chicken would be reduced.
2. The second alternative is speed bumps on Alvarado, which we understand are not favored
by the City.
The added advantage of the curved entry to Alvarado would be that the old bus stop on Hillside
could be used as a drop off point. Crosswalks could be put in to alleviate the safety concern of
students having to cross Hillside.
I would like to emphasize that allowing an expansion of traffic due to added enrollment should only
occur AFTER this issue is resolved. The solution needs to be put in place and monitored for at least a
semester if not more.
I would like to also support Jeb Gibney's request for data regarding the past and future student
numbers for Mercy. This is a situation that requires planning and enforcement of the rules if it is to
be resolved.

In regards to the Mercy High School traffic on Alvarado Ave. and Adeline Drive. It would be
beneficial to all of the neighbors on Alvarado Ave. and Adeline Drive to know the following:
Will the city of Burlingame conduct a traflic meter survey on Alvarado Ave and Adeline Drive
during the regular school year?
\ilhat has the enrollment been at Mercy High School for each of the preceding 5 years?
How many students were allowed to park on campus for each of the preceding 5 years and
how many students car pooled for each ofthe 5 years?
\ilhat is the 5 year plan for Mercy High School in regards to expanding the student enrollment
and the anticipated increase in the number of staff for the next 5 years - broken down by year.
a. number of students
b. number of staff
c. number of students allowed to park on campus
d. number ofparking spaces to be dedicated to students for each ofthe 5 years
e. number ofparking spaces to be dedicated to stafffor each ofthe 5 years
What further expansion of facilities are planned for the next 5 years and where will the facilities
be located?
\Vould Mercy High School support the following?
a. establishing a drop off point for students on the south side of Hillside and Alvarado?
b. routing honor students through the main gate on Alvarado?
c. routing the remaining students through the lower gate on Adeline?
d. creating a one way flow of arriving students through the main gate. Having parents
who are dropping offstudents continue through the campus and exiting through the
lower gate onto Adeline - the 'inconvenience " this may have on the convent will be
off set by the improved relationship with the local community. This certainly will be
less disruptive to the tranquility ofthe convent than the late night parties that are
hosted by the school.
e. only allow cars with more than 3 student to enter through the main gate. All other cars
that are going to be allowed to park must enter through the iower gate. Drop offs must
be done at the corner of Alvarado and Hillside.

I have two major concerns in regards to the Mercy High School traffic on Alvarado
Ave. and Adeline Drive.
The first concern is safety:
Sister of Mercy has no way to enforce any safety standards on any of the public
streets.
Their efforts to do this have been completely ineffectual as attested to my numerous
complaints by residents reporting damaged parked cars and hit numerous hit and
run incidents.
The second is traffic flow in the morning and afternoon:
It is both difficult and dangerous to exit and enter driveways on both of these
narrow streets even at times when the school is not in session.
When the school is in session the situation is exacerbated by parents and students
attempting to arrive at school in the morning and for the parents to continue on to
their jobs. Very few people allow sufficient time for any trip especially for school or
work. The parents and students often do not follow the general courtesy of
allowing alternate passage for others. The narrowness of Alvarado and Adeline
require the driver to be focused and courteous to others due to the narrowness of
the street and the plethora of automobiles and trucks that are parked on these
streets.
I recognize the reluctance of the school to re rout the traffic between the school and
the convent in order not to disrupt the religious life of the convent. The citizens on
Alvarado and Adeline would request the same consideration. The school is
requesting to increase enrollment which will have a direct impact on the entire

If the city does not want to inconvenience the school and / or the convent the very
least it can do for the neighborhood is to insist the traffic exiting the school from the
main gate must make an immediate right or left onto Adeline and not proceed south
on Alvarado. This will at least reduce the traffic that would normally exit the gate
and proceed south on Alvarado.
As the school will want and need to continue to grow its enrollment they need to
develop a 5 year plan to improve the roads within the property to allow for
additional entry and
egress.

