HomeMy WebLinkAboutReso - CC - 078-1998RESOLUTION NO. 78-98 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME REVISING THE FEES FOR ISSUANCE AND INSPECTION OF PERMITS FOR SIDEWALK/DRIVEWAY/CURB CONSTRUCTION AND SEWER AND STORM DRAIN INSTALLATIONS AND CLARIFYING INSURANCE REQUIREMENTS RESOLVED by the CITY COUNCIL of the CITY of BURLINGAME that: WHEREAS, this matter came before the City Council on AUGUST 3 , 1998, and was regularly noticed as required by Government Code § 66016; and WHEREAS, the City Director of Public Works has presented a report to the Council showing that the costs to the City of processing and inspecting encroachments has increased, but that there has been no increase in the fees for this construction for over 7 years; and WHEREAS, the proposed fees do not fully reimburse the City for the costs of providing the issuance and inspections services nor the potential liability to the City for such work; and NOW, THEREFORE, it is hereby ordered and directed as follows: 1. The schedule contained in Exhibit A hereto is adopted for fees and processing of permits for sidewalk/driveway/curb construction and sewer and storm drain construction. 2. The City Engineer is authorized and directed to implement the fees and provisions of the Schedule contained in Exhibit A. This schedule shall become effective sixty required by Government Code § 66017. Mayor I, JUDITH A. MALFATTI, City Clerk of the City of Burlingame, do hereby certify that the foregoing resolution was introduced at a regular meeting of the City Council held on the 3rd day of AUGUST 1998, and adopted thereafter by the following vote: AYES: COUNCILMEMBER: GALLIGAN, JANNEY, KNIGHT, O'MAHONY, SPINELLI NOES: COUNCILMEMBER: NONE ABSENT: COUNCILMEMBER: NONE City Clerk FEE SCHEDULE FOR PUBLIC WORKS DEPARTMENT PERMITS The following fees and bond requirements shall apply. However, the City Engineer may determine that specific construction is extremely complex, difficult, or affects significant public facilities, and increase the amount of the fees or bonds required. In doing so, the City Engineer shall provide a written statement of the reasons and analysis of the increased fee or bond to the permittee. The fees to be applied in such a situation shall not exceed the actual costs of providing the issuance and inspection services. ISSUANCE AND INSPECTION FEES Sidewalk, Driveway, Curb, Gutter Sewer or Storm Drain First 150 Square Feet $ 35.00 Per Square Foot over 10¢ per square 150 Square Feet foot Each permit $ 45.00 BONDS, CASH DEPOSIT, OR LETTER OF CREDIT REQUIRED In an unimproved area (no City surface improvement exist in area involved in work) Sidewalk, Driveway, Curb, Gutter Street Opening (surface repair) Sewer System or Storm Drain Modification or Addition INSURANCE $150.00 $ 8.00/square foot ($300.00 minimum) $ 8.00/square foot ($750.00 minimum) $1,000 or estimated value, whichever is greater, for each connection Liability insurance will be required before a permit is issued, unless the City Engineer determines that the work will be done where there is very little or no public travel or when the area of work is small and the work can be completed in one work day. Liability insurance shall generally be as follows, but in projects of significant potential liability, the amounts required may be increased by the City Engineer: A -I EXHIBIT A A. General liability: Permittee shall maintain limits no less than $100,000 combined single limit per occurrence for bodily injury, personal injury and property damage. B. Automobile Liability: $100,000 combined single limit per accident for bodily injury and property damage. C. The policies are to contain, or be endorsed to contain the following provision: The City of Burlingame, its officers, officials, employees and volunteers are to be covered as insureds as respects liability arising out of activities performed by or on behalf of the Permittee or automobiles owned, leased, hired or borrowed by the Permittee for the project. 2. Each insurance policy required by this clause shall be endorsed to state that coverage shall not be suspended, voided, canceled by either party, reduced in coverage or in limits except after thirty (30) days prior written notice by certified mail, return receipt required, has been given to the City. D. Permittee shall furnish the City with certificates of insurance and with original endorsements effecting coverage required by this clause. The certificates and endorsements for each insurance policy are to be signed by a person authorized by that insurer to bind coverage on its behalf. All certificates and endorsements are to be received and approved by the City before work commences. The City reserves the right to require complete, certified copies of all required insurance policies, at any time. PUBLIC UTILITIES Public utilities may be charged an annual fee on a calendar year basis in the amount of $500.00 to cover all permits for work involving 100 square feet or less of pavement or sidewalk area opening. In addition to this annual fee, the actual costs of inspection of public utility projects involving more than 100 square feet of pavement or sidewalk opening will be filled to the utility company. This billing will be done on an annual basis for projects completed during the year to a maximum of'h of 1% of the actual construction cost. CAWP5 ITILESIPublic WorksTeesresol.res.wpd A-2 EXHIBIT A
