RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BURLINGAME REJECTING ALL BIDS FOR MISCELLANEOUS
STORM DRAIN SYSTEM REPAIRS PROJECT — CITY PROJECT NO. 9827 — AND
AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO NEGOTIATE A
CONTRACT FOR THE WORK WITH APPROVAL OF THE CITY COUNCIL
WHEREAS, the City of Burlingame wishes to repair and improve various portions of its
storm drainage system before the heavy rainy season begins; and
and
WHEREAS, the City issued plans and specifications for the project pursuant to State law;
WHEREAS, on October 23, 1998, the date set for opening of sealed bids for the project, the
City had received only one bid, which it opened as set forth in the bid documents; and
WHEREAS, the one bid received was more than fifty percent higher than the engineers
estimate for the work; and
WHEREAS, the only bidder on the project found that a material error had been made in the
bid, which while lowering the bid amount, probably means that the bid cannot be accepted by the City
and that in effect, the City has not received any bids for the project; and
WHEREAS, the work under the project is extremely important to the health, welfare, and
safety of the community during the coming winter; and
WHEREAS, current economic conditions and the immense construction project at San
Francisco Airport have made the retention of contractors extremely difficult on small public works
projects, such as this one; and
WHEREAS, pursuant to Public Contracts Code sections 20166, 20167, and 22038, the City
may proceed to seek to negotiate a contract for the project under the circumstances; and
WHEREAS, the sole bidder should be eligible to be considered for such a negotiated
contract, because the bidder alerted the City to the material error in time to avoid an overpriced
contract; and
WHEREAS, this resolution is adopted by at least a four-fifths vote of the City Council,
NOW, THEREFORE, the City Council of the City of Burlingame does hereby resolve,
determine, and find as follows:
1. All bids received for Project No. 9827 are hereby rejected.
2. All bonds and security received in connection with the bid received shall be returned
to the bidders.
3. The Director of Public Works is hereby authorized to negotiate with responsible
contractors, including Vanguard Construction, for a contract to perform the work, and to return a
negotiated contract to the Council for approval.