RESOLVED by the CITY COUNCIL of the CITY of BURLINGAME that:
WHEREAS, this matter came before the City Council for public hearing on February 21,
2007, on appeal from the decision ofthe Planning Commission approving the conditional use permit,
and was regularly noticed in accordance with State and City law; and
WHEREAS, the Council received and considered all written documentation and oral
testimony submitted from all interested persons; and
WIIEREAS, the Council visited the neighborhood and spoke with neighbors and the
applicants; and
WHEREAS, the properties have been used for social, cultural, religious, and educational
purposes for many years; and
WHEREAS, in 1961, the owners had applied for and received a conditional use permit for
"high school, college, convent and all related facilities" from the County of San Mateo; and
WIIEREAS, in I 979, the properties were annexed into the City of Burlingame and prezoned
as R-1; and
WHEREAS, in the City of Burlingame, the uses encompassed within the conditional use
permit approved by the County are conditional uses in the R-l District; and
WHEREAS, the property ownerc have come forward voluntarilyto establish a baseline for
the uses and facilities on the property and the scope of the preexisting County use permit; and

WIIEREAS, California law is not cefiain whether the preexisting conditional use permit
runs with the land upon annexation or whether the uses under the permit become nonconforming
simply because the permit was granted by the County rather than the City; and
WHEREAS, it does not appear necessary for the Council to determine this issue because the
uses and facilities that exist on the property are uses that are conditional uses in the City's R-l
District; and
WHEREAS, there is some dispute about whether the number of events on the properties or
the way the events are being conducted has changed over the years; and
WIIEREAS, it does not appear that any of the uses have been changed into a different use
from that which existed in 1 979 when the propefties were annexed into the City or even in 1 961 , and
the uses identified in the permit application are the types and levels of uses consistent with the uses
described in the County permit and the annexation documents; and
WHEREAS, these uses can be conducted and the facilities can be operated in such away
as to not cause a nuisance or detriment to other properties, and that establishing conditions in a
baseline permit will assist the property owners, the neighborhood, and the City in working together
to continue the many benefits provided by the property, its programs and services, while ensudng
a minimal effect on others; and
WHEREAS, the uses.and facilities on the properties are an integral part of the cultural fabric
of the Burlingame community and are consistent with the goals and policies of the Burlingame
General Plan;and
WHEREAS, the property owners have demonstrated that many of the proposed conditions
already work, such as the use of a hotline for events and their efforts to limit parking off-site; and
WHEREAS, it is important to sustain usable parking on the properties, while at the same
time ensuring that students use the parking and entrances appropriately; and
WHEREAS, a one-way circulation pattem for the High School does not seem to be feasible
from either an environmental or economical standpoint; and
WHEREAS, it is important that the noise levels from the Kohl Mansion, particularly in the
evenings, be controlled, so amplified music shall only be allowed inside the Mansion; and

WHEREAS, this conditional use permit is categorically exempt pursuant to CEQA
Guideline Section 15301 (existing facilities) in that there is no proposed expansion of use beyond
those existing at the properties; and
WIIEREAS, a review in one year will provide a valuable opportunity to determine if the
conditions are clear, workable, and effective in meeting the concerns of the community,
NOW, TIIEREFORE, it is hereby ordered and directed as follows:
1. The decision of the Planning Commission is affirmed and a conditional use permit
approved, subject to the conditions attached hereto as Exhibit A. The appeal is denied.
2. This resolution shall be recorded in the Official Records of the County of San Mateo.
This decision is afinal administrative decision of the City of Burlingame. Anyone wishing
to challenge this decision in a court of competent jurisdiction must do so within 90 days pursuant
to Code of Civil Procedure Section l}g4.6unless a shofter time is provided by State or Federal law.

