AGREEMENT AMENDMENT NO. 2 FOR PROFESSIONAL SERVICES
PERMCO ENGINEERING AND MANAGEMENT
CALIFORNIA DRIVE SEWER INTERCEPTOR PROJECT
CITY PROJECT NO. 9609
RESOLVED, by the CITY COUNCIL of the City of Burlingame, California and this
Council does hereby FIND, ORDER and DETERMINE AS FOLLOWS:
1. The public interest and convenience require execution of the agreement cited in the
title above.
2. The City Manager be, and he is hereby, authorized to sign said agreement for and
on behalf of the City of Burlingame.
3. The City Clerk is hereby ordered an

AMENDMENT NO 2. TO AGREEMENT FOR PROFESSIONAL SERVICES
PERMCO ENGINEERING AND MANAGEMENT

THIS AGREEMENT, made in duplicate and entered into this _ day of_ , 1998, by and
between the CITY OF BURLINGAME, a municipal corporation, hereinafter referred to as "CITY" and
PERMCO ENGINEERING AND MANAGEMENT, hereinafter referred to as "CONSULTANT,"
WITNESSETH:
WHEREAS, CITY and CONSULTANT have previously entered into an agreement for certain
services, said agreement being dated FEBRUARY 3, 1997; and
WHEREAS, it is the desire of the parties to amend said agreement as hereinafter set forth;
NOW, THEREFORE, IT IS HEREBY AGREED AS FOLLOWS:
1. Amendment of Agreement
Said agreement dated FEBRUARY 3, 1997is hereby amended to include those revisions
in services and compensation set forth in EXHIBIT "A", attached hereto.
and effect.
2. In all other respects said agreement dated FEBRUARY 3, 1997shall remain in full force

Revised Request for Contract Amendment
Dear Donald:
As you are aware, by the time this project is completed, the period required for construction will
have significantly overrun the original schedule.
The construction schedule has lengthened due to obstructions encountered and material supplier
delays, not to mention several blunders by the contractor. In addition, significant costs were
added to the inspection and testing phase of the work due to overtime and close supervision by
our personnel and that of the soils engineer required by the contractor.
To date, we have invoiced for over $7,000 in overtime (reimbursed to the City by the contractor)
and over $31,000 in soils testing and inspection (versus an original budget of $18,000 and of
which a portion has been reimbursed to the City by the contractor). We have estimated the
remaining inspection and administrative costs at approximately $48,000, assuming construction is
completed by the end of October. A shorter construction period would, of course, lower these
anticipated costs. Also, this month's billing, through August 22°d and including the previously
missed inspection hours, exceeds the original authorized contract amount by approximately
$17,000.
Therefore, we must request an amendment to our contract in the amount of $65,000 to cover the
current overrun and the anticipated remaining costs, Thank you for your consideration of this
