HomeMy WebLinkAboutReso - CC - 077-1998RESOLUTION NO. 77-98 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME ESTABLISHING FEES FOR APPEALS FROM RESOLVED by the CITY COUNCIL of the CITY of BURLINGAME that: WHEREAS, this matter came before the City Council on August 3, 1998, and was regularly noticed as required by Government Code § 66016; and WHEREAS, the City Planner has presented a report to the Council showing that appeals of Planning Commission decisions cost at least $350 in staff time in preparing reports, analyzing issues, and presentation; and WHEREAS, appeals of Planning Commission decisions must be noticed as required by State law and the Municipal Code; and WHEREAS, the Planning Commission hearing process provides a full and fair hearing to all concerned on matters within the Commission's jurisdiction; and WHEREAS, some appeals from the Commission have already been appealed from a decision of the City Planner; and WHEREAS, the taxpayers at large of the City should not solely bear the costs of appeals from the Commission; and WHEREAS, there is no current fee charged for filing an appeal of Commission decision; and WHEREAS, those using the appeals process should bear a fair portion of the costs incurred by the City; NOW, THEREFORE, it is hereby ordered and directed as follows: 1. Any person appealing a decision of the Planning Commission pursuant to the Municipal Code shall be required to pay an appeal fee of $250, which includes noticing costs, at the time that the appeal is submitted to the City. 2. This appeal fee shall become effective sixt required by Government Code § 66017. I, JUDITH A.