MERCY IIIGH SCHOOL
1. that Mercy High School shall only be open during the hours of 6:00 a.m. to 4;00 p.m.,
Monday thlough Friday, fi'om August to mid-June, with a maximum enrollment of 500 students
and 80 faculty/staff members;
2. that after school plograms shall occur only during the hours of 3:00 p.m. to 6:00 p.m.,
Monday thlough Friday;
3. that students shall be informed that cars shall only be parked on-site in designated parking
areas; no student parking shall be allowed to occur in the surrounding residential streets; Mercy
High School staff or representatives shall supervise and monitor campus traffic and parking at
the beginning and the end of each school day during the school year;
4. that all busses used by students or visiting teams shall be parked on site; parking
directions to on-site parking areas shall be provided to visiting teams and schools;
5. that enrollment for summer school and sports camp programs shall be limited to a total of
275 pafiicipants; summer school and camps may occur only during the hours of 8:15 a,m, to 3:15
p.m. Monday through Friday;
6. that Montessori Preschool shall be open only during the hours of 9:00 a.m. to l:00 p.m.
Monday through Friday, with a maximum enrollment of 30 students;
7. that all vehicles delivering students to the Mercy High School and Montessori school
sites or picking students up from the schools on the site shall enter the school campus alea
though the gates to the site and drop students offor pick them up on-site at locations designated
by each school;
8. that in addition to service deliveries, any parking along the service road (shown as
"EASEMENT"on Plot Plan attached as Auachment 1 to 2-21-07 City staff report) and the
service road parkin g area shall be limited to parking for faculty and staff of Mercy High School
and the Montessori school only; no student parking shall be allowed along the service road or in
the service road parkingarca;
9. that any intensification of use including maximum number of students eruolled in the
school, number of support educators and staffor summer school and sports progmm enrollment

number, which exceeds the maximums stated in these conditions shall require an amendment to
this use permit;
KOHL MANSION
1 0. that each contract for rental or use of Kohl Mansion shall include a copy of the noise
limits and other requirements for operation established in these conditions of approval along with
the requirement that the contractor shall comply with each of these requirements or cease its
event on the Kohl Mansion site;
I l. that the base line for defining noise problems used on the Mercy High School site shall be
the established City standard which includes: any noise which is five (5) decibels over the
ambient noise level at the time of the event at property line; and the requirements of Chapter
10.40 of the Burlingame Municipal Code.
12. that in order to monitor and document noise at the Kohl Mansion:
a. Mercy High School shall purchase one or more decibel meter(s), as appropriate,
designed for the purpose of measuring sound out-of-doors; the security and other appropriate
staff shall be trained in the proper use and maintenance of the noise meters;
b. The School shall work with a qualified noise specialist to establish a baseline ambient
noise level at various noise sensitive locations and at various times duringa24 hour period along
the property line of the Mercy High School site;
c. During each event scheduled at Kohl Mansion for the next year, the noise levels at
these established locations shall be measured and recorded in a log. The log shall document
which events used sound amplification and whether the amplification was inside or outside,
including those events with music. This data shall be tabulated monthly into a log and shall be
submitted to the City as a paft of the annual review of the baseline conditions of approval; and
d. Noise measurements shall not be required during the occasional weekday Mercy High
School student body events;
13. that Kohl Mansion events shall be limited as follows:
a. No more than 125 events shall be conducted at Kohl Mansion during any calendar year
that are in addition to Mercy High School events and "Music at Kohl Mansion" events.
b. During any calendar year, no more than six (6) non-school events shall be held during
the day while school is in session, and most guests at such an event shall arrive by bus.
c. The only sound amplification that shall occur outdoors shall be limited to the
amplification of normal speaking voices during speeches, ceremonies, selices, and Mercy High
School rallies and presentations.
14. that events held at the Kohl Mansion shall end:
a. No later than l0:00 p.m., Monday through Thursday, with holidays and evenings
before holidays excepted; and

b. No later than 11:00 p,m. on Friday, Saturday, Sunday, holidays and evenings before
holidays;
15. that between the hours of 10:00 p.m. and 8:00 a.m., the "take-down" for outdoor parties
shall be limited to activities that do not cause a noise disturbance across property lines into a
property located in a residential district, in accordance with Burlingame Municipal Code Section
10.40.039; however, in no event shall tents be taken down between l0:00 p.m. and 8:00 a.m.;
MERCY CENTER
16. that overnight programs at the Mercy Center shall be limited to a maximum of 97 guests;
meetings and sessions as a paft of these programs shall conclude by 9:00 p.m.; these programs
may include an internship plogram in July with a maximum of 60 participants, and retreats which
last an average of three (3) days and a maximum of ten (10) days with an average of 33 retreat
participants;
17. that day programs and activities at the Mercy Center and Chapel shall be limited totfue
activities such as a Sunday speaker sedes; Saturday spiritual direction programs; daily
meditation, chapel and prayer groups; evening serices, including, but not limited to, the Friday
evening Taiz6 service; Sunday mass; non-profit organizational meetings; Mercy Center
bookstore. Day Program events shall be scheduled only during the hours of 9:00 a.m. and 9:00
p.m., and shall be limited to no more than 150 participants;
SISTERS OF MERCY
18. The Labyrinth Garden shall be only open to the public daily from sunrise to sunset.
19. that the Mothelhouse Room and Board facility for Sisters of Mercy shall be limited to a
maximum of 50 residents;
20. that the Marian Care Convent and lnfirmary for Sisters of Mercy shall be limited to a
maximum of 40 residents;
21. that the Lodge Cottage House shall be limited to housing a maximum of 4 residents;
22. that Russell Hall may include classrooms for Mercy High School and administrative
offices for the Sisters of Mercy and Mercy High School. It shall be open for conduct of classes
and business only during the hours of 7:00 a.m. to 7:00 p.m. daily and shall be limited to a
maximum of 35 employees;

ENTIRE SITE
23. that the maximum, cumulative number of guests for all events occuming at any one time
at the Kohl Mansion, Mercy High School, Mercy Center, and the remainder of the facilities and
property subject to this conditional use permit shall be 300. The maximum, cumulative number
of event support staff for all events occuning at any one time at the Kohl Mansion, Mercy High
School, Mercy Center, and the remainder of the facilities and property subject to this conditional
use permit shall bc frfty (50). Any changes in the nature of the events, maximum number of
guests and support staff, or any other provision specified in these conditions shall require an
amendment to this conditional use permit.
24. that as a part of the agreement for use of any facility on the site, information shall be
provided regarding available parking for the event; participants shall be informed that all parking
shall occur on site; there shall be no overflow parking allowed on the surrounding public streets.
25. that Sisters of Mercy and Mercy High School shall provide the neighbors and public with
a2417 phone number for emergencies and complaints. This telephone'hot line' shall be answered
by an individualtrained to respond to neighborhood complaints at the time the complaint is
received, and, in the case of after-hours events at Kohl Mansion, a process shall be instituted that
would convey information about a complaint immediately to the staff member supervising the
event who has the authority to address the issue immediately with the customers and site
sectu'ity;
26. that the Sisters of Mercy and Mercy High School shall be responsible for producing and
providing online to the public a comprehensive calendar of events planned for the facilities on
the properties owned by the Sisters of Mercy and Mercy High School, and a copy of the calendar
shall also be provided to the Burlingame Police Department. The calendar of events shall
include, at a minimum, the nature of the event, the duration of the event, the date of the event and
the contact number for someone wishing to inquire about the calendal and events; tha this
calendar shall be compiled, updated, maintained and posted regularly thloughout the year;
27. that this conditional use permit shall be reviewed in one year (March 2008) at a noticed,
public hearing of the Planning Commission to evaluate the effectiveness of the conditions in
establishing a base line for operations of the collective uses on the properties owned by the
Sisters of Mercy and Mercy High School which compose this site. This review shall include a
review of any complaints logged, including the responses and resolutions of the complaints, and
any changes to operations initiated as a result of any complaints received or from the
administration of the conditions of approval. Notice of the review will be given to owners of real
property within 500 feet of the Mercy propefties, including the properties on the 1400 block of
Alvarado Avenue even if the properties are beyond the 500 foot radius.
